Teenager made harrowing call for rescue in deadliest English Channel crossing tragedy

An Iraqi-Kurdish boy phoned coastguards to warn that everyone on board a small boat crossing the English Channel would die as it began to sink, an inquiry into the tragedy was told on Monday. Mubin Rizghar Hussein, 16, known to be one of the victims, made the harrowing call as the flimsy boat carrying more than two dozen migrants from northern France towards the UK took on water in the early hours. His account of what happened formed part of the opening of the Cranston Inquiry into what has been the largest single loss of life since migrants began crossing the Channel in small boats in 2018. The names of the 26 people confirmed dead and the four who remain missing were read out on Monday. Another body was found but their identity has not been confirmed. The inquiry heard no one can be certain how many people were on board the boat on the night of November 24, 2021 but French authorities believe it was 33, including 13 women and eight children. As the inquiry opened, No 10 Downing Street insisted the British government was taking action to curb similar Channel crossings, addressing the 'chaos' in the asylum system and stepping up returns of people with no legal right to be in the UK, but added there are 'no quick fixes' to the global problem of illegal migration. The Prime Minister's official spokesman said: 'We're taking the measures that will ultimately deter and smash people-smuggling gangs that have been plying this illegal trade. We're extending a deal with France to step up our work with the French to further smash the gangs and stop the small boat crossings.' Figures published on Monday indicated that 592 migrants arrived on March 2 in 11 boats, the highest number of arrivals on a single day so far this year. It takes the total number of illegal cross-Channel arrivals this year to 2,716, which is 20 per cent higher than at the same point last year. The inquiry, chaired by former judge and academic Sir Ross Cranston, will look at what happened on the night in question and what lessons can be learnt from the search-and-rescue operation. Rory Phillips KC, counsel to the inquiry, said one of two known survivors, Issa Mohamed Omar, saw 15 people clinging to the overturned boat when the sun rose, and he recalled a mother screaming, searching for her lost children. Mr Phillips said the horror of what Mr Omar had seen was 'unimaginable' and he set off swimming for hours. A French fishing boat found the first bodies floating in the water shortly after midday, the inquiry heard. 'It is said one of the victims died just half an hour before rescue,' Mr Phillips said. 'The question if loss of life was avoidable is not an academic one in this case.' A report from the Marine Accident Investigation Branch, released in 2023, found that the rescue response was hindered by confusion, lack of resources and poor communication between the UK and France. Mr Phillips said the migrants had gathered in the dark on a beach near Dunkirk after trekking for about two hours. 'They had left their home countries for a variety of different reasons but were united in their desperation to reach the United Kingdom,' he said. The migrants 'paid thousands of pounds' to criminal gangs 'who promised them safe passage' but 'instead they were about to embark on a harrowing journey, with more than 30 people crammed into a boat with a safe capacity for far fewer than that'. By about 10pm the boat had been fully inflated and dragged into the water on the French coast, while the people smugglers themselves remained on the beach. The women and children were directed to sit on the floor of the boat, while the men perched on the inflated sides. Those on board were wearing what the smugglers called a life jacket but these were merely 'vests stuffed with cotton or other fabric and with strips of reflective material on the sides'. Three hours into the journey 'the boat began to take on a significant amount of water and became swamped' and those on board tried frantically to bail out water, 'as panicked calls were made for help' at about 1.30am. The incident was given the reference "Charlie". The French transferred a 'harrowing call' from Mr Hussein to the UK Coastguard and spoke for 20 minutes, during which time he was able to give co-ordinates from his phone. 'Around 2.30am, the 16 year old made another desperate plea for help,' said Mr Phillips. 'He said to the coastguard that the passengers were finished and that they would all die.' He was told help was on its way and to stop calling. A Border Force vessel, the Valiant, was sent out but it was not until shortly before 3.30am that it arrived at the boat's last known location, by which time it had drifted away. A helicopter operating that night also failed to find the boat and was stood down. Mr Phillips said: "At the time when the Valiant was cleared from incident Charlie, when she returned to Dover, and when the helicopter returned to base, the incident was marked as resolved and closed – all those times human beings who had been on board the sinking small boat were in the water and the vast majority were drowning." He said an expert who submitted evidence to the inquiry believed most of the migrants who survived the swamping of the boat and entering the water had still been alive at this point. 'As the hours passed and no help arrived, one by one, the passengers succumbed to exhaustion and hypothermia," he said. "Dawn came around 7am one of the survivors had told the inquiry that when the sun rose over the water, there were about 15 people still clinging to the remains of the boat. 'The bodies of their fellow passengers were floating around them. He recalled a mother screaming as she searched for her children.' The inquiry comes as a report by the Marine Accident Investigation Branch published in November 2023 said the UK's search-and-rescue response was hampered by the lack of a dedicated aircraft carrying out aerial surveillance.

