Media's role in fighting corruption must be defended

This summer marks the 30th anniversary of the enactment of the Ethics in Public Office Act 1995. Although commended for introducing statutory disclosure obligations for designated public office holders, including politicians, and the establishment of Sipo's predecessor, its significance runs deeper. The act ended a 79-year hiatus in Ireland's anti-corruption legislation.
From the foundation of the Irish Free State, the legislation governing corruption in Ireland was housed in the Prevention of Corruption Acts 1889 to 1916. That legislation remained unamended on the Irish statute book until 1995, when modest revisions were introduced under the Ethics in Public Office Act.
That act was introduced partly as a response to political indiscretions exposed in a number of scandals that gripped Ireland during the 1990s, including the Greencore affair, Telecom Éireann's site purchase, and the Beef Tribunal. But behind that legislative response lay another powerful force — the media.
From the 1970s onwards, investigative journalism in Ireland began to develop, which led — among other things — to the exposure during the 1990s of conflicts of interest and ethical lapses among public officials.
The media reports unearthed a culture of impunity and lack of oversight, and were significant in embedding corruption in the public discourse. The Greencore affair, for example, which arose out of the privatisation of Súicre Éireann, revealed weaknesses in the anti-corruption legislative architecture that had never been focused on before, namely conflicts between public duties and private interests.
It centred on a small number of executives who bought a 49% stake in a subsidiary of the company for £3.2m and sold it back to the State a year later for £9.5m, prompting concerns over corporate governance and abuse of trust.
Although statutory investigations found breaches of company law and corrupt practices by some of those involved, no criminal prosecutions followed. Then there was Telecom Éireann, a semi-state company, which found itself the subject of much media attention in 1991, arising from irregularities surrounding its purchase of a piece of land for use as its headquarters.
The Beef Tribunal, established in 1991, on foot of an ITV World in Action programme, would go on to reveal questionable and uncomfortably close connections between big business interests and Irish political interests.
These revelations helped shift public sentiment, fostering a climate more receptive to investigative journalism and expanding the public understanding of corruption. Before then, corruption was regarded as an overt form of bribery. This understanding was reflected in the legislation criminalising corruption, which dated back to 1889.
Events throughout the 1990s showed that corrupt behaviour could constitute more clandestine activities where private interests and public duties collided, and an awareness of the connection between conflicts of interest and corruption. This growing public awareness, aided by the media, created the necessary political pressure for reform.
The Ethics in Public Office Act 1995 was the first enacted legislative response. However, it was not the first attempt to introduce accountability into Irish public life.
Four years previously, Labour TD Brendan Howlin initiated the Ethics in Government and Public Office Bill 1991 as a private members' bill. Although the bill was defeated, its principles were incorporated into the 1995 act.
The Ethics in Public Office Act 1995 sparked a series of incremental reforms over the next 15 years, including the introduction of freedom of information laws, regulation of political donations, and the Prevention of Corruption (Amendment) Acts 2001 and 2010.
Running in tandem with these legislative developments was persistent media scrutiny, reporting on events that formed the subject matter of various tribunals throughout the 1990s and 2000s. The media played a pivotal role in the establishment of the tribunals.
However, its influence extended beyond this initial contribution, in that it was instrumental in informing the public about the proceedings and findings of the tribunals. The particular significance of the Moriarty, Planning, and Morris tribunals is that, for the first time, findings of corruption were made against individuals who were the subject of the investigations.
The momentum for change, driven by media vigilance and Ireland's commitments under international and European instruments such as the OECD Convention on Combating Bribery, ultimately culminated in the Criminal Justice (Corruption Offences) Act 2018.
The 2018 Act repealed Ireland's outdated corruption laws and replaced them with a unified modern framework. It introduced offences of active and passive corruption, trading in influence, knowingly giving gifts or advantages to facilitate the commission of a corruption offence, intimidation, and substantially increased penalties for corruption offences.
The legislative inertia that had persisted for most of the 20th century eventually gave way to a resurgence of reform, driven in no small way by the media's persistent focus on corruption.
As Mr Justice Humphreys recently observed, the media plays a vital role in shaping public discourse, a role that mirrors Percy Bysshe Shelley's famous description of poets as "the unacknowledged legislators of the world".
This is not to suggest that the media alone dictates policy and legislation; rather, media coverage can influence legislators' behaviour, as Ireland's experience with corruption legislation has shown.
Irish legislation is a product of the Oireachtas, which essentially comprises directly elected politicians. Dependent on public support, politicians risk losing political power if they ignore public opinion. Media reporting and commentary often guide public opinion, which in turn can influence the legislative agenda.
The evolution of Ireland's anti-corruption laws is a testament to the enduring importance of the Fourth Estate. Ireland's path towards transparency and reform may not have been so meaningful without it.

