Top Court Issues Notice To Centre On Plea Against Blocking 4PM YouTube Channel

The Supreme Court on Monday issued a notice to the Union government on a plea filed by journalist Sanjay Sharma challenging the directive to block the YouTube channel 4PM News Network on grounds of "national security" and "public order".
A bench of Justices B.R. Gavai and K.V. Viswanathan sought responses of the Union government, including the Ministry of Home Affairs, and YouTube, and posted the matter for further hearing next week.
When a prayer for interim relief was pressed, the Justice Gavai-led Bench told senior advocate Kapil Sibal, representing the petitioner, that it was not inclined to pass any interim order without hearing the other side.
In his writ petition filed before the top court, the editor of the digital news platform said that non-furnishing of the blocking order or underlying complaint violated both statutory and constitutional safeguards.
"Rules 8, 9, and 16 of the Information Technology (Procedure and Safeguards for Blocking for Access of Information by Public) Rules, 2009, which permit blocking without notice or hearing, are violative of Articles 14, 19(1)(a), and 21 of the Constitution, as they oust the principles of natural justice and enable a shadow regime of censorship devoid of transparency or accountability," stated the petition filed through Talha Abdul Rahman.
Further, it said that the Constitution does not permit the blanket removal of content without an opportunity to be heard.
"'National security' and 'public order' are not talismanic invocations to insulate executive action from scrutiny. They are constitutionally recognised grounds under Article 19(2), but are subject to the test of reasonableness and proportionality," the plea said.
A vague reference to these grounds, without even disclosing the offending content, makes it impossible for the petitioner to challenge or remedy the allegation, thereby depriving him of his fundamental right to free speech and fair hearing, added the petition.
Recently, in a press statement, the Editors Guild of India said that it was "deeply concerned" by the decision of the Union government to block YouTube Channel 4PM News Network, and termed the move an "opaque use of executive power, without prior notice or opportunity for response".
"Arbitrary takedown orders undermine the fundamental right to freedom of speech. [T]he Guild reiterates its demand for a transparent and accountable mechanism for content takedowns, particularly when it concerns journalistic work. National security cannot become a pretext to silence critical voices or independent reporting," added the press statement.

The Rs 3,800 crore project to be executed in three phases, received Rs 1,622 crore for the first phase of 34 km. DC Roshan recently confirmed that 80% of the land acquisition is now complete. This ambitious project, sanctioned under the Bharatmala project, will help resolve the traffic congestion in Belagavi city. "Most of these projects were delayed despite being sanctioned, because of land-related issues. After I became MP, I prioritised these issues, met Union ministers, held review meetings with officials, and visited the sites. Today, we are seeing the results. I expect the required land to be fully acquired in the next 2-3 months and the tender process to begin within 5-6 months," said MP Jagadish Shettar. He credited DC Mohammad Roshan for playing a vital role in resolving bureaucratic and on-ground challenges related to land acquisition. Mangaluru: Dakshina Kannada MP Capt Brijesh Chowta said that the tender process for the proposed Mangaluru-Bengaluru High-Speed Express Corridor was completed by the ministry of road transport and highways (MoRTH), and the work to prepare a detailed project report (DPR) will commence soon. Providing information about the high-speed corridor project, Chowta said that a letter was received from Union minister Nitin Gadkari regarding the construction of the fastest road corridor between Mangaluru and Bengaluru. A contract for preparing the detailed project report for this project was awarded on April 30, and it is expected to take approximately 18 months to complete the DPR, he said. "The ambitious project, which is crucial for comprehensive development, including commercial activities in Dakshina Kannada, including Mangaluru, has taken a significant step forward under the govt of Prime Minister Narendra Modi. This high-speed expressway is expected to have four to eight lanes and will pass through Hassan. Plea seeks to curb excessive ticket pricing by multiplexes

Kochi: High court has sought the state govt's stand in a public interest litigation (PIL) seeking judicial intervention to regulate alleged profiteering by multiplex operators through excessive ticket pricing. A bench of Chief Justice Nitin Jamdar and Justice Basant Balaji directed the state govt to file a counter affidavit and adjourned the matter to July 1. The petition was filed by G Manu Nair, a resident of Thiruvarppu in Kottayam. In the petition, Nair alleged that cinema chains routinely inflate ticket prices based on demand, time slot and release status, resulting in exorbitant rates, particularly during the initial week of screening. He contended that such price fluctuations occur without any public approval or oversight by licensing authorities under the Kerala Cinemas (Regulation) Act, 1958 and its Rules. The petitioner further pointed out that several Indian states have introduced legal mechanisms to cap cinema ticket rates and ensure affordability. Andhra Pradesh, for instance, imposed upper limits for various theatre classes and mandated a quota of affordable seats. Telangana introduced price caps across seating categories, and Karnataka directed a ceiling of Rs 200 for multiplex tickets. Tamil Nadu has not only instituted a price control regime but also ensured judicial oversight through directions issued by the Madras high court for strict enforcement against overcharging, he added.
