Conflict of interest in CEC may affect FCAA cases: Retired officers to CJI
In their open letter dated June 30, the signatories, including former secretaries, ambassadors, police chiefs and forest officers, said the four-member CEC currently includes three former Indian Forest Service officers and a retired scientist who also worked with the environment ministry for many years. There are no independent experts on the panel.
The letter said two CEC members recently retired as Director General of Forests and Special Secretary in the environment ministry.
"A CEC comprising officers who had held the highest positions in the Ministry of Environment, Forest and Climate Change, and were closely involved in policy-making, can hardly be expected to give independent advice to the Supreme Court, advice that is different from what they gave while they were in the government," the letter read.
The retired civil servants, part of the Constitutional Conduct Group, said the CEC, formed in 2002, had a balanced composition until 2023.
The earlier CEC included not only government experts but also two independent members -- a wildlife specialist and a Supreme Court advocate -- who had neither held senior government positions nor been involved in forest policy decisions, "thus ensuring impartiality and preventing conflict of interest", they said.
In 2023, a group of individuals challenged the Forest Conservation Amendment Act (FCAA) in the Supreme Court, saying that it would hasten forest decline. In this matter, the court has issued four orders, including one upholding the definition of forests as per the Godavarman order of 1996. The case is pending final hearing.
The retired officials pointed out that a current CEC member, while serving in the environment ministry, had "prepared and defended" the Forest Conservation Amendment Bill before the Joint Parliamentary Committee. The Act, its rules and guidelines were all notified during that time.
They said several memos allowing use of degraded, notified and revenue forests for compensatory afforestation, which goes against the 1996 Godavarman judgment, were also issued during the tenure of some present CEC members.
The signatories feared that the outcome of the cases against the FCAA 2023, "may possibly be compromised considering the conflict of interest of the CEC", as the Supreme Court might rely on the CEC's advice before making its final decision.
Any advice or report given by the current CEC, given its composition, in cases that challenges the FCAA 2023, "will in all probability be biased in favour of the Act as passed and will thus represent a clear conflict of interest", the letter said.
The retired officials said this concern is already reflected in the recent Supreme Court order on Maharashtra's 'zudpi' forests (scrub forests). The court's order dated May 22, 2025 relied heavily on the CEC's advice, which recommended the untrammelled use of these forests for 'compensatory afforestation', considering them ecologically inferior as they cannot support dense forest cover.
The former bureaucrats urged the court to ensure that the CEC includes not just retired government officials but also independent experts from outside, saying there are many such experts in the country.
They requested the chief justice not to allow the current CEC to advise the court in the FCAA 2023 cases or other important matters related to forests, wildlife and ecological security.

‘Will apologise on social media': Indore cartoonist tells SC in ‘undignified' Modi caricature case
An Indore-based cartoonist booked for depicting Prime Minister Narendra Modi and the Rashtriya Swayamsevak Sangh in an allegedly undignified manner told the Supreme Court on Tuesday that he will publish an apology on social media, Bar and Bench reported. A bench of Justices Aravind Kumar and NV Anjaria was hearing a petition filed by the cartoonist Hemant Malviya, seeking anticipatory bail in the case registered against him in Madhya Pradesh. 'I have already placed the apology according to the earlier order,' Bar and Bench quoted advocate Vrinda Grover, representing Malviya, as having told the bench. 'I want to make an additional statement that it [the caricature] will be deleted from all social media platforms even though the case pertains to the Facebook post.' Grover added: 'I will publish the apology on my social media account as well.' Additional Solicitor General KM Nataraj, for the Madhya Pradesh government, said that the post should not be deleted because of the ongoing investigation. Nataraj added that the apology should be published on social media with an undertaking that the cartoonist would not indulge in the same again. The bench said that Malviya should publish the apology within 10 days and extended the interim protection from arrest granted to him till the next hearing. On July 15, the Supreme Court had granted the cartoonist interim protection from arrest but cautioned that if he continued to share allegedly offensive posts on social media, the Madhya Pradesh government was free to take action against him. The order had come after Malviya submitted an apology for his social media post. The bench had also directed the cartoonist to file the apology in Hindi as an affidavit. A day earlier, the cartoonist had agreed to delete the post after being criticised by the Supreme Court. Malviya had moved the top court challenging a Madhya Pradesh High Court order that denied him anticipatory bail in the case. The High Court in its July 3 order observed that Malviya had 'clearly overstepped' the limits of free speech and misused his right to expression. It held that the cartoonist had failed to exercise discretion while publishing the caricature and held that his custodial interrogation was necessary. The case Malviya had published the original cartoon on January 6, 2021, which depicted Modi as a doctor administering an injection to a man dressed in what may have appeared to some as the uniform of the RSS. The RSS is the parent organisation of the Bharatiya Janata Party. It was accompanied with the Hindi caption: 'Why are you worried? Serum's Poonawala has said that the vaccine only has water, you won't die from the side effect of water!' This was a reference to Serum Institute of India's Chief Executive Officer Adar Poonawalla alleging that many Covid-19 vaccines in the market were only as effective as water. According to the High Court order, a Facebook user had republished the cartoon, but replaced the caption with one in which the man in the purported RSS uniform addresses Modi as an incarnation of the Hindu deity Shiva and asks to be injected with such a strong dose of the caste census in his buttocks so that he forgets the Pahalgam terror attack and the contentious Waqf Act, among other matters. Malviya had shared the altered version of his cartoon on Facebook on May 1, writing that anyone could use any of his cartoons by writing their own names and captions. All his cartoons were for the public, by the public and dedicated to the public, he said. He added that the altered cartoon was shared with him by a friend and that whoever had created the caption had written well. Based on this, a RSS member had filed a complaint, alleging that Malviya had posted objectionable content on Facebook that defamed the Hindutva organisation and hurt religious sentiments. Malviya was booked in May under sections of the Bharatiya Nyaya Sanhita and the Information Technology Act pertaining to promoting enmity between groups, acts intended to outrage religious feelings, intentional insult and electronically publishing or transmitting material containing sexually explicit acts. Malviya has argued that he was falsely implicated in the case and that his work was merely satire. He also said that the comments about the caricature on Facebook were not his own, and therefore, he could not be held responsible for them.

