
Chhattisgarh HC rules no prior consent required for electricity transmission lines

RAIPUR: The Chhattisgarh High Court has ruled that prior consent from a landowner is not required for the installation of electricity transmission lines, reiterating that such infrastructure projects serve a larger public interest.
The court stated that landowners are entitled only to compensation and cannot seek an injunction to halt construction. The court noted that Chhattisgarh serves as a power hub, and electricity generation and supply from the state are of paramount importance. It clarified that CSPTCL would not claim ownership of the land where the tower is situated, with ownership remaining with the petitioner. The interim order granted by the court on 15 April 2025 has been vacated.
The High Court observed that while CSPTCL is required to inform the petitioner before entering his land, prior consent is not mandated by the Electricity Act, 2003, and the Telegraph Act, 1885.
Justice Amitendra Kishore Prasad, presiding over a Single Bench, issued the directive to the Chhattisgarh State Power Transmission Company Limited (CSPTCL) and other respondents to provide adequate compensation to the petitioner after a hearing.

The court also directed the petitioner not to obstruct the construction of electricity transmission towers. Authorities have been instructed to disburse the compensation within 60 days of receiving the order.
The petitioner, a 94-year-old agriculturist, owns 8.73 acres of agricultural land in Korbi village, Baloda tehsil, Janjgir-Champa district. He alleged that CSPTCL had dug 16 large pits and commenced construction of transmission towers on his land without prior notice, consent, or compliance with the mandatory conditions of the approval order dated 11 March 2024 issued by the State Government.
The petitioner had sought a court direction to immediately stop the construction work, arguing that the permission granted by the Chhattisgarh State Government had become void due to non-compliance with its conditions by CSPTCL. He also sought restoration of his land to its original condition, removal of erected structures, and exemplary damages for mental harassment.
The petitioner submitted that approximately 4.86 acres (55.7%) of his land had been "illegally encroached upon and disturbed."
He stated that CSPTCL initiated construction as part of a diversion project necessitated by the construction of National Highway No. 130A. He claimed that 16 pits were dug initially, followed by eight more on 8 March 2025, despite statutory requirements mandating prior identification of affected land in the landowner's presence, payment of compensation, and formal permission from the competent authority upon objection.
The petitioner had raised objections through a legal notice dated 31 December 2024, which he said were disregarded. He further claimed that arbitrary compensation notices were issued without site inspection or his presence, and no compensation was provided for Khasra Nos. 730/5 and 658/8.
Counsels for the respondents argued that the claim of the sanction order being cancelled due to non-compliance was baseless.
They stated that compensation had been duly calculated and offered to the petitioner on 24 June 2024 and 22 January 2025, but the petitioner refused to accept it. They emphasised that under the Electricity Act, 2003, and Section 10 of the Telegraph Act, 1885, prior consent from the landowner is not a requisite for erecting transmission lines, as it is a project of national importance.
The respondents' counsel cited a previous High Court order in Manikant Agrawal and Ors.
v. State of CG and others, which, in similar circumstances and for the same project, granted landowners liberty to raise grievances before appropriate forums.
They also highlighted the State Government's notification dated 13 December 2006, which generally authorises CSPTCL officers under Section 164 of the Electricity Act, 2003, to act as Telegraph Authority for laying electricity transmission lines.
The court referenced Supreme Court rulings in Power Grid Corpn. of India Ltd. v. Century Textiles and Industries Ltd. and Century Rayon Limited v. IVP Limited, which underscore the necessity of unobstructed access for laying electricity transmission lines in the larger public interest for national development.