Could David Cameron be prosecuted for threatening the ICC?

David Cameron, the former British foreign secretary, may be liable for prosecution under international law and within the UK for his attempts to obstruct the work of the International Criminal Court (ICC), experts have said. Middle East Eye revealed on Monday that Cameron privately threatened Karim Khan, the British chief prosecutor at the ICC, in April 2024 to defund and withdraw from the ICC if it issued arrest warrants for Israeli leaders. "A threat against the ICC, direct or indirect, is an obstruction of justice," Francesca Albanese, the UN's special rapporteur on Palestine, told MEE's live show on Tuesday. "It's incredibly serious that someone in a position of power might have had the audacity to do that." And Professor Sergey Vasiliev of the Open University of the Netherlands reacted: "If the reports are confirmed, David Cameron did cross the legal line when he threatened the Prosector with all kinds of consequences for applying for the warrants. What did David Cameron do? Cameron, then foreign secretary in Rishi Sunak's Conservative government, made the threat on 23 April 2024 during a heated phone call with Khan. Cameron told Khan that the UK would "defund the court and withdraw from the Rome Statute" if the ICC issued warrants for Israeli leaders. At the time, Khan and his team of lawyers were preparing arrest warrants for Israeli Prime Minister Benjamin Netanyahu and his then-defence minister, Yoav Gallant, as well as for Hamas leaders Yahya Sinwar, Ismail Haniyeh and Mohammed Deif. Khan's office applied for warrants on 20 May, less than a month after the phone call. 'Per the reported dialogue, David Cameron clearly seeks to pressure the ICC Prosecutor's decision regarding whether to pursue warrants for Israeli officials' - Professor Tom Dannenbaum Six months later, on 21 November, the warrants were approved by a panel of judges, officially charging Netanyahu and Gallant with war crimes and crimes against humanity committed in Gaza since October 2023. MEE revealed details of the call based on information from several sources, including former staff in Khan's office familiar with the conversation and who have seen the minutes of the meeting. Cameron, a former British prime minister who was appointed foreign secretary by Sunak in November 2023, told Khan that applying for warrants for Netanyahu and Gallant would be "like dropping a hydrogen bomb". He said Khan was "on the brink of making a huge mistake" and that "the world is not ready for this". The report has drawn condemnation from British MPs who called for an investigation into Cameron's actions. Cameron has not responded to multiple requests for comment. Approached by MEE for a response to the exchange with Cameron, Khan said on Monday: "I have no comment to make at this time." What's the background to David Cameron's demands? The Conservative government was accused last year of being behind the delay in the ICC's issuance of arrest warrants against Israeli and Hamas officials, after filing a request with the pre-trial chamber to challenge the court's jurisdiction on Israeli nationals. The request prompted dozens of submissions from other states, but was later dropped by the Labour government, which came to power in July 2024. The revelations about Cameron came after the administration of US President Donald Trump said last week that it would sanction four ICC judges for investigations into the US and its ally Israel. In February, Khan was the first ICC official to be the target of US sanctions, carried out under an executive order issued shortly after Trump took office. The revelations also follow Khan's decision to take a leave of absence pending a UN-led investigation into alleged sexual misconduct, an accusation denied by his lawyers. What are the legal risks for Cameron? The ICC, established by the Rome Statute in 2002, is the only permanent international court that prosecutes individuals for war crimes, crimes against humanity and genocide. It has 125 signatories, including the UK and all EU countries, though Hungary has officially begun the withdrawal process. Leading international law experts have told Middle East Eye that Cameron's behaviour is an attack on judicial independence, and is prohibited under the Rome Statute and British law as an obstruction of justice. Professor Tom Dannenbaum of the Fletcher School of Law and Diplomacy said that, in general, the UK is entitled to withdraw from the ICC, and, upon exit, would then cease its financial contribution. But, he said, the issue here arises before any such withdrawal or defunding. "The problem here is David Cameron's reported threat to condition possible UK action or inaction in those respects on the decisions of the ICC Prosecutor regarding