ASI should consider supervision of Mehrauli monuments: Supreme Court
Synopsis The Supreme Court has directed the Archaeological Survey of India (ASI) to consider supervising the repair and renovation of monuments within Delhi's Mehrauli Archaeological Park, including the Ashiq Allah Dargah and Chillagah of Baba Farid. This directive comes in response to appeals seeking protection of these historical and religiously significant structures from demolition. Supreme Court of India The Supreme Court on Tuesday said the Archeological Survey of India (ASI) should consider the supervision of monuments inside Delhi's Mehrauli Archaeological Park including the 13th century "Ashiq Allah Dargah" and "Chillagah of Baba Farid", the revered Sufi saint. The apex court was acting on two appeals for directions to the authorities to desist from demolishing or removing the dargah (shrine) and other surrounding historical monuments in Mehrauli or Sanjay Van. A bench of Justices B V Nagarathna and R Mahadevan noted the top court on February 28 ordered no constructions, additions or alterations in the existing structures in the area without its permission. "Why do you want to demolish it in the first place?" the bench asked the Delhi Development Authority (DDA) counsel. The DDA's counsel said the authority was not against the dargah but there were several other unauthorised structures that had come up in the vicinity. "The question which really arises is, how much of it is the protected monument and how much of it is the encroachment," the counsel said. While the bench observed no further constructions should be carried out, it stressed on preservation of the monument. "That monument has to be preserved. We are only concerned with the monument," the bench said. The counsel for the appellants, who moved against a Delhi High Court order related to the matter, argued the monuments in question were not encroachments for they had existed in the area since 12th century. While referring to the ASI's status report, the appellants argued though the structures might not have been treated as a centrally protected monument, the ASI could supervise their repair and maintenance. The DDA's counsel, however, contended the authority was concerned only with demolition of unauthorised structures encroaching public land in terms of the orders passed by the apex court. "In the circumstances, we dispose of these appeals by observing that the ASI should take under its consideration the supervision of the monuments in question in the matter of repair, renovation," the bench said. One of the appellants sought protection of the religious structures inside the archaeological park from demolition. The ASI previously said the two structures inside the archaeological park bore religious significance as Muslim devotees paid daily visits to the shrines. An inscription, the ASI said, on the tomb of Shaikh Shahibuddin (Ashiq Allah) says it was constructed in the year 1,317 AD. The ASI said the tomb was close to the citadel of Prithviraj Chauhan and fell within the regulated zone of 200 metre according to the Ancient Monuments and Archaeological Sites and Remains Act. Any repair, renovation or construction work required a prior permission of the competent authority, it added. "Both structures are frequently visited. Devotees light lamps at the Ashiq Dargah for fulfilment of wishes. They visit Chillagah to get rid of evil spirits and bad omen. The place is also associated with the religious sentiment and faith of a particular religious community," the ASI report said.

Bihar SIR: Those aggrieved at being left out of voter list can file claims using Aadhaar, CEO says
Following the Supreme Court's interim order to the Election Commission (EC) that those aggrieved at being left out of the draft voters' list in Bihar should be allowed to file claims using their Aadhaar cards, Bihar Chief Electoral Officer Vinod Singh Gunjiyal on Monday issued a notification to that effect. '…All such voters, who are not included in the draft list, can get information about their entry in this list along with the reason through their EPIC number. The list related to such voters who are not included in the draft list published on 01.08.2025 has also been displayed at all block offices, panchayat offices, municipal bodies offices and polling stations, through which such voters can get information and information related to their entry along with the reason. Dissatisfied persons can submit their claim with a copy of their Aadhar card,' the Bihar CEO said in his order. However, it is not clear whether such voters need to produce one of the 11 EC-mandated documents to get their names enrolled into the list again. On Sunday, the Bihar CEO had published details of 65 lakh names deleted from the draft electoral rolls in the first phase of the special intensive revision (SIR). This came after the Supreme Court, while hearing petitions against the SIR, had directed the Election Commission to publish the details of those whose names were deleted from the draft rolls and the reasons for the deletion. Opposition parties and other activists have raised concerns over potential wrongful deletions during the SIR process. They have claimed that several people declared dead during the process, and have had their names deleted, are in fact alive. Out of 7.89 crore voters in Bihar, 7.24 crore were enrolled in the first draft. Out of the 65 lakh names deleted from the list, 36 lakh were shown to have permanently moved elsewhere, and 22 lakh were said to be dead.
