This NZ law aims to give people with criminal convictions a 'clean slate'. It's not working

If you own a business, would you be willing to hire a person who has been convicted of a crime? Give them a chance when a background check shows they have a criminal record?
The answers matter for both individuals and communities.
For people who have paid their debt to society, rejoining it can hinge on getting a second chance without being judged on their past. It is not something they can really hide.
Employers often conduct
criminal background checks
as part of the hiring process. People with criminal records face high levels of stigmatisation, making it harder to reenter their communities and make money legally.
The thorny question of what to do with people with convictions when it comes to employment has been considered by policymakers and justice campaigners around the world.
In the United States, more than 27 states have introduced
"Ban the Box"
legislation. While each law is unique, by and large, they have eliminated the requirement to provide criminal background information in job applications.
And a number of countries, including New Zealand, have implemented
clean slate initiatives
which help conceal criminal records for people who meet certain criteria.
Our
new research
looks at whether New Zealand's clean slate scheme increases the job prospects for eligible people.
The clean slate reform was introduced as the
Criminal Records Act
in 2004.
People who were previously convicted of minor offences can now have their criminal records automatically concealed if they can maintain a conviction-free record for seven years after their last sentence.
The regulation excludes people who were involved in a serious offence (such as sexual misconduct) or who received a particularly punitive sentence (such as incarceration or an indefinite disqualification from driving).
Our research started with the
Integrated Data Infrastructure
(IDI), hosted by Statistics New Zealand (StatsNZ). This is a repository of records provided by different public and private agencies, including court charge data from the Ministry of Justice and tax records from Inland Revenue.
StatsNZ uses specific characteristics of individuals (such as name and birth date) to identify them across the different datasets. This enables researchers to track the same individual's data footprint across different administrative records.
We used court charges data on all men convicted between 1992 and 2003 who had fulfilled the clean slate eligibility criteria. We then linked this pool of people with their Inland Revenue records to measure their employment and earnings.
To identify the labour market impact of the clean slate policy, we compared the employment and earnings of those who completed their seven-year rehabilitation period (the treatment group) with individuals who became eligible sometime later (the control group).
Our analysis found the clean slate scheme has no relevant impact on the likelihood of eligible individuals finding work. This could result from the length of time required between sentencing and being eligible for a clean slate. Seven years could simply be too long.
But the clean slate scheme did create at least a 2 percent increase in eligible workers' monthly wages and salaries - equivalent to a NZ$100 hike for an individual with an average monthly salary of $5000.
The increase in monthly earnings appears to be greater for workers with a stronger commitment to working and for those who remain with one company for longer periods.
The labour market effects of concealing past convictions have also been explored in the US.
Recent research
looked at a policy enacted in Maryland, New Jersey, Pennsylvania and Bexar County, Texas. Mirroring our own results, the authors do not find any relevant impact on gaining employment.
Our findings indicate the concealment of past convictions through New Zealand's clean slate scheme might happen too late to make a huge difference. But there are changes that can be made to improve work outcomes for people who have completed their sentences.
This could include following the example of countries such as Finland, where access to
criminal histories is much more restricted.
In Finland, the background check has to be directly relevant to the job requirements. For example, the law allows checks for someone applying to work in the financial sector who was convicted of fraud.
There would also be benefits from looking at the eligibility criteria for New Zealand's clean slate scheme.
Currently, it only applies to people who committed a minor offence. But, policymakers should consider whether it makes sense to expand the policy to people who committed more serious crimes but managed to turn their lives around. Making this change would allow people to reap the benefits of working without stigma.
All that said, the government's current "tough on crime" stance makes change unlikely, with a focus on the cost of crime rather than what happens after punishment has been completed.

