Double killer could be deported back to Scotland from US

A double killer is facing deportation back to Scotland after he was detained by agents from America's ICE immigration service. Phillip Harkins, 46, originally from Greenock, shot a man dead with an assault rifle during a botched drug deal in Florida in 1999. After fleeing back to the UK, Harkins then crashed a car into a taxi and killed its 62-year-old passenger, Jean O'Neill, also of Greenock. Harkins was jailed for five years for causing O'Neill's death by dangerous driving, but was extradited to America despite his 14-year court battle against the decision and sent to prison for second-degree murder. He was due to be released from jail next week but was detained just before his release date. US Immigration and Customs Enforcement (ICE) officials in Florida have revealed he is back in custody and facing a deportation court hearing. This week a source at Florida's justice department said: 'Phillip Harkins is … detained at Baker County detention facility under a court order. He was detained towards the end of his prison sentence.' The ICE agency is a frequent subject of controversy regarding its enforcement practices, particularly involving arrests and deportations. US activists have claimed immigrants at the detention centre where Harkins is being held are experiencing abuse including lack of adequate hygiene and food. Harkins shot 22-year-old Joshua Hayes in the head at close range during a drug deal in Jacksonville, Florida, in 1999. After his arrest for murder, he jumped bail and returned to Greenock to stay with his grandmother Annie Harkins, who has since died. He told her he had returned for a holiday. Despite being a fugitive, he managed to get a job in the accounts department of a Glasgow company. At the time of his arrest in 2003 over O'Neill's death, Scottish police discovered there was an international arrest warrant in his name and alerted the FBI, who began extradition proceedings. Three months after Harkins's release from prison in March 2006, he was rearrested and the home secretary at the time, John Reid, ordered that he be extradited. Harkins then launched a series of appeals that lasted another 11 years. The killer claimed sending him back to face justice in the US would breach his human rights. The case went all the way to the European Court and became the UK's longest ever extradition court battle. The lengthy pre-Brexit legal process angered the prime minister, David Cameron, who said British laws were too often being overturned by unelected judges in Strasbourg. Harkins was finally extradited in 2017 after US prosecutors assured the British authorities they would not seek the death penalty if he was convicted. In 2018 he admitted guilt over the death of Joshua Hayes. He was sentenced to 25 years for second degree murder, with credit for time served dating back to killing O'Neill in 2003. He could be returned to Scotland if Ice succeed in removing him from the US. At the time of Hayes's murder, his mother, Patricia Gallagher, said: 'Josh was my oldest. So, yeah, it's hard. Josh has got grandchildren now but he'll never know. He's got a son that never got a chance to know him.'

Father's horror as he finds shirtless man lying on top of his seven-year-old daughter in her bed

A father's worst nightmare