whom to investigate and prosecute," said Dannenbaum. "That threat is deeply concerning. The rule of law depends on prosecutors' insulation from political pressure in their identification of individuals for investigation and prosecution,. That is true at the ICC just as it is in domestic systems of criminal justice." Under what law could Cameron be charged? The four experts MEE spoke to said the ICC could charge Cameron, given the nature of the phone call with Khan, based on Article 70 of the Rome Statute, which prohibits offences against the administration of justice. These include "impeding, intimidating or corruptly influencing an official of the Court for the purpose of forcing or persuading the official not to perform, or to perform improperly, his or her duties; and retaliating against an official of the Court on account of duties performed by that or another official." Dannenbaum argued that Cameron's threat to withdraw the UK from the ICC and defund the court may amount to "corruptly influencing an official of the Court for the purpose of … persuading the official not to perform, or to perform improperly, his or her duties". Although this particular provision has never been litigated before the ICC, Dannenbaum said, the relevant offence of "corruptly influencing a witness" has. "That case law indicates that 'corruptly influencing' includes 'pressuring' the protected person in a way 'capable of influencing the nature' of their contribution and thereby 'compromising' it, with the term 'corruptly' signifying the aim of 'contaminating' the person's contribution," Dannenbaum explained. "Per the reported dialogue, David Cameron clearly seeks to pressure the ICC Prosecutor's decision regarding whether to pursue warrants for Israeli officials. It is possible that this pressure would be understood to have been designed to 'contaminate' the Prosecutor's decision, although that concept may be less clear here than it is in the context of witness testimony. "Considerations regarding state withdrawal and budget cuts are plausibly 'capable' of influencing such decisions, albeit that the Prosecutor appears to have resisted the pressure in the case at hand." Given the above points, Dannenbaum concluded that Cameron's conduct may be consistent with the prohibited offences against the administration of justice listed under Article 70. The court has jurisdiction over Article 70 offences, irrespective of the nationality or location of the accused. What penalty could Cameron face? If successfully charged, Cameron is likely to face an arrest warrant by the court and, if convicted, could be sentenced to up to five years of imprisonment in The Hague or a fine. However, given the vulnerability of the ICC, with Trump's sanctions and Khan's leave of absence, Vasiliev suggested that Cameron's prosecution in The Hague would be "rather unlikely. "The ICC could in principle open the investigation into these allegations under Article 70 or request the UK to do so (or the UK could do so on its own). Whether this will in fact be done, is a big question." Could Cameron be prosecuted in the UK? Toby Cadman, a British barrister and international law expert, said that if the allegations are substantiated by clear evidence, then Cameron could be investigated at an international and domestic level "provided there's political will". Francesca Albanese: David Cameron could be criminally liable for threatening ICC Read More » In the UK, an investigation could be opened for the common law offence of obstruction or perverting the course of justice or the common law offence of misconduct in public offence, he said. An investigation in the UK can be carried out in accordance with Section 54 of the ICC Act 2001, which is based on Article 70 of the Rome Statute. The attorney general's consent would be required for any prosecution to go ahead. "It is quite clear that the allegation is serious and if the UK is committed to maintaining a system based on the rule of law with full respect for the state's international treaty obligations it should open an investigation and if the evidence supports it, bring charges," Cadman told MEE. Could Cameron be prosecuted outside the UK? But Vasiliev suggested that Cameron's prosecution before the courts of other states would be precluded by his functional immunity - the protection granted to senior officials if an alleged offence was committed during their official duties. "Cameron has a functional immunity for that act as he uttered those threats in the exercise of his official functions, and there is no exception to such immunity applicable in foreign courts for offences against the integrity of judicial system," Vasiliev argued. "The prosecution authorities of other states parties therefore will not eagerly pursue such a case."

