Two arrested by MACC over RM8.1m fraud in machinery, waste disposal services

PUTRAJAYA, May 28 — Two individuals have been arrested by the Malaysian Anti-Corruption Commission (MACC) on suspicion of submitting false particulars amounting to approximately RM8.1 million, involving the provision of machinery rental services, facilities, and waste disposal.
According to sources, a former company owner and a former Chief Financial Officer, both in their 40s to 50s, were arrested around 6.30 pm on Tuesday when they arrived to give their statements at the MACC Headquarters here.
'Both suspects are believed to be involved in corruption and money laundering for the provision of machinery and facility rental services between 2019 and 2021.
'Additionally, the investigation also focuses on claims for waste disposal services that occurred from January to October 2022, as well as the receipt of bribe money,' the source said.
The source added that MACC's investigation is also identifying other criminal offences under the Penal Code and money laundering activities.
Through 'Op Flora,' conducted by MACC's Special Operations Division (BOK) at 11 premises around the Klang Valley and Negeri Sembilan yesterday, MACC has frozen 76 bank accounts, comprising individual and company accounts, totaling approximately RM1.68 million.
The source informed that both individuals are currently remanded for one day after Magistrate Irza Zulaikha Rohanuddin allowed the MACC's application at the Putrajaya Magistrate's Court.
Meanwhile, MACC Special Operations Division Senior Director, Datuk Mohamad Zamri Zainul Abidin, when contacted, confirmed the arrests and stated that the case was being investigated under Section 18 of the MACC Act 2009.

PUTRAJAYA, June 7 — There is no worker representation in the Malaysian delegation to the 113th International Labour Conference (ILC) in Geneva, Switzerland, due to there being no official leadership in the Malaysian Trades Union Congress (MTUC), said the Ministry of Human Resources (KESUMA). It stressed, in a statement today, that claims that the government deliberately excluded the participation of MTUC representatives were unfounded, misleading and malicious. KESUMA added that the Court of Appeal had on Feb 21 ordered the MTUC to hold fresh leadership elections within 90 days, which will be managed by a joint special committee (JBK). 'The election that was supposed to be held in May has been postponed to Aug 10, resulting in MTUC not having an official leadership to represent workers on any official platform, including the ILC,' it added. According to KESUMA, the JBK that was specifically established to handle the re-election process has no mandate to make policy decisions or nominate representatives for international forums. 'In fact, the nomination of names by the JBK to the ILC is outside the jurisdiction granted by the court and had been objected to by several MTUC affiliate members,' it clarified. KESUMA also emphasised that the selection of the Malaysian delegation to the ILC was made transparently based on the guidelines of the International Labour Organisation (ILO) as well as legal advice from the Attorney-General's Chambers (AGC) regarding MTUC's current status. It added that the government remains committed to its principle of tripartite and supports the rights of a valid workers' union's participation on the global platform. 'KESUMA calls for the MTUC re-elections to be promptly resolved to protect the image of the workers' union movement and ensure Malaysia's complete participation in the ILC next year,' it said. — Bernama

(Website pic) PETALING JAYA : The Malaysian Anti-Corruption Commission will file an application to forfeit the Ilham Tower in Kuala Lumpur next week, says its chief, Azam Baki. Azam said the forfeiture application would be filed under Section 55 or 56 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (Amla), Utusan Malaysia reported. Section 56 of Amla provides for the forfeiture of property where there is no prosecution, if a High Court judge is satisfied that the asset was the subject-matter or evidence relating to the commission of an offence under the Act, the proceeds of an unlawful activity, or the instrumentalities of an offence. MACC first seized the 274m-tall tower owned by the late Daim Zainuddin and his family under the MACC Act in December 2023. It previously said it could seize the tower for up to 18 months pending investigations. Yesterday, it announced it had seized the tower again, this time under Amla. Daim's widow, Naimah Khalid, plans to challenge the seizure in court. Last month, MACC opened eight new investigation papers into 'high-value' assets linked to Daim and his family members after receiving new information from overseas.

In a statement today, Ramkarpal stressed that the AG's claim of 'insufficient evidence' does little to address the family's long-standing concerns about the quality and thoroughness of the investigations. 'It is disappointing that the AG came to the conclusion that there is insufficient evidence,' he said. 'The AG should disclose further details of his findings, particularly on the question of why he says there is insufficient evidence. 'A general statement to that effect does not, in any way, overcome the family's real concerns that such investigations were not properly and professionally conducted.' Prior to 2018, two special investigation teams were set up – one in 2011 and the other in 2015 – to look into Teoh's death, but both cases were classified as NFA by the public prosecutor. Ramkarpal noted that the AG's justification appeared to rest on a technical distinction – that the Court of Appeal's findings were based on civil, not criminal, standards – and argued that this reasoning is deeply unsatisfactory after over a decade of investigations. He confirmed that Teoh's family is considering a judicial review of the AG's decision and will announce their next steps soon. Teoh's family has long called for accountability and has expressed frustration with repeated delays and lack of resolution in the case.
