
Huge update after man was allegedly attacked by freed immigration detainee at Footscray intersection
Police are expected to lay more serious charges against a former immigration detainee after a man died following an alleged violent assault in Melbourne.
Emergency services were called to the intersection of Nicholson and Paisley Streets in Footscray at around 10am last Sunday after reports of an assault.
Dominic O'Brien, 62, was found with critical injuries and rushed to hospital, where his condition deteriorated over the week.
He died in hospital on Saturday morning.
The 62-year-old was a photographer who had previously worked in the media, according to The Age, which was one of the outlets that employed him.
Police arrested 43-year-old Lominja Friday Yokoju on the same day as the incident, charging him with intentionally causing serious injury.
Victoria Police said investigators will consider alternative charges following the results of a post-mortem.
He has been remanded and will appear before Melbourne Magistrates' Court on October 20.
Mr Yokoju is accused of approaching Mr O'Brien, speaking to him briefly, before allegedly hitting him and stamping on his head while he was on the ground.
The 43-year-old is believed to have been among more than 200 people released from immigration detention in late 2023 after the landmark High Court decision in NZYQ v Minister for Immigration.
116 of the men released were violent offenders, including convicted murderers.
The ruling found indefinite immigration detention was unlawful where there was no realistic prospect of deportation.
At the time of his arrest, Mr Yokoju was reportedly living on a bridging visa and had no fixed address.
Mr Yokoju is due to appear for a committal hearing at Melbourne Magistrates' Court on October 20.

Police have launched an investigation after a video was released on social media in which a bus driver appeared to be struck by a passenger. An unknown man wearing a green tracksuit could be seen punching the driver aboard a vehicle full of passengers at around 6pm on Friday near South Bank in Brisbane. 'No one deserves to face violence in their workplace, especially from a single individual whose reckless actions endangered the safety of everyone on board. 'My thoughts are with the bus driver who was subjected to this appalling and completely unacceptable attack while simply doing his job.' The mayor emphasised that the incident did not reflect the values of the community, describing Brisbane as a 'friendly' city where everyone should feel safe. While noting the city has strong safety protections in place for drivers, Mr Schrinner said violence like this should never happen. 'We shouldn't need them, which is why we continue to stand up for Brisbane against crime to keep our community safe,' he added. Queensland Police confirmed to Daily Mail Australia on Saturday that they were investigating the incident. 'The matter was only reported to police this afternoon, but initial information indicates a driver was assaulted shortly after 6pm Friday, June 20,' a spokesperson said. A man has been stabbed at a popular city farm attraction in said they were called to Heeley City Farm at about 15:00 BST on Friday where the 30-year-old had suffered injuries that were not thought to be life-threatening or life-altering.A 24-year-old man was arrested on suspicion of assault, South Yorkshire Police said. Newcastle men attacked dad trying to save kids from party, court told
Two "drunken yobs" who hit a dad with a baseball bat and shovel as he tried to save his kids from a booze-fuelled party have been spared Bungay, 38, and Jack Doran, 36, attacked the man and his partner after they had gone to Doran's home to get the victim's children, who called him saying they wanted to leave the house full of drunken adults, Newcastle Crown Court man said he feared he was going to be killed and had been left with long-lasting pain and a fractured admitted offences including assaulting the man and woman and were sentenced to two years in prison, which was suspended for two years. Bungay was in a relationship with the victim's ex-wife and they had gone with the former couple's two children to a party at Doran's home on 9 December 2023, prosecutor Nicoleta Alistari messaged her father to say the adults were drunk and she wanted to go, so he and his partner drove to collect her and her brother, the court heard. 'Threatened to kill' The man called police to say he was doing that as he knew Bungay, of Orpington Avenue in Newcastle, was a boxer and therefore there may be violence, the court the man knocked on the door, a woman inside told him the children were there but they were not allowed to leave, the court man called police again and was told officers would be there within an hour, but after two hours they had still not arrived and the man had had more messages from his children begging to collect them, the court the children were allowed out and got in the man's car, but their mum then came out and started screaming at the man to give them back, the court and Doran, of Cestrium Court in Wallsend, North Tyneside, came out armed with a baseball bat and shovel respectively and started attacking the man, hitting him repeatedly with the weapons and punching him, Ms Alistari was shouting he would kill the man during the attack before he punched the victim's partner in the face, the court couple eventually managed to flee leaving the screaming children behind, but not before Bungay had hit the car's door with the baseball bat. 'Should be ashamed' The court heard the man suffered multiple injuries to his head and face, including a broken nose which had made it difficult to breathe, while the woman had bruises and a statement read to the court, the man said he believed he was going to be killed and was left in "considerable pain".Recorder David Gordon said the attack was "absolutely disgraceful" and "drunken yobbery" in front of children."You should both be thoroughly ashamed of yourselves," the judge said, adding it was an irony that Bungay worked as a health and safety consultant when he had shown total disregard for the victims' health and said neither defendant "could have any complaint" if they were jailed but the reality was they would probably only serve 10 months before being released and the prisons were "extremely overcrowded".Bungay must complete 240 hours' unpaid work and Doran 150 hours, and each were ordered to pay £900 towards prosecution costs.
