Nikam: State must move SC against acquittal of accused

on Monday urged state govt to immediately appeal to the SC regarding the acquittal of 11 surviving accused in the 2006 Mumbai serial blasts case.
Speaking to the reporters in Solapur, where he was presenting a murder case before the sessions court, Nikam said, "The acquittal by the Bombay high court is a matter of study as to whether the law was misread or wrong evidence was collected."
It should be noted that Nikam was not involved in the prosecution of the 2006 blasts. A Mumbai sessions court had initially convicted the accused, but the high court later overturned this decision on appeal.
Nikam also went on to highlight similarities between the two major incidents. "In the 1993 blasts, RDX was used. Similarly, in the 2006 blasts, RDX was used again," he said.
"Prima facie, it appears that Mumbai's sessions court pronounced the conviction based on the confession recorded by the accused under the Prevention of Terrorist Activities (POTA) Act, but the high court has found the same confessions not reliable," he added.

Nikam suggested that now there is an urgent need to seek a stay on the acquittal by approaching the SC. "Many innocent lives were lost in the serial blasts. The HC not trusting the evidence is a serious concern. The govt, after studying the order, must immediately appeal before the SC," he said.

On the other hand, Sameer, who is behind falsely accusing Angad for the accident gets angry at the police constable as he was not able to delete the CCTV footage. The constable asks him to calm down and contact traffic police Inspector Nitin Gokhale. Sameer decides to bribe him and leaves to meet Nitin. Meanwhile, Nitin grows emotional over his sister Vrinda's lack of access to basic education. During a visit to Nitin's home, Sameer tries to bribe him with Rs 50,000 in exchange for erasing the CCTV footage. When Nitin appears reluctant, Sameer ups the offer to Rs 5 lakh before leaving. This leads to a heated argument between Nitin and his wife, who scolds him for turning down the money. At Nitin's home, his mother pretends to be injured, while his wife secretly pays the doctor to support the lie. The doctor falsely informs Nitin that his mother requires urgent surgery, which would cost a significant amount, adding pressure on him to arrange the money quickly. Nitin agrees to accept the bribe and delete the accident footage which can prove Angad innocent after his wife emotionally blackmails him. Tulsi is seen sitting in the temple of her house, worried about Angad, at Nitin's house, Vrinda wakes up early morning to finish her assignment. She notices the television playing a news report about Angad being arrested for a drink-and-drive incident. While looking for her own pen drive, she stumbles upon Nitin's by accident. She watches the accident footage and realises that Angad is innocent, she decides to speak to her brother in the morning. Next morning at Shanti Niketan, the news of Angad's arrest starts affecting Mihir's business and investors starts cancelling their contracts and their share market prices also starts declining. Gayatri expresses concern over how the situation is getting out of hand. When Mihir decides to arrange bail for Angad, Tulsi strongly objects. Despite her disapproval, Mihir insists and prepares to sign the bail documents. Just then, Hemant steps in and urges Mihir not to act against Tulsi's wishes. This intervention leaves both Mihir and Gayatri visibly displeased. The episode comes to an end.

1 2 Kolkata: A division bench of Calcutta High Court's Jalpaiguri circuit bench has stayed a Bengal govt gazette notification announcing the creation of two Special Task Force (STF) police stations and tying them up with two existing courts in two parts of the state. The state had set up the designated police stations — one in north Bengal and the other in south — to register FIRs and investigate offences under special acts like Narcotic Drugs and Psychotropic Substances Act, Arms Act, Unlawful Activities Prevention Act and Prevention of Money Laundering Act. "The entire scheme of BNSS has been sought to be frustrated, prima facie" by such a notification, said a bench of justices Sabyasachi Bhattacharyya and Uday Kumar, ordering an interim stay on it till Sept 15 or until further orders. If the notification is to be given force, then a person living in a remote area will never report an offence," Justice Bhattacharyya observed. The additional advocate general pleaded that the executive action was well within the powers of state govt. However, the bench underscored the distinction between "local jurisdiction" of courts and determination of "local area" of police stations under BNSS.
