The bench, comprising judicial member Justice Pushpa Sathyanarayana and expert member K Satyagopal, observed that OMs created de facto exemptions from statutory requirements and were issued without public consultation or scientific assessment.
'The OMs are issued without any scientific study or in fact assessment. The legal character of the OMs is administrative but their effect is legislative, creating de facto exemptions from legal mandates,' the bench stated.
The tribunal found the exemptions inconsistent with Regulation 7(2) of the EIA Notification, 2006, which mandates prior environmental clearance if any change in raw material mix leads to increased pollution load. It warned that allowing unchecked transitions between coal sources, especially from imported to domestic coal or vice versa, could raise emission.
The ministry defended the move as a procedural streamlining effort to promote domestic coal, but the NGT ruled that environmental concerns must not be compromised for operational flexibility.

The successful story of Asiatic lion's conservation in Gujarat has become global due to the vision of Prime Minister Narendra Modi and proactive practices of the forest department, Chief Minister Bhupendra Patel said on Sunday. The CM was participating in an official function to celebrate World Lion Day in Timbdi village of Bhanvad taluka in Devbhumi Dwarka district. The CM was also joined by the Union Minister of Environment, Forest and Climate Change, Bhupender Yadav, among others. Speaking on the occasion, CM Patel said, 'The population of lions in Gujarat…has increased to 891. The increasing population of lions is a matter of pride for us. Under the leadership of PM Modi, a relation of emotion and economy has been established between the locals and lions. In the last 25 years, the lion's territory has expanded from three districts to 11 districts.' The region is known as Barda Wildlife Sanctuary where the Asiatic lions have naturally settled after a long time while reclaiming their territory. Referring to this fact, the CM said, 'Lions have naturally made Barda Wildlife Sanctuary their home. The PM has announced to provide all necessary help and facilities for lion conservation in Barda. And today, after 143 years, rehabilitation of lions has started in Barda. Naturally beautiful Barda region is attracting tourists. With the PM's vision and proactive practices of the forest department, the successful story of lion's conservation in Gir has become global.' On the occasion, the CM also inaugurated or laid the foundation stone of various projects worth Rs 180 crore in the region. These include development of a safari park in Barda Wildlife Sanctuary, facilities for tourists there, around 247 vehicles for patrolling, monitoring and rescue of the wild animals. The CM also launched a portal from where tourists can do online booking of 24 eco-tourism sites in the state. Yadav also delivered a speech on the occasion wherein he emphasised the importance of eco-centrism: a condition where humans can live with nature. 'And I tell it across the world, our maldhari fellows are living in their Nes (maldhari settlements in Gir region) while conserving nature. There, the population of lions has also increased,' Yadav said. He said that Gir is the best example of how man can live with lion in a friendly manner. 'If one wants to see wildlife conservation in a friendly manner, then the Gir region of Gujarat, local government's efforts and the lifestyle of local maldhari community should be observed,' Yadav said. Yadav said that the concept of eco-centrism can be a big example for the world. And for that, he said, PM Modi has given a climate action programme in the form of International Big Cat Alliance. The Union minister said that out of the seven big cat varieties in the world (lion, tiger, leopard, snow leopard, cheetah, jaguar and puma), five can be seen in India. Yadav said that under PM Modi, conservation efforts are being made for the five big cats. Gujarat is the only place where Asiatic lions can be found. Yadav said the number of tiger reserves in India has increased from 47 to 58 in the last 10 years, and 70% of the total tigers of the world are surviving in the wild in India. Commenting on Project Cheetah, the Union minister said, 'The fifth big cat, cheetah, was last seen in India in 1952. Those cheetahs were seen in Kuno of Madhya Pradesh… It was a big challenge to bring back the wild cheetah. I want to tell you that under the leadership of PM Modi, we had brought 20 cheetahs from Namibia and South Africa. Today, with 29 cheetahs, our fifth big cat (initiative) Project Cheetah is going very well.'

