The HC was hearing the response by the railways on a PIL that raised concerns over the high rate of fatalities in the suburban railway system. In 2025, until May, CR has recorded 293 deaths due to track crossing and 150 due to falling from the running train.
A bench of Chief Justice Alok Aradhe and Justice Sandeep V Marne was hearing a Public Interest Litigation (PIL) filed by one Yatin Jadhav, a daily commuter who raised concerns over the high rate of fatalities in the second busiest suburban railway system in the world and sought the formation of an expert panel to recommend measures to eliminate deaths due to untoward incidents.
On June 20, the HC had expressed concern over the 'disturbing' situation of nearly 10 deaths occurring daily on Mumbai's suburban railway system. The bench had said that the 'unfortunate' Mumbra train accident reported last month, in which five commuters lost their lives after falling off overcrowded trains, should not have happened.
The court was informed that the railways have a high-level monitoring committee with a 'zero death mission', and a multi-disciplinary committee headed by a senior divisional safety officer was formed to examine what led to the accident in Mumbai.
Pravindra Wanjari, Senior Divisional Commercial Manager, Mumbai of CR enumerated measures adopted by it to redress issues and stated that projects such as Panvel-Karjat suburban corridor, Kalwa-Airoli elevated corridor, third and fourth line between Kalyan-Badlapur will be 'progressively' done within three to four years.
Moreover, the third line between Kalyan and Kasara is scheduled to be completed by December 2026. Among other projects, the fifth and sixth line between Kurla and CSMT is undertaken, of which Kurla-Parel (Phase-1) is scheduled to be completed by June 2027.
However, the same is affected by private land acquisition and issues of Project Affected Persons (PAPs), the affidavit stated.
'The Central Railway Suburban system in itself is a complex network. During monsoon, the work gets slowed down, as no digging is done due to safety reasons. Further, the work is to be carried out ensuring safety of a large volume of traffic. The major work is carried out only during night blocks,' the affidavit stated.
Moreover, the CR said the requests were sent to nearly 800 establishments to make staggered office hours to reduce peak-hour rush. Earlier this month, the Indian Express reported that only 46 establishments had responded positively.
The HC was further informed that an investigation by multi-disciplinary team has been constituted to probe the June 9 Mumbra incident convened by a senior divisional safety officer and the investigation is underway. The HC will hear the PIL next week.

The Bombay High Court on Tuesday (July 15, 2025) rejected and refused to entertain a public interest litigation (PIL) petition alleging that Leader of the Opposition Rahul Gandhi violated the petitioner's rights by making 'immature' remarks about Hindutva ideologue Vinayak Damodar Savarkar. The petition sought the court to issue directions to the Congress leader that he should read his petition and learn about Savarkar before making 'irresponsible' statements. Phadnis, 65, from Mumbai and the founding president of Abhinav Bharat Congress, a public policy think tank, mentioned history and research work by the petitioner on Savarkar. The petitioner said that Mr. Gandhi, in London in March 2023, had tried to paint Savarkar as someone who takes pleasure in the humiliation of Muslims. He further said that Mr. Gandhi tried to portray Savarkar as a coward and in a derogatory reference at a press conference held on March 25, 2023, where he said, 'My name is not Savarkar, I am Gandhi and Gandhi does not make apologies to anyone.' 'Rahul Gandhi is LoP in Lok Sabha and could well become Prime Minister of India in the future. Therefore, he cannot be allowed to take liberties with facts to denigrate respected leaders of freedom struggle and prevent the young from being in a position to fulfil their fundamental duties. The only way to prevent him from causing harm to the nation is by an expert such as the petitioner to step into the box, depose comprehensive facts about Shri Savarkar and allow himself to be cross examined by Rahul Gandhi to establish facts once and for all,' the petitioner said, asking the court to direct Mr. Gandhi to read the contents of his petition and learn about Savarkar. A Division Bench of Chief Justice Alok Aradhe and Justice Sandeep Marne observed that the Supreme Court had already dismissed a similar petition filed by Mr. Phadnis and said that the court could not direct Mr. Gandhi to read the contents of the petition and remove his ignorance about Vinayak Savarkar. 'In your petition, your prayer is to direct him to personally study and read your petition. How can the court compel him to read your petition? This court cannot issue directions to Rahul Gandhi to study the contents of this petition and remove ignorance about the contribution of Savarkar. We do not know if he will become Prime Minister or not. Do you know that he will become the Prime Minister?' the Bench noted and disposed of the petition. The court noted that a criminal defamation case had already been filed against Mr. Gandhi by Satyaki Savarkar, grand nephew of Vinayak Savarkar, and that the same was pending before a special MP/MLA Court in Pune.

HC annuls govt order cancelling Khas Mahal Lease of city apartment
Patna: Giving relief to the dwellers of an apartment on Frazer Road in the state capital, the Patna high court has annulled a govt order of May 18, 2004, which cancelled its Khas Mahal Lease. The high court has also quashed the state govt direction of Sept 14, 2004, which directed the Patna district magistrate to resume the entire building as govt property. A single bench of Justice Alok Kumar Sinha, while hearing a writ petition of one Robert Lakra and 28 other residents of the apartment, delivered this judgment on July 11, a copy of which was uploaded on the HC website on Tuesday. Senior counsel Chitranjan Sinha and advocate Jitendra Kishore Verma, while representing the petitioners, argued that the cancellation of the lease was arbitrary and whimsical as no condition stipulated in the deed was violated. The state govt gave prior permission to the leaseholder for re-allotment of the land as far back as in 1989. Later, the govt revoked the permission without giving any prior notice to the leaseholder or subsequent allottees. Justice Sinha held that the state govt's order is arbitrary, illegal and in violation of the fundamental rights of the apartment dwellers.

HC raises questions on holding polls, kanwar yatra together
Dehradun: Uttarakhand high court on Tuesday raised questions about the feasibility of holding panchayat elections during the ongoing kanwar yatra and Char Dham pilgrimage. HC was hearing a public interest petition by Haridwar resident Dr Baijnath, who highlighted that key administrative resources such as police and SDRF teams were engaged in flood relief work, potentially impacting election management. He urged the court to consider postponing the elections until after Aug. In response, DGP Deepam Seth and panchayati raj secretary Chandresh Kumar Yadav informed the court via video conferencing that preparations were in place to ensure smooth conduct of the elections and the yatras. The state election commission also confirmed its readiness to conduct the polls. Polling is scheduled in two phases, July 24 and 28, across 12 districts, excluding Haridwar, while the kanwar yatra will continue until July 23. Seth said 30% of the police force was deployed for kanwar yatra, 10% for Char Dham pilgrimage and another 10% for the elections, with contingency measures in place for any disruptions. The court was also informed that the first group of kanwar pilgrims from Himachal Pradesh, Haryana, Punjab, Uttar Pradesh and Delhi would complete their journey before the first polling date. Districts affected by the yatra will vote in the second phase. The DGP said legal action was taken against some pilgrims for unruly conduct. The court directed officials to submit a report on the next hearing on Wednesday.