Landlord finds squalid home, tenant Jessica Michelle Duffy ordered to pay $4822
By Catherine Hutton, Open Justice reporter in Wellington of Photo: 123rf A landlord's final inspection of a house revealed some surprises, including baseball bats and chains under the beds and couches, modifications to the garage and a flatmate still living there with his dog. The landlord, whose name is suppressed, provided the Tenancy Tribunal with photographs of the house to show tenant Jessica Michelle Duffy made no attempt to clean it before she left in February. The landlord described the state of the house as squalid, which the tribunal accepted. "Cupboards were still full, dishes were piled in the sink and bench, the bathroom still had personal items, furniture was still in all the rooms and the woodshed was piled with a tremendous amount of rubbish. "Baseball bats and chairs were found under the beds and couches. The wood burner was loaded with the remnants of burnt aluminium cans and glass bottles. "The bathroom required an immediate application of Exit Mould and personal items removed with gloves, before being considered hygienic enough for occupancy and professional cleaners." During an inspection on 28 January, the landlord also discovered a missing downpipe and a broken window in one of the rooms. Despite being asked in writing to make repairs before mid-February, Duffy made no effort to do so, the decision said. In another room, four large rectangles had been cut into the carpet, destroying it. The carpet also had suspected paint stains that couldn't be removed. As well as the damaged carpets, there was a strong smell of cigarettes, ash and dog throughout all the rooms. As a result, the landlord decided to replace the carpet and sought a contribution from the tenant. The garage had been heavily carpeted, and the walls and windows boarded up and lined with underlay and black material. While the flatmate removed the wall lining, an extensive quantity of boards, material, carpet, underlay, rubbish and personal effects remained in the garage. The garage door was also broken and had to be replaced, because it had been levered open. The recently released decision also noted that, because the keys weren't returned, the locks had to be replaced and the lawn needed to be mowed. In its decision, the tribunal accepted the landlord's claim that the clean-up required two skip bins, and "many hours of stressful and disgusting work" shifting the tenant's rubbish and possessions, although the decision noted the flatmate also helped. Taking into account betterment and depreciation, the tribunal ordered that Duffy, who didn't attend the hearing, pay $4822 to the landlord for the costs they'd incurred. That included rent arrears, rubbish removal, replacing carpet, curtains, and repairs to the window and downpipe, garage door, and replacement locks. - This story originally appeared in the New Zealand Herald .

Serious crash closes Auckland's St Lukes Road overbridge
Photo: 123RF Emergency services have responded to a serious crash on the St Lukes Road overbridge in Auckland. The crash, involving two cars, was reported to the police at 6.30pm. One person is reported to be in a critical condition. The northwestern St Lukes off-ramp has been closed and other traffic management may be put in place. Motorists are asked to avoid the area and take alternate routes where possible. Wasp warning: Ruakākā Beach walker warns public after being stung 50 times
Radewald ran to her car with her dog in tow, managing to bat away the majority of the wasps as she got in her vehicle. She believed she had been stung all over her body about 50 times. The pain was 10 times worse than if she had been stung once, she said. At home, Radewald had a cold shower and tried to calm herself down. 'I felt itchy and in pain all over,' she said. Radewald was amazed the wasps had managed to sting her through two layers of clothing. Radewald used vinegar and other natural ointments to treat the sores, which had since started to heal. 'I got away. I feel okay,' she said. Radewald was unsure what species of wasp had attacked her. The most commonly encountered wasps in Northland are the German wasp and the common wasp. The Asian paper wasp is also widespread in the upper North Island. The German European Wasp is one of the common wasp varieties seen in Northland. Radewald said a member of the public instead dealt with the wasps themselves. She also posted online to warn others, especially those with children, to take care. Whangārei District Council senior technical officer Spencer Jellyman said the council decided the wasps had most likely been bees as wasps do not usually swarm but bees do. 'Bee swarms move about, so rather than going to the location to find them we decided to monitor for further incidents before investigating further.' Jellyman said council did not receive any more reports about the swarm in the days after the incident, which they usually would if there was an aggressive swarm of bees or wasps near a path. Department of Conservation (DoC) science adviser Eric Edwards said the incident sounded consistent with the behaviour of a disturbed wasps' nest that was possibly concealed. 'These species can become very aggressive when they feel threatened, particularly in late summer and autumn when nest sizes peak. 'However, aggressive behaviour can also occur during warmer winter days if nests are still active.' Phil Tunstall, owner and manager of pest management company Enviropro, said it was possible Radewald's dog may have stood on a wasp nest or disturbed one higher up. He said wasps were hibernating in nests on the ground, in trees or tree trunks at this time of year. 'If you do stand on a nest over winter time they will attack. 'They get very angry very quickly and they go into protect mode.' Tunstall said Enviropro typically got about 50 callouts around February and March, and perhaps one or two in winter. Wasp callouts had been common this summer as it had been reasonably warm, he said. The mild winter had meant the cold wasn't enough to impact a nest, he said. How to prevent bee and wasp stings Health New Zealand Te Whatu Ora information states that calling an exterminator is the best practice for wasps found at home. It also states to take care when eating food outdoors, especially sugary drinks and fish sandwiches, which can attract bees and wasps. Other tips include: Avoid bright-coloured or dark-coloured clothing Avoid perfumes If you're hiking in bush and forest areas, wear hats, long-sleeved shirts and long pants, and light colours.
