Aug 12 (Reuters) - A federal judge in California has denied a request from Anthropic to immediately appeal a ruling that could place the artificial intelligence company on the hook for billions of dollars in damages for allegedly pirating authors' copyrighted books. U.S. District Judge William Alsup said on Monday, opens new tab that Anthropic must wait until after a scheduled December jury trial to appeal his decision that the company is not shielded from liability for pirating millions of books to train its AI-powered chatbot Claude. Spokespeople for Anthropic did not immediately respond to a request for comment on the decision on Tuesday. Attorneys for the authors suing Anthropic declined to comment. Writers Andrea Bartz, Charles Graeber and Kirk Wallace Johnson filed the class action against Anthropic last year. They argued that the Amazon- and Alphabet-backed company unlawfully used pirated books without permission or compensation to teach Claude to respond to human prompts. The case is one of several high-stakes lawsuits brought by authors, news outlets and other copyright owners against companies including OpenAI, Microsoft and Meta Platforms over their generative AI training. AI companies argue their systems make fair use of copyrighted material to create new, transformative content. Alsup determined in June that Anthropic's training made fair use of authors' work, but said the company still violated their rights by saving pirated copies of books to a "central library" that would not necessarily be used for AI training. Alsup has set a trial for December 1 to determine how much Anthropic owes in piracy damages, which could total billions of dollars. Anthropic asked Alsup to pause the case and allow the company to appeal his fair use ruling to the 9th Circuit. Alsup rejected the company's request on Monday and said the 9th Circuit should hear the case after trial so it would "have the benefit of a full record and findings, rather than just the self-serving and sanitized declarations served up by Anthropic." The case is Bartz v. Anthropic PBC, U.S. District Court for the Northern District of California, No. 3:24-cv-05417. Aug 12 (Reuters) - Stock and crypto trading platform eToro beat second-quarter profit estimates on Tuesday as retail investors piled into markets, but shares fell 8% after executives said the April post-tariff trading spike has begun to normalize. Retail trading has been strong this year, buoyed by gains in U.S. equity markets and renewed interest in high-risk assets such as cryptocurrencies and tech stocks. In April, markets saw sharp swings after U.S. President Donald Trump announced new tariffs, yet analysts observed that individual investors were not deterred by the volatility and quickly sought opportunities to "buy the dip". However, "those numbers (elevated trading activity) normalized throughout July, as we moved from the spike in April," Chief Financial Officer Meron Shani told analysts in a post-earnings call with analysts. Net contribution, which deducts the cost of revenue from cryptoassets and margin interest expense, jumped 26% to $210 million from the year-ago quarter. New-age fintech platforms have taken market share from established Wall Street firms by luring younger, tech-savvy investors. eToro's assets under administration (AUA) grew 54% to $17.5 billion in the quarter. "During the quarter, eToro continued to develop its offering, launching key products," analysts at Jefferies said in a note, adding that growth in AUA was driven by market gains in equities and crypto, alongside strong customer inflows. The company went public in May in a bumper U.S. initial public offering, with its shares surging on debut after pricing above the marketed range. eToro posted an adjusted profit of 56 cents per share in the three months ended June 30, beating estimates of 50 cents, according to estimates compiled by LSEG.

Billionaire Elon Musk threatened legal action against Apple on behalf of his artificial intelligence startup xAI, accusing the iPhone maker of favoring OpenAI and breaching antitrust regulations in managing the rankings in its App Store. The posts elicited snide responses from Sam Altman, the OpenAI CEO, and began a spat between the two former business partners on X. 'Apple is behaving in a manner that makes it impossible for any AI company besides OpenAI to reach #1 in the App Store, which is an unequivocal antitrust violation. xAI will take immediate legal action,' Musk said in a post on his social media platform X. In a post earlier that day, he wrote, 'Hey @Apple App Store, why do you refuse to put either X or Grok in your 'Must Have' section when X is the #1 news app in the world and Grok is #5 among all apps? Are you playing politics?' OpenAI's ChatGPT currently holds the top spot in the App Store's 'Top Free Apps' section in the US, while xAI's Grok ranks fifth. Apple has a partnership with OpenAI that integrates ChatGPT into iPhones, iPads and Macs. Apple and xAI did not provide comment. Altman responded to Musk on X: 'This is a remarkable claim given what I have heard alleged that Elon does to manipulate X to benefit himself and his own companies and harm his competitors and people he doesn't like.' Musk has bent X's algorithmic recommendations to favor his own tweets, according to multiple reports. Altman and Musk founded OpenAI together in 2015, but Musk left the startup and rescinded funding in 2018 after proposing to take it over, a petition other executives rebuffed. The Tesla CEO has since sued the company twice over its planned transition to a for-profit enterprise, alleging 'deceit of Shakespearean proportions'. Altman has cast Musk as a bitter and petty ex-partner who was jealous of the company's success after departing. Musk replied to Altman's tweet, 'You got 3M views on your bullshit post, you liar, far more than I've received on many of mine, despite me having 50 times your follower count!' Altman replied to Musk multiple times, first calling his lack of views a 'skill issue', then 'or bots', and then offered a legal question of his own: 'Will you sign an affidavit that you have never directed changes to the X algorithm in a way that has hurt your competitors or helped your own companies? i will apologize if so.' Users on X – through the community notes feature – have pointed out that a few apps besides OpenAI have taken the top spot on the App Store this year.
