Woman tells Cork court her ex-husband 'threatened to run her over'
This was the allegation made at an in-camera hearing of Cork District Court for cases brought under the Domestic Violence Act. The man was arrested and charged but there was no objection to bail.
Judge Mary Dorgan asked to hear what was alleged in the case. The circumstances of the alleged incident were outlined by Sergeant Aisling Murphy.
'On June 15 it was alleged that she drove to collect her son from her ex-husband. Her son was entering the car which her husband was also entering.
'She alleged that she made an attempt to speak to him with regards to their son and in doing so she opened the driver's door where he was seated.
'She said he became aggressive and threatened to run her over. He is alleged to have driven away with his car door open,' Sgt Murphy said.
David McCoy, solicitor for the accused, said the allegations were rejected by the defendant who said it was his ex-wife who opened the door of his car when she arrived in the middle of his pre-arranged access with the child.
Judge Dorgan adjourned the case until July 8 so that a date could be set for a hearing of the case.
When charged, the defendant said in relation to his ex-wife on the day of the disputed incident: 'She caused havoc – I hope there are cameras.'

Dubliner claims he's innocent after arson attack destroyed Cork pensioners' home
The two pensioners - both aged in their 80s - were not the actual target of the incident A man is vehemently protesting his innocence in respect of an alleged arson attack which caused €550,000 in damage and totally destroyed the home of two Cork pensioners. Paul McCarthy of Dowth Avenue, Cabra, Dublin, appeared before Cork District Court on a charge of arson at Fernbrook, Ballincrokig, in Co Cork, on April 24 last. The court previously heard that Mr McCarthy (37) was allegedly one of three men who drove from Dublin to Cork to set fire to a house. It was also previously alleged that the incident was video-recorded by one of the men. The two pensioners - both aged in their 80s - were not the actual target of the incident. Sgt John Kelleher told Judge John King that €550,000 worth of damage was caused to the property involved by the blaze. He stated this led to the 'complete destruction' of the house. Sgt Kelleher said that Mr McCarthy first appeared before the court on May 7 last in connection with his alleged role in the incident. He has been remanded in custody since. Sgt Kelleher said that forensic results are awaited in the case following the search of two properties. Gardaí applied for a four-week remand in custody in the case. Defence counsel Nicholas Hall BL said that his client will be insisting that he is entirely innocent of the crime. He stated that the searches were carried out early on and asked that the matter be expedited. Judge King remanded Mr McCarthy in ongoing custody until August 20 next for directions from the Director of Public Prosecutions (DPP). The accused will appear by video link again on that date. Garda Brian Murphy previously objected to bail when the matter first came before Cork District Court. He said that it was alleged that at 9pm on April 24 last a car arrived at the house in Ballincollig and three people emerged from the vehicle. "Two entered the curtilage of the property and ignited two glass petrol bombs with a blowtorch. They smashed a bedroom window and threw in these petrol bombs,' he said. 'The third person – believed to be Paul McCarthy – stands close to the vehicle and allegedly films the incident on his mobile phone. The Skoda Octavia enters the Plaza filling station in Portlaoise just before midnight and Paul McCarthy is identified, filling the car with €30 diesel and leaving without paying.' The vehicle was also detected passing the Watergrasshill toll plaza at 8.30pm that evening. Garda Murphy said that a man aged 87 and his 86-year-old wife were watching television in the house at the time. He told the court that the house was quickly engulfed in flames but the couple were unharmed. Garda Murphy said that if it had been a short time later the pensioners would have been in bed with potentially tragic consequences. 'Paul McCarthy had complete disregard for the elderly occupants of the property which was completely destroyed. From the initial investigations, gardai are not of the belief that these persons were the intended victims,' he said. He added that it was alleged that Mr McCarthy drove from Dublin with the two other individuals. Gardaí indicated to the court that, from their investigations, the two pensioners are not believed to have been the targets of the attack.