New report accuses France of 'continuously' delivering military equipment to Israel

A new report has accused France of "regularly and continuously" delivering military equipment to Israel since the start of its war on Gaza. According to the study by a coalition of NGOs released on Tuesday, deliveries have been continuous, both by sea and by air, since October 2023. They include more than 15 million "bombs, grenades, torpedoes, mines, missiles and other munitions of war" worth more than $8m, as well as 1,868 "parts and accessories for rocket launchers, grenades, flamethrowers, artillery, military rifles and hunting rifles" worth more than $2m. The report was produced by the activist network Progressive International (PI) in cooperation with a coalition of NGOs including the Palestinian Youth Movement, the French Jewish Union for Peace, BDS France and Stop Arming Israel France. To compile the report, the organisations say they relied on data from the Israel Tax Authority, verifying imports that corresponded to French-made military equipment. At a press conference to launch the report at the National Assembly in Paris, David Adler of Progressive International said that the document "reveals a very stunning hypocrisy at the heart of President Macron's foreign policy and the sustained violation of international humanitarian law." 'The data presented in this report offers a very partial picture of French complicity in the occupation, destruction and genocide of the Palestinian people' - David Adler, Progressive International secretary general Denouncing "very hollow promises about Palestinian liberation" and the positioning of France "as a champion of human rights", he said the report confirmed "what many people in this country have long suspected to be true: that France has played and continues to play a central role in the traffic of arms to Israel not for defensive purposes but to be deployed against the people of Gaza and the occupied territories of the West Bank." Adler said the report also identified shipments of F-35 fighter jet components, artillery systems and machine gun ammunition, weapons that have been documented in use during the mass killing of Palestinian civilians attempting to access humanitarian aid in recent days. The authors have specified that the study is limited in scope. For example, drone components sold by the French group Thales are not included. "The data presented in this report offers a very partial picture of French complicity in the occupation, destruction and genocide of the Palestinian people," Adler said. More than 55,000 Palestinians have been killed as a result of Israel's war on Gaza, which several countries, as well as many international rights groups and experts, now describe as "genocide". "The full scope of this military cooperation, including classified licences and covert operations, remains hidden from public view and remains hidden from parliamentary view as well," Adler added. "We're here to demand accountability, transparency and a full parliamentary investigation into France's role in arming and aiding Israel as it continues to bomb, kill and starve the people of Gaza and occupy the West Bank." 'Double standards' The report follows revelations by the investigative media outlet Disclose last week that France was preparing to deliver machine gun equipment to Israel. According to Disclose, an Israeli cargo ship stopped last Thursday in Fos-sur-Mer, near Marseille, to deliver to Israel 19 pallets containing several tons of spare parts for machine guns. The parts, called "links", are small metal pieces used to connect machine gun bullets and allow rapid bursts of fire. Anne Savinel-Barras, president of Amnesty International France, said such deliveries were taking place "in opacity and in total contradiction" with the recent statements by French President Emmanuel Macron, who had expressed horror over the humanitarian situation in Gaza. "These weapons could be used to commit serious crimes under international law in Gaza and the West Bank," she said, urging France to end its "double standards" and impose a total embargo on all arms intended for Israel. "If France continues to authorise the delivery of war material to Israel, it is fuelling this genocide," Savinel-Barras added. According to Disclose, which had access to maritime data, two other such shipments between Fos-sur-Mer and the Israeli port of Haifa took place on 3 April and 22 May. French Defence Minister Sebastien Lecornu had stated at the time that these parts exported by a Marseille company, Eurolink, would be "re-exported" through Israel and not used by the Israeli army. On Friday, after French dock workers in Fos-sur-Mer blocked the shipment in protest, Lecornu stated again France's "clear" position that it does not sell weapons to Israel. Only "components" intended for the "Iron Dome", Israel's anti-missile system, or "elements for re-export" are sold to Israel, he added. In the latter case, "some items go to Israel, undergo industrial intervention, and are often re-exported. Sometimes even to France. And all of this is subject to monitoring," Lecornu said. Lack of accountability According to experts, including the report's authors, it is impossible to verify whether equipment sold by France are actually used by the Israeli army and deployed in Gaza. In France, military affairs fall exclusively under the executive branch. Arms deliveries are covered by state secrecy, which means the parliament has almost no room to manoeuvre in controlling the government's actions. "There is no guarantee and no follow-up on the supposed reshipments of weapons assembled in Israel. Similarly, we see that the parts cited in this report are not used in the Iron Dome." He pointed out that France is a signatory to the Arms Trade Treaty and, therefore, "there should not even be a question about what type of weapons or what quantity. "The treaty is very clear: when there is a risk of committing a war crime, a crime against humanity or a genocide, arms deliveries must cease immediately. This has not been the case here," he added. No French company can sell arms to Israel without "specific, detailed authorisation" from the French prime minister and government, he said, lamenting that parliament is "deprived of any power to control arms deliveries". Meanwhile, on Tuesday, a French court rejected a request from NGOs asking it to ban Israeli companies from the Paris Air Show scheduled from 16 to 22 June at Le Bourget, near Paris, citing the risk of perpetuating "international crimes". The court considered that an obligation to screen exhibitors would involve "in-depth legal and political analyses, closely linked to the conduct of France's international relations, which SIAE [the organiser] does not appear capable of conducting," a lawyer for the NGOs told AFP.
