Lawyer cancels bid to temporarily pause JAC for judges' appointments, to send constitutional questions to Federal Court

KUALA LUMPUR, June 25 — Lawyer Datuk Syed Amir Syakib Arsalan Syed Ibrahim today withdrew his bid to have the High Court temporarily pause the functions of the Judicial Appointments Commission (JAC) and to temporarily let the prime minister skip the JAC when selecting judges to be appointed.
The High Court was initially scheduled today to hear Syed Amir Syakib Arsalan's application for a stay.
In the stay application, he wanted the High Court to order a temporary pause on all recommendations for and appointments of judges at the High Court, Court of Appeal and Federal Court if these appointments are based on the mechanisms under the JAC Act 2009.
The stay application had also asked the High Court to order that the prime minister still be allowed to give advice to the Yang di-Pertuan Agong on appointments of judges without having to be bound by the JAC's recommendations, during the period that the JAC's processes are temporarily paused.
His lawyer Daniel Annamalai this morning informed the High Court that his client would be withdrawing this application.
High Court judge Datuk Amarjeet Singh Serjit Singh then struck out the stay application.
When met outside the court, Daniel told reporters that his client had withdrawn the stay application as they were planning to file an application to refer constitutional questions to the Federal Court.
'That is the reason why we are withdrawing the stay, to give way for this application,' he said.
The High Court is still scheduled on July 16 to hear Syed Amir Syakib Arsalan's main lawsuit which seeks to challenge the constitutionality of the JAC Act 2009.
The lawyer had on April 8 filed the lawsuit against the Malaysian government and the JAC.
He is currently seeking eight specific court orders, including to declare the JAC Act 2009 unconstitutional, and to declare the JAC as lacking legal authority to perform its functions.
In the lawsuit, he also wants the court to order the prime minister to follow the constitutional process for the appointing of judges without 'interference' by the JAC.
Currently, the JAC's role is to recommend candidates to be appointed as judges, and the prime minister — after accepting recommendations — would then give advice to the Yang di-Pertuan Agong for the appointment of judges.
PPMM holds watching brief, Bersih joins as amicus curiae
Lawyer Shahrulazwad Ismail also represented Syed Amir Syakib Arsalan today.
Senior federal counsel Ahmad Hanir Hambaly who is also deputy head of the Attorney General's Chambers' Civil Division III, and federal counsel Safiyyah Omar, appeared for the Malaysian government and the JAC.
Former Malaysian Bar presidents Christopher Leong and Karen Cheah, Malaysian Bar vice-president Anand Raj and lawyer New Sin Yew appeared today for the Malaysian Bar, which is an intervener or has previously been made a party to the case.
Hanir and Leong today both said they were not asking for costs over the stay application that has been withdrawn, and the High Court made no order for costs.
Malaysia Muslim Lawyers Association (PPMM) president and lawyer Muhamad Hisham Marzuki, lawyers Muhammad Hariz Md Yusoff and Mohd Wafiyuddin Al-Awal Musa appeared today for PPMM which was seeking to hold a watching brief as the case involves public interest matters.
Lawyer Ramkarpal Singh, who is also Bukit Gelugor MP and a former deputy law minister, applied today for his client Bersih to be made an amicus curiae or friend of the court to assist the High Court.
Ramkarpal said polls reform group Bersih had spearheaded various initiatives on constitutional reforms and human rights issues over the years.
The High Court then allowed PPMM to hold a watching brief, and also allowed Bersih to be an amicus curiae.

'As AI continues to evolve, meaningful dialogue and international cooperation are essential for building a future that is inclusive, secure, and beneficial to all,' he said during the high-level ministerial panel titled Fostering Global Dialogue on AI for a Collective Future at the Unesco GFEAI 2025. Earlier, Gobind participated in a panel discussion titled 'From Readiness Assessment to Enhanced Institutional, Technical and Human Capacities in AI.' During the session, he highlighted Malaysia's achievements, including strengthening nationwide connectivity, adopting a multi-faceted approach to infrastructure, talent, and trust development, and introducing data centre regulations to position Malaysia as a regional hub for data infrastructure. 'I am confident that many more commendable milestones lie ahead. That said, I firmly believe that the next phase of advancement must be underpinned by robust and forward-looking policies and regulations. 'At the Ministry of Digital, our commitment to driving this agenda remains unwavering. We will continue to strive for a digital future that is inclusive, secure, and sustainable,' he said. Later in the day, Gobind held a bilateral meeting with Thailand's Minister of Digital Economy and Society, Prasert Jantararuangtong, who also serves as Deputy Prime Minister. Gobind said their discussion centred on opportunities for regional collaboration in digital technology and AI, with a particular focus on transformative applications in the agriculture, health, and transport sectors. 'Building on the relationship first established during ADGMIN, we reaffirmed our shared commitment to Asean cooperation in digital technologies and AI. As Malaysia assumes the 2025 Asean Chair, I extended invitations to the upcoming Asean AI Summit in August and the SMART City Expo in September, both of which will be held in Kuala Lumpur,' he said. Gobind added that both ministers also addressed the urgent need for joint action on cybersecurity threats in an increasingly AI-driven digital landscape. — Bernama

KUALA LUMPUR, June 26 — All students who obtained 10As and above in last year's Sijil Pelajaran Malaysia (SPM) examination and applied for the Matriculation Programme will be offered places, regardless of race or background. The Ministry of Education (MOE) said this was agreed upon at yesterday's Cabinet Ministers' Meeting. 'This includes students who obtained 10As and had A- results. This policy is the same as the one announced by Prime Minister Datuk Seri Anwar Ibrahim last year. 'This decision is made to ensure all top-performing students in the 2024 SPM examination have the opportunity to further their studies,' it said in a statement today. It added that the existing Bumiputera quota system for the Matriculation Programme remains unaffected. Shukri's defeat in polls not a rejection of leadership, says Perlis PAS leader

(Bernama pic) PETALING JAYA : Shukri Ramli need not resign as Perlis menteri besar despite losing in the Arau PAS division elections last Saturday, says a state party leader. Perlis PAS committee member Ridzuan Hashim attributed the loss to PAS's political maturity, not a rejection of Shukri's leadership in the state government. 'Losing in a party election does not mean one must resign,' the Guar Sanji assemblyman told FMT. 'It just means that he no longer holds responsibilities at the party level and can focus fully on leading the state government.' Ridzuan, the Arau PAS deputy chief, also denied any internal conflict in the division, saying ties among local leaders remained strong and harmonious. He urged outsiders not to stir up tensions or demand Shukri's resignation. 'We thank rival parties for their concern about PAS's internal affairs, but let us handle our own household matters,' he said. Shukri, the Sanglang assemblyman, lost to incumbent Solahudin Azmi who retained the Arau leadership post with 128 votes against Shukri's 43. On Monday, Amanah vice-president Mahfuz Omar claimed that Shukri's defeat signalled a loss of confidence in his leadership among PAS grassroots members. Shukri has faced repeated calls to resign, starting in November 2023 when Kuala Perlis assemblyman Abu Bakar Hamzah accused the menteri besar of ignoring Bersatu president Muhyiddin Yassin's nomination for him (Abu Bakar) to become a state executive councillor as part of Perikatan Nasional's second year in power. Abu Bakar was later made the exco for tourism, arts, culture, and rural development in a state Cabinet reshuffle. Resignation rumours resurfaced in August last year, although Shukri dismissed them at the time as 'naughty political gossip'.