Man kicked female jogger in the stomach during random attack in Dublin
It happened 18 days after he was handed a suspended sentence for an earlier theft crime. A woman was the victim of a random "unprovoked" attack where she was kicked in the stomach, knocked to the ground and left in pain after she went jogging in Dublin, a court has heard. Hoyda Hamad, a Syrian national of no fixed abode who has used multiple identities, was jailed for three months on Wednesday over the incident at East Wall Road, Dublin 3, on the morning of July 26 last. It happened 18 days after he was handed a suspended sentence for an earlier theft crime. The 35-year-old, a barber by trade, was charged with a section 2 assault, which carries a six-month sentence, as well as with providing a false or misleading name and address to a member of An Garda Síochána and with using threatening, abusive, or insulting words or behaviour. Cloverhill Prison News in 90 Seconds - August 6th "This was an unprovoked attack on a female member of the community who was going about her own business, out for a jog, and was attacked by someone who was unknown to her, and suffered pain and suffering," said Judge Patricia Cronin at the sentence hearing at Cloverhill District Court Hamad pleaded guilty last week, and the case was adjourned until Wednesday for facts and a victim statement. The woman did not have to attend the hearing or give evidence because of the guilty plea. Court Sergeant Olyn Murphy outlined the prosecution's evidence on behalf of investigating officer Garda Ruth Redmond. Judge Cronin heard that the incident happened at around 10.05 am when the defendant assaulted the woman "by kicking her in the stomach, causing her to fall back on the ground," and Hamad was verbally abusive toward her. She also suffered a back injury, a swollen finger, and her head was "throbbing" after being attacked by Hamad. Gardai attended the scene and Hamad gave a false name and date of birth before being arrested and brought to a station to be charged. Judge Cronin noted that he had two sets of prior convictions, one under the name Hamad with two theft convictions which led to the imposition of a two-month sentence, suspended for one year, in Wexford District Court on July 8. That term could now be activated. He also committed several other crimes under a different name: three for vehicle theft and driving offences, one for drug possession, another for burglary, one trespass and another for failing to provide a passport as required. That resulted in a 10-month prison sentence from Cork District Court on July 31 last year. In a mitigation plea, the defence counsel asked the judge to heed that he had pleaded guilty at an early stage, which was valuable given the moving victim impact statement, which was not read aloud during the hearing. The defence stressed that Hamad did not prolong the ordeal for the woman who did not have to testify, and that he had no prior assault convictions, and should be given significant credit for those factors. Later in the hearing, the defence described Hamad as non-binary and originally from Syria, having come through France. Over recent months, the accused had a transient living situation and was in a transient relationship with a supportive partner, counsel said. Pleading for leniency, the defence described the situation as a "chaotic set of circumstances". Hamad's recollection of events was minimal, and he was apologetic, and his expression of remorse was evidenced by his early guilty plea, the barrister submitted. The accused had been remanded in custody on the date of the incident. Hamad did not testify and spoke only to instruct his barrister that he wished to have the case finalised. Judge Cronin remarked how the victim's statement was eloquent and outlined the psychological and physical injuries, "significant impact", and the life changes the woman made since the attack. The judge found her account to be honest and not exaggerated, and she took notice of the fact that her employer was assisting her in getting counselling. Sentencing, the judge took into account Hamad's plea and prior convictions and that he had none under the Non-Fatal Offences Against the Person Act or similar public order matters. The early guilty plea meant the victim did not have to come to court, she noted. However, she had to take into account all the circumstances and the mitigating factors. The sentence was backdated to July 26, and the judge expressed her wish for the woman to know that she was well in her recovery. The three-month term was handed down on the assault charge, with the two remaining offences taken into consideration.

Truck driver 'maintaining his innocence' over €2.1m cannabis seizure in Cork, court told
A 59-year-old truck driver charged in connection with a €2.1m drug seizure in Cork is 'maintaining his innocence' in the matter, a court has heard. Robert Slivar of no fixed abode, but formerly of Ivanic in Croatia, appeared before a special sitting of Cork District Court last Saturday. He was charged with two offences relating to the seizure of 93 packages of herbal cannabis with a weight of 107kg. Mr Slivar, who travelled to Cork by ferry from Zeebrugge in Belgium, was charged with cannabis possession and possession of cannabis for sale or supply at the Port of Cork, Ringaskiddy, on July 27 last. The alleged offence is contrary to section 3 and section 15 of the Misuse of Drugs Act 1977. Dt Garda Ryan Dillon previously objected to bail in the case citing the strength of evidence and the seriousness of the charge facing the accused. He said that Mr Silvar made no reply after each charge was put to him under caution. Mr Slivar was remanded in custody to appear before Cork District Court on Wednesday, where solicitor, Diarmuid Kelleher, told Judge John King that his client maintains his innocence of any wrongdoing. A statement of means was handed in to the court and free legal aid was assigned. Mr Kelleher said the employers of the accused were 'very concerned about their truck'. Mr Silvar was assisted throughout the short hearing by a Croatian interpreter. Dressed in dark clothing, he was not required to speak during the hearing. Sgt John Kelleher applied for a four-week remand in the case which he described as being in its 'early stages.' He said that 'DPP directions are still outstanding'. Judge King remanded Mr Silvar in custody to appear in court by video link on August 20 for DPP directions.