Union Minister for Environment, Forest and Climate Change Bhupender Yadav on Sunday credited Prime Minister Narendra Modi for launching Project Lion in 2020, leading to a rise in the wildcat population from 674 to 891 to date. Speaking at an event to mark World Lion Day 2025 and the launch of a Mega Wildlife Conservation Drive at Barda Wildlife Sanctuary in Gujarat, Union Minister Yadav said, "Narendra Modi, first as Chief Minister of Gujarat and later as Prime Minister, made conservation and protection of the 'King of the Jungle' a priority area." "The Asiatic Lion (Panthera leo persica) is a global symbol of successful wildlife conservation, and on this World Lion Day, we celebrate their remarkable recovery. From just 284 lions in 1990, the population has now risen to 891 in 2025 - a 32 per cent increase since 2020 and over 70 per cent growth in the past decade," he said. He expressed happiness over the significant rise in India's lion population, which has grown to 891, up from 674 in 2020. Bhupender Yadav congratulated every forest official, wildlife lover, and environment enthusiast for their role in this success story. "It is heartening to note that such remarkable growth has been made possible through collective will, dedication, and policies rooted in co-existence," he said, launching a Rs 180-crore wildlife conservation initiative to boost Lion Conservation and Ecotourism. "It is a matter of immense national pride that if the Asiatic lion exists anywhere in the world today, it is in Gir. Our relentless conservation efforts have doubled their population in the past decade, giving hope to global wildlife protection. World Lion Day, celebrated annually on August 10, aims to raise awareness about the conservation and protection of lions worldwide. On August 15, 2020, during the 74th Independence Day address from the Red Fort, PM Modi announced Project Lion to ensure the long-term conservation of Asiatic Lions. The Ministry of Environment, Forest and Climate Change has approved a 10-year project with a total budget of Rs 2,927.71 crore for lion conservation. The Ministry had approved a National Referral Centre for wildlife healthcare with 20.24 hectares of land allocated by the state government at New Pipliya in Junagadh District for this purpose.

CAQM response to RTI: no study behind Delhi-NCR overage vehicle ban
The Commission for Air Quality Management (CAQM) has acknowledged that it has not conducted any independent study or research on the pollution levels caused by so-called End-of-Life Vehicles (ELVs) vehicles -- diesel vehicles older than 10 years and petrol ones older than 15 years -- that have been banned in Delhi-NCR. To be sure, the body clarified that its policy was based on judicial directions, including the National Green Tribunal's (NGT) ruling in Vardhman Kaushik vs Union of India and the Supreme Court's order in MC Mehta vs Union of India. The ban on ELVs applies irrespective of the state in which a vehicle is registered. While CAQM had earlier ordered a fuel sale ban for ELVs at Delhi fuel stations starting July 1, it later postponed the implementation until October 31 following a Delhi government request. The government cited 'operational and infrastructural challenges' in enforcing the order on time. Delhi alone has over 6.2 million ELVs, including 4.1 million two-wheelers. Across NCR districts, an estimated 4.4 million such vehicles are estimated to be operational. CAQM's phased rollout plan involved using Automated Number Plate Recognition (ANPR) cameras and the VAHAN database to identify banned vehicles, starting from November 1 in Delhi and five major NCR districts, and extending the system to the entire NCR by April 1 next year. However, the Delhi government has reported issues with the ANPR system, including software errors, misaligned cameras, faulty sensors, and lack of integration with adjoining states' databases. Amit Gupta criticised the lack of planning and called for a holistic strategy to combat pollution. 'The fight against pollution is not a one-day task. Vehicular emissions are just one part. We also need urgent action against dust, industrial pollution, and poor public transport. Even Delhi's system is not robust, and the rest of NCR is far worse,' he said. Both the Supreme Court and the NGT have previously criticised the delay in removing old, polluting vehicles from NCR roads. Meanwhile, the Delhi government has filed a plea in the Supreme Court to review the 2018 blanket ban on overage vehicles.