SECRET files have been declassified that shine a light on talks between the Irish and British governments as they worked together to bolster the peace process in the wake of the Good Friday Agreement. Here, David O'Dornan reveals some of the extraordinary discussions that took place. IRA ARMS DUMP 'POLICED BY NORWEGIANS' PEACE process facilitator Father Alec Reid proposed that the IRA set-up a superdump for their arms in Dublin that could be overseen by Norwegians in a bid to make a breakthrough on decommissioning. The Catholic priest's idea is revealed in a top secret memo, dated November 20, 2000, penned by the Northern Ireland Office's Bill Jeffrey after a meeting with Ulster Unionist Harvey Bicker, a retired colonel in the British Army. He wrote: 'We were obviously at a delicate stage in the process, and would need somehow to persuade the IRA to re-engage with [General John] de Chastelain and make some further confidence building move on weapons. 'He was - as we knew - close to Mary McAleese and had helped with her Presidential campaign. Out of that had come a suggestion that he talk to Father Reid. 'He and Reid had developed a number of concepts, including language like 'putting beyond use' which had ended up in the public domain. 'Bicker also mentioned that, at some point in the dialogue - he did not make it clear precisely when - he and (I think) Reid had proposed that the IRA should establish a major dump for arms at the site of the Army Air Corps base north of Dublin. 'This would be secured by international troops (he had suggested Norwegians) and would not be accessible by representatives of either the British or Irish Governments. 'The only people to have access would be the four representatives of the moral interface and the IRA themselves. 'The major dump north of Dublin policed by the Norwegians was the only point in our discussion when I thought we were losing touch with reality, but that may simply reflect lack of imagination on my part.' 'AL CAPONE ROUTE' ON REPUBLICANS THE problem of how to crack down on republican gangs along the border was becoming a hot topic with concerns that scrapping British Army bases and the removal of the presence of soldiers in the north would impact the ability to combat crime. A key part of talks between the two governments and Sinn Fein was that Army checkpoints, watchtowers and barracks in the heavily militarised South Armagh area would be scaled back before going away for good - but only if the Provisional IRA made good on decommissioning. John Sawers - who would later be the Chief of MI6, Britain's Secret Intelligence Service, was at the time a foreign affairs adviser to Tony Blair and wrote to him about his concerns on November 24, 2000. He told him: 'The pressure in these negotiations will be to stretch ourselves on demilitarisation - scaling back on our coverage of South Armagh in return for some real action on putting arms beyond use. 'At the same time, we have to retain and improve our ability to crack down on racketeering and smuggling… the Irish are better placed to pursue the Al Capone route against both PIRA and RIRA on their side of the border (though whether they would ever put Slab Murphy in the dock on smuggling charges is doubtful).' ADAMS CLAIMED SHOCK AT MORE IRA GUNS A MEETING with Irish government civil servants Dermot Gallagher and Martin Mansergh regarding what Sinn Fein president Gerry Adams had to say about IRA activity was recorded in a note dated November 17, 2000 by British mandarin William Fittall. He said: 'We asked Gallagher what Adams had said about continued PIRA murders and procurement. Gallagher said that Adams 'took a very careful note of what I said about killing people'. 'On procurement Adams had said that 'he would be very, very surprised if anything was happening in that area'. 'Mansergh added that even concreting dumps would be 'vast and difficult' for the movement.' BERTIE'S BELIEF THE IRA WOULDN'T DISBAND THE files show that the close relationship between Good Friday Agreement brokers Bertie Ahern and Tony Blair continued for many years as they fought for the peace process together with constant phone calls and meetings. On April 16, 2003, the Taoiseach told him he believed 'the IRA would never say that they were disbanded or going away totally'. A day later in a separate discussion with Blair, 'Ahern commented that the IRA had shown some movement… but on targeting/beatings etc they had been unable to move 'because they are up to their necks in it'.' Then in a note of a phone call a fortnight later on May 1, it stated: 'The Prime Minister did not think that [Peter] Robinson and the DUP would ever in reality ever be prepared to share power with Sinn Fein. SPANISH POLICE HAVE said that gardaí in Ireland have arrested a man linked to a major organised crime drug smuggling group in Spain. In a statement released on their website the National Police in Spain have said that the lengthy months long operation took place in locations in Madrid, Malaga, Seville and County Louth in Ireland. An Garda Síochána has a liaison officer in Madrid who works closely with the Spanish law enforcement agencies. The police said they arrested 13 people and gardaí detained one person in ireland – the plot was to smuggle the cannabis in animal feed. Advertisement The Spanish searches included €100,000 in cash, 630 marijuana plants, a firearm and three detonators. They also seized high-end vehicles and luxury watches. There was also a freezing of assets and property. The Spanish said the operation began in January of this year when it was found that there was a criminal network comprised of British, Irish, and Spanish citizens. The network used 'international freight forwarding companies' to ship pallets of animal feed containing marijuana buds. Investigators discovered that these shipments were regularly sent to the Britain and Ireland and were previously packaged in Spain. The organised crime group, the Spanish police said, has been working since 2019 and in that time they shipped more than three tons of cannabis. The Spanish authorities said that the Irish search took place at a house in County Louth where they arrested a person who is an alleged member of the gang.
