Kerala high court to examine ART practices

Kochi: The high court (HC) will examine the practice of bringing women from other states to Kerala for assisted reproductive technology (ART) procedures. The court noted that such activities are classic cases of 'daunting and inter-state human trafficking', involving transactions worth several lakh rupees.
The bench of Justices Devan Ramachandran and M B Snehalatha had recently interacted with the additional secretary of health services, who is the designated authority under the Assisted Reproductive Technology (Regulation) Act, regarding malpractices in the field.
The court was hearing a petition from a private ART bank in Ernakulam seeking release of seven women brought from other states to Kerala for surrogacy.
Police had detained the women after a raid conducted with authorities under the ART Act.
During the hearing, the petitioners said the women came to Kerala in response to a newspaper advertisement. HC called it a 'startling submission' and asked for a copy of the ad. Petitioners produced one that appeared on social media. The court orally observed: "People are there in other states getting ladies and bringing them. Absolutely, it is inter-border trafficking."

The court decided to examine the process of bringing women from other states for ART and surrogacy.
The petitioners claimed seven women were detained. But state govt told the court there were only six women—five from WB and one from TN—and a child. One woman had already donated an oocyte (a cell in an ovary) in Hyderabad, though the Act allows such donation only once in a lifetime. While the petitioners named a seventh woman, the state denied this and said she was not present at the clinic during the raid.
Govt also opposed the claim that the women responded to the petitioners' ad. It said the claim was implausible as the women spoke only their native languages and the ad was found on social media. The govt pleader said a probe is needed to find out how the women reached the clinic after seeing the ad.
Police protection for 'detained women'
Counsel for the shelter home where the women are housed told the court that many people were trying to gain access by claiming the women were detained illegally or needed to sign vakalaths or other contracts.
She said this was causing a law-and-order issue. HC directed the SHO of Kalamassery station to maintain a beat around the shelter and respond quickly to any request for help.
Hurdles faced by authorities
Kerala has 110 ART clinics, 25 ART banks and 23 surrogacy clinics. Ernakulam alone has eight such clinics. ART clinics are classified into Level 1 (which perform intrauterine insemination) and Level 2 (which offer advanced treatments like IVF, intracytoplasmic sperm injection, surgical retrieval of gametes, embryo transfer and storage).
The state has only one designated authority, headed by an additional secretary of the health and family welfare department. This authority issues licences, inspects clinics and acts against violations under ART and surrogacy laws. But limited staff and resources make it hard to ensure compliance.

The action was taken based on a report by Nanded district collector Rahul Kardile which stated that Thorat's conduct maligned the image of govt and recommended disciplinary action, the suspension order issued by the divisional commissioner Jitendra Papalkar of Chhatrapati Sambhajinagar said. Bawankule, in an official statement, said govt officers are expected to maintain the dignity of their office. Bawankule said that thousands of cases of citizens are pending in the office and Thorat had no time to address them, yet he found time to indulge in such activities while seated on the tehsildar's chair. "This is unacceptable which is why he has been suspended. Such conduct will not be tolerated in the revenue department. If our officers behave in this manner, they should be sent home," he said, adding that all govt officials must uphold the dignity of their positions. The suspension has drawn criticism from citizens and political leaders, including members of the BJP, who argued that it was too harsh and urged govt to review it. Pune-based BJP leader Ujwal Keskar said, "The tehsildar was moved by his emotions and simply enjoyed the moment. The only mistake was the place where he chose to do it. And he had to face disciplinary action." Keskar added that instead of imposing such a severe penalty, the officer should have been given a warning and allowed to continue his duties. Navi Mumbai: Karjat police arrested three out seven people accused of assaulting a journalist, Prathmesh Kudekar, and his friend Mayur Randive on Aug 1. The accused have been arrested from Karjat and Mahad along with a car and a two-wheeler. The incident evoked massive public anger besides journalists launching a protest. Search is on for the absconding four accused. The accused had fled the spot after the attack at the prominent Chaarphata circle. Kudekar sustained grievous injuries in the incident and is undergoing treatment. It took almost 14 days after the incident when police caught hold of a few accused. Investigation was done by using technical methods and scanning CCTVs around the incident area including those in Khopoli, Khalapur, Chowk, Neral and Mumbai-Pune expressway, besides the Shedung toll naka on the Mumbai-Pune highway. The names of the accused has been withheld by police for further investigation purposes. A local court has granted bail to the three accused. An eight member police team led by assistant inspector Rahul Varote are investigating the case. Earlier, journalists had demanded action under the Maharashtra Media Persons and Media Institutions (Prevention of Violence and Damage or Loss to Property) Act, 2017. They had met the deputy superintendent of police, Rahul Gaikwad, demanding stringent action against the accused.

Hyderabad: The city civil court, under the motor accident claims, has awarded a compensation of 10.3 lakh with 9% interest to the family of T Yadagiri, who lost his life in a road accident. According to the family, on Nov 6, 2019, Yadagiri (55), was travelling with his wife on a motorcycle near Nidigonda village in Jangaon district when a TGSRTC bus, driven by M Nagesh, allegedly entered the wrong lane at a high speed and hit the two-wheeler head-on. While Yadagiri died on the spot, his wife sustained injuries. An FIR was registered at Ragunathapalli police station, and a chargesheet was later filed against the bus driver. The compensation petition was filed by Yadagiri's wife, Laxmi Bai, his son Jampu (who later passed away during proceedings), and his minor granddaughter, Jasmitha. The court, however, recognised only the wife and granddaughter as dependents and examined evidence including, the FIR, chargesheet, inquest, and postmortem reports. In assessing compensation, the court fixed Yadagiri's income at the minimum wage for a light motor driver, 9,516 per month, adding 10% towards future prospects. By applying the legal multiplier, the court calculated the family's loss of dependency at 9.21 lakh. Additionally, compensation was awarded under various heads: 80,000 towards consortium, 15,000 for loss of estate, and 15,000 for funeral expenses. The court ordered TGSRTC and the driver to pay the compensation jointly. It further ordered that the deceased's wife can withdraw 3 lakh, while the granddaughter's share will remain in a fixed deposit until she attains the age of 18.
