OLD ORCHARD BEACH, Maine — A Maine police officer arrested by immigration authorities has agreed to voluntarily leave the country, U.S. Immigration and Customs Enforcement said Monday.
ICE arrested Old Orchard Beach Police Department reserve Officer Jon Luke Evans, of Jamaica, on July 25, as part of the agency's effort to step up immigration enforcement. Officials with the town and police department have said federal authorities previously told them Evans was legally authorized to work in the U.S.
An ICE representative reached by telephone told The Associated Press on Monday that a judge has granted voluntary departure for Evans and that he could leave as soon as that day. The representative did not provide other details about Evans' case.
Evans' arrest touched off a dispute between Old Orchard Beach officials and ICE. Police Chief Elise Chard has said the department was notified by federal officials that Evans was legally permitted to work in the country, and that the town submitted information via the Department of Homeland Security's E-Verify program prior to Evans' employment. Assistant Secretary of Homeland Security Tricia McLaughlin then accused the town of "reckless reliance" on the department's E-Verify program.
E-Verify is an online system that allows employers to check if potential employees can work legally in the U.S.
The town is aware of reports that Evans plans to leave the country voluntarily, Chard said Monday.
"The town reiterates its ongoing commitment to meeting all state and federal laws regarding employment," Chard said in a statement. "We will continue to rely on the I-9 Employment Eligibility Verification form and the E-Verify database to confirm employment eligibility."
ICE's detainee lookup website said Monday that Evans was being held at the Donald W. Wyatt Detention Facility in Central Falls, Rhode Island. However, a representative for Wyatt said Evans had been transferred to an ICE facility in Burlington, Massachusetts. ICE officials did not respond to requests for comment on the discrepancy. It was unclear if Evans was represented by an attorney, and a message left for him at the detention facility was not returned.
ICE officials said in July that Evans overstayed his visa and unlawfully attempted to purchase a firearm. WMTW-TV reported Monday that Evans' agreement to a voluntary departure means he will be allowed to leave the U.S. at his own expense to avoid being deported.

The Trump administration is moving to expand scrutiny of immigrants' 'good moral character' when deciding on citizenship applications. U.S. Citizenship and Immigration Services announced officers will be instructed to seek more than a 'cursory mechanical review focused on the absence of wrongdoing' and instead conduct "a holistic assessment of an alien's behavior, adherence to societal norms, and positive contributions that affirmatively demonstrate good moral character." In a memo shared on Friday, the agency said existing rules will remain, such as bars on granting citizenship to people shown to have conducted serious offenses including murder and torture, while outlining new criteria for naturalization. 'U.S. citizenship is the gold standard of citizenship — it should only be offered to the world's best of the best,' agency spokesperson Matthew J. Tragesser said in a statement to The Hill. Under the new policy, immigration officers are directed to factor in positive evidence of moral character, like an immigrant's community involvement and education attainment, as well as negative information, such as repeated DUI convictions or actions that 'while technically lawful, may be inconsistent with civic responsibility within the community, such as reckless or habitual traffic infractions, or harassment or aggressive solicitation.' Officers will also consider evidence of reformed character, such as paying back taxes, or complying with probation conditions. Experts said the new policy broke with precedent and could be seen within the larger context of the Trump administration's steps to limit legal immigration and settlement within the U.S. "They're trying to increase the grounds for denial of U.S. citizenship by kind of torturing the definition of good moral character to encompass extremely harmless behavior," Doug Rand, a former senior official at the agency during the Biden administration, told CBS News. In a tweet shared on Thursday (Aug. 14), the social media account for Homeland Security shared a video showing off multiple ICE trucks patrolling the streets of Washington D.C., which comes amid Donald Trump's vow to increase police presence in the Capitol to "crack down on crime." The clip is soundtracked by DaBaby's song "Toes," which appeared on his 2019 album Kirk. On the song, DaBaby raps about his "ice," as in his jewelry. Not the same ICE that Homeland Security is talking about. "My heart so cold I think I'm done with ice," he raps in the Kenny Beats-produced song. As reported by Rolling Stone, the Trump administration spent $384,000 on the Ford Raptors and GMC Yukons featured in the video, with an additional $182,000 spent on "graphic wrap design and application for law enforcement vehicles." The administration said the vehicles were for "recruitment purposes." The trucks proudly feature the same color scheme that Trump has for his private jet and feature the phrase, "Defend the Homeland" and "President Donald J. Trump." ICE has been seeking to recruit more officers amid Trump's push for more forcible deportations across the country. The call to action worked for former Superman actor Dean Cain, at least, with him recently announcing that he'll be joining the agency. It's unclear if DaBaby gave Homeland Security permission to use the track, although he has not responded to it on social media or reposted it. He did, however, previously indicate that he was a supporter of Donald Trump in a 2022 episode of the Full Send podcast. "Do I f**kswith Trump? Now? Hell yeah," he said, per Billboard.
