IANS New Delhi: A special CBI court has chided a co-accused allegedly involved in the land-for-jobs scandal for moving an application in a "contrived manner" to avoid arguments on framing of charges against him.As reported by ET, a special court here is conducting day-to-day hearing on the framing of charges against the accused involved in the alleged scandal. The Central Bureau of Investigation (CBI) has charge sheeted the then Union Railways Minister Lalu Prasad Yadav, his wife Rabri Devi, sons Tejashwi and Tej Pratap Yadav, daughters Misa Bharti and Hema Yadav in the said case under the Prevention of Corruption Act.
Around 84 of the 99 total accused have concluded their arguments opposing the framing of charges. These include Tejashwi, Tej Pratap Yadav and others.
A local court, in an order passed last week, came down heavily on Ram Ashish Singh for moving an application to "delay" the proceedings of the case. The dispute in question pertains to a letter dated June 27, 2022 relied upon by the CBI vide which the accused, a principal of a school in Bihar, had responded to CBI's query revealing that few job aspirants had procured forged mark sheets and transfer certificates to secure jobs in the Railway Department. The accused moved court seeking deletion or exclusion of the said document from CBI's charge sheet on the ground that it is in the nature of a "confessional statement". The same was strongly opposed by CBI.
Refusing to entertain the plea the court, in its order dated August 8, came down heavily on the accused. The CBI court held that "the court finds the insistence of the counsel for accused upon the application being decided before he may lead other arguments to be a conscious ploy to seek a truncated and piecemeal as well as premature finding from the court on issues relating to the charge". More so, the order reads, "when the document in question is a letter from the accused to the investigating officer and is not cited as a confession or a disclosure statement by the CBI. The heightened insistence of the counsel is perceived by the court as a disguise for delay".Refusing to grant any relief, the court ruled that "the court is therefore not inclined to allow the prayer for a standalone order to be pronounced on the present application which calls upon the court to first reach a finding as to whether the said letter sent by accused to the IO, is a confessional statement and then disregard it. When the charge itself is not contemplated as a mini trial, no such exercise can be conducted for appreciating the tenor or admissibility of a document even prior to an order on charge".The court held that "being conscious that any eager, animated or inflexible assertion of the counsel ought not to prejudice the accused, the court would refrain from making further observations regarding the contrived manner in which the application has been moved so as to avoid arguments on charge on other aspects".

Trinamool Congress leader Kunal Ghosh filed a defamation case against the father of the R.G. Kar rape and murder victim on Wednesday following allegations the latter made that the Trinamool leader had 'made a settlement' with the Central Bureau of Investigation (CBI) to bury the probe. 'Today we filed a defamation lawsuit at the Chief Judicial Magistrate (CJM) court in Kolkata against the victim's father. At the recent Nabanna Abhijaan, he had alleged that Mr. Ghosh made a settlement with the Central Bureau of Investigation at their office at CGO complex. These comments are baseless and defamatory,' Mr. Ghosh's legal counsel, Ayon Chakraborty, told The Hindu. The CBI was probing the case in which a woman doctor on duty was raped and murdered on August 9, 2024, at the R.G. Kar Medical College and Hospital. In January this year, a civic police volunteer, Sanjay Roy, was pronounced guilty of the charges and sentenced to life imprisonment by a city court. On August 12, Mr. Ghosh sent a legal notice to the father of the victim in response to a comment the latter had made to the media. 'We had sent a legal notice to the victim's father last week and asked him to withdraw these statements through the press or social media. However, we received no reaction or response from him on the matter. So we went forward with the defamation case,' Mr. Chakraborty said. Also Read | Unhappy over probe, R.G. 'Someone is exploiting their sentiments and shooting off over the family's shoulders. I do not know who that is, but I must protest against it. I have two pending cases with the CBI, how can I meet them to settle a different case,' he asked. The father of the victim could not be reached for a response.

Navi Mumbai: A septuagenarian residing in Koparkhairane became a victim of a digital arrest scam by a cyber fraudster posing as a police commissioner. She ended up paying Rs 21 lakh between August 8 and 19 after being threatened with legal action, with claims of her involvement in terror funding. As per the complainant, on the morning of August 5, she received a video call from an unknown number. The caller identified himself as Police Commissioner Vishwas Nangare Patil. He told her that she misused her Aadhaar card by providing it to a person for opening an account in Canara Bank for terror funding, for which she received a Rs 20 lakh commission. He claimed that a CBI inquiry was initiated and her arrest warrant was issued. She was placed under digital arrest until August 19, and to prevent legal action, she was made to gradually transfer Rs 21 lakh to a bank account provided by the imposter. Patna: BJP on Wednesday demanded a public apology from Congress leader Rahul Gandhi for misleading the people against the special intensive revision (SIR) of the electoral rolls in Bihar. Revenue and land reforms minister Sanjay Saraogi alleged that Rahul "misused" Ranju Devi of Chafla village under Nauhatta block in Rohtas district during his "Vote Adhikar Yatra" in Aurangabad on Monday by presenting her as a victim of SIR though she and her other family members had their names already on the voter list. "Ranju Devi has accepted that she was misguided by a panchayat official. Now, Rahul should apologize to the country," Saraogi said.