‘Save Powai Lake' human chain plan off over BMC fee
Mumbai: A silent "Save Powai Lake" human chain scheduled for Sunday by local residents and nature lovers was cancelled after the BMC demanded a nominal "event fee" of Rs 11,000 to organise it at the lakeside. Green activists alleged they tried in vain to explain to civic officials that this was not an event but a public expression of concern to save the lake from pollution and floating weeds such as hyacinths. The human chain was planned for Sunday, June 8, to focus on the need to conserve Powai Lake as part of Mumbai region's biodiversity, said the activists. "For about a week the BMC was making us go round in circles for a simple no-objection certificate for the human chain after we obtained the police nod," said Pamela Cheema, chairperson of the advanced locality management committee (ALMC). Police suggested that the organisers seek the BMC's approval as well. Cheema said, "Despite the police forwarding them our request and we ourselves presenting the BMC's S ward office our request, the officials were searching for the documents till Friday." The BMC insisted on payment of "a nominal fee of Rs 11,000" for using the Powai Lake premises, she said. Residents of shaky wadas bear with risks, miss out on tenancy certificates
1 2 Pune: Chandrakant Kandhare (50), an auto-rickshaw driver, has been living at Mote Wada, a crumbling building near Shaniwarwada, for as long as he could remember. He is the fourth generation of the family living at the 200-year-old wada. The same is the case with his neighbours — Kabules and Ghags — who have been staying as tenants at the wada for more than 120 years. They have not heard about the tenancy certificates offered by Pune Municipal Corporation (PMC) to occupants of dilapidated wadas. The initiative by PMC assures rights of tenants of dilapidated wadas. Doubts over its utility, legal value and fear of losing property rights after leaving the dilapidated wadas have kept away many from applying for the certificate. "The govt has put restrictions on redeveloping properties near Shaniwarwada. It has stalled development of wadas. We are left with no option but to stay in this dilapidated property," said Kandhare. All that these residents want is improvement of the building's safety so that their future generations could continue to stay there. The authorities should remove the damaged portions to ensure the safety of residents," he said. According to the residents, their forefathers paid rent of around 20 paise, which went up to around Rs 50 per month. Though parts of the property have suffered damage, many tenants continue to stay put, putting their lives at risk. Though some have moved out, they continue to pay rent either to the owner or in court in case of a legal dispute to ensure that they retain their property rights on the wada. According to PMC data, only around 650 tenancy certificates have been issued since the initiative started about 10 years ago to resolve the legal battle between owners and occupants of wadas. Over 15,000 tenants still live in wadas, mostly in Peth areas of the city. Faced with poor response to the initiative from wada dwellers, the civic administration has been exploring other options like giving additional floor space index (FSI) for redevelopment of wadas. These can be utilised to accommodate tenants as owners if a wada is redeveloped immediately. "But if a wada is not redeveloped immediately, the tenancy certificate is the guarantee of tenancy rights," an official said. Former PMC corporator Vishal Dhanwande, a resident of a Peth area, said, "The administration lacks willingness to deal with the issue. Many officials show reluctance to demolishing these properties. This can lead to major mishaps. The residents of nearby areas can suffer because of the accident-prone structures." He said the administration should make more efforts to convince the tenants to accept the certificates. Camps or special drives should be organised to create awareness about the same, Dhanwande said. Abhay Joshi, a wada resident, said, "PMC should make efforts to resolve the problem of dilapidated structures. Many of us live in dangerous conditions. The properties are dilapidated and can cause accidents any time, especially during the monsoon." PMC has divided these dangerous structures into three categories — C1, C2, and C3. The most dangerous ones are in the C1 category, while those which need major repairs are in C2 category. The C3 category structures need minor repairs. Rajesh Bhutkar, a senior official of PMC's building permission department, said, "Safety and security of people is of utmost importance to us. The administration has been urging people to vacate the dangerous premises following which demolition drives can be carried out. PMC keeps track of people getting tenancy certificates." The civic body had given notices to residents of 103 rickety wadas ahead of the monsoon. "Most of us belong to the financially weaker sections of the society and cannot afford to pay the market rent," said an occupant of a wada. So, they continue to gamble with fate and stay in these crumbling buildings despite the obvious risks.
