Supreme Court grants protection to minor girl forced into child marriage

New Delhi [India], June 18 (ANI): The Supreme Court on Wednesday granted relief to a minor girl, aged 16, who was forced into child marriage and directed the Bihar and Delhi Police to ensure the safety of the girl and her friend.
The girl approaching the apex court has said that her family had married her off to a 32-33-year-old contractor on December 9, 2024, from whom they had taken a loan.
A bench of Justices Ujjal Bhuyan and Manmohan also issued notices to the Bihar and Delhi governments.
It asked the DGP of Bihar and the Police Commissioner of Delhi to provide full security to the girl and her friend and ensure no harm is caused to them. The bench also sought a status report from the police.
It further directed that the police have to be in touch with the girl and her friend so that, in case of emergency, necessary assistance can be provided to them.
The girl, a resident of Bihar, filed a petition in the apex court through her friend, saying that her family forcibly married her off and she has been subjected to physical abuse and harassment by her in-laws.
The teenager stated that she recently appeared for her Class 10 Board exams and wishes to continue her studies, but her in-laws are not agreeable to it.
She has appealed to the apex court to protect her from her family and husband and sought annulment of her forced marriage under the Child Marriage Prohibition Act, 2006.
The girl further explained that she willingly ran away from home with a friend. However, her family has now filed a kidnapping case against her friend, concealing the fact that her daughter was married.
The petition said that her husband has been pursuing the case personally and has told people in Madhopur village that he would not mind going to jail after killing her.
The petition stated, 'The Petitioner is presently on the run with a friend (Saurabh Kumar) and fears they would be killed if they returned back to Bihar or were apprehended in the hunt launched for them.'
According to the plea, her husband, a civil contractor, claimed that the girl's parents were indebted to them and she would have to continue in the marriage rather than go for further studies to pursue her dream of becoming a teacher or a lawyer.
She sought protection from any coercive action by police till the matter is finally decided by law. (ANI)

CHENNAI: Enforcement Directorate (ED) on Wednesday admitted to Madras high court that it lacks the power to seal a premise but said it has the power to break open locked premises during a search. 'My lords are right; we (ED) don't have the power to seal premises under the Prevention of Money Laundering Act (PMLA) ... We have the power to break open a premise if it's closed when we go there for a search. We should have done that … We will remove the notices pasted on the properties and permit the petitioners to enter,' said additional solicitor general S V Raju. He was referring to the sealing of the residences and office premises of film producer Akash Bhaskaran and businessman Vikram Ravindran in connection with the alleged Rs 1,000 crore Tasmac liquor scam. The basis for the raid was 41 FIRs registered in connection with irregularities in Tasmac, the ASG said. A mere suspicion is enough to conduct a search; 'reason to believe' comes into play only during an arrest, he said. To this, the court asked whether the petitioners are named in any one of the 41 FIRs. It is not necessary; mere suspicion is enough, Raju said. Pointing out that Supreme Court is seized of the issue (search conducted in Tasmac), Raju wanted HC to wait till the apex court arrived at a decision on the powers of ED. To this, a division bench of Justice M S Ramesh and Justice V Lakshminarayanan said, 'While ED will continue its proceedings in connection with the case and not wait till SC passes an order, how can they expect us (HC) to wait for the SC order?' If ED has taken a stand that the apex court is seized of the issue, why did the agency not move a petition seeking to transfer the current plea to Supreme Court, the bench asked. Perusing the documents produced by ED, it said what has been given to the court is not sufficient material for suspicion against the petitioners. The court then reserved orders on the interim application moved by the petitioners to de-seal their property and adjourned the main application by four weeks for ED to file a counter.

Shahjahanpur: A 32-year-old child care home worker has accused the head of the centre in Shahjahanpur and one of his associates of raping her, a police officer said on Wednesday. The woman had been posted at the Azizganj-based Bal Grih (Child Care Home) by the Social Welfare Department last year, Superintendent of Police Rajesh Dwivedi told PTI. According to her, the centre-in-charge, Nemchand, had been harassing her ever since, he said. Nemchand also allegedly made a video of her beating children and used it to blackmail her, the officer said. According to the FIR, Nemchand and his associate Mukesh Dixit allegedly threatened to get the woman terminated and raped her several times over the last one year. A video recently surfaced on social media, showing the woman hitting children. A week ago, the administration filed a complaint against her in connection with that incident, police said. The officer said Nemchand and Mukesh Dixit have been booked under charges of gang rape and criminal intimidation, and the woman sent for medical examination. Ten people, including four minors, were apprehended on Tuesday in connection with the gang rape of a 20-year-old woman at the famed Gopalpur beach in Odisha, police said. Odisha Chief Minister Mohan Charan Majhi also strongly condemned the gang rape incident and termed it a "crime against humanity". The National Commission of Women (NCW) sought a report on the incident which has sparked an outrage across the state. The incident happened on Sunday night when the woman, an undergraduate student at a private college, went to the beach along with her boyfriend, who is a classmate, on the occasion of the Raja festival, police said. Taking suo motu cognisance of the matter, NCW chairperson Vijaya Rahatkar asked the Odisha DGP to submit an action taken report within three days and directed the immediate arrest of all the remaining accused, a swift and time-bound investigation, and provision of free medical and psychological support to the survivor. "Compensation must be ensured to the victim under Section 396 of the BNSS," the NCW said in a social media post. The woman, in her complaint lodged at the Gopalpur police station, alleged that when they were sitting at an isolated place on the beach, a group of 10 people approached them, rounded up her boyfriend and took turns to rape her.

HYDERABAD BRS working president K.T. Rama Rao has declined to submit his mobile phone to the Anti-Corruption Bureau (ACB) that is probing the Formula E race case citing privacy issues. Interestingly, the former MA&UD minister claimed that he had replaced his old mobile phone in the first quarter of 2024 with a new one and not used any other electronic devices during the relevant period pertaining to the Formula E race case. In his written reply to the ACB, KTR stated that such a direction violates fundamental rights and personal privacy guaranteed under the Constitution. Questioning the ACB's direction, he said that he had personally appeared before the ACB on June 16 and responded to all queries. Stating that ACB had served him a notice to submit the mobile phone used between November 1, 2021, and December 1, 2023, along with other electronic devices used by him, KTR pointed out that the notice did not specify the reason or purpose for seeking these devices. KTR emphasised that all official records relevant to the Formula E case were already available with the State Municipal Administration and Urban Development (MA&UD) department, and all decisions related to the case were made in his official capacity as Minister of that department. He added that if any electronic devices were to be examined, strict protocols laid down by the Supreme Court must be followed to avoid any tampering or misuse of data. He highlighted the importance of the right to privacy citing a relevant case in which the Supreme Court granted interim relief to a petitioner and instructed the Enforcement Directorate not to access or copy the contents of the petitioner's mobile phone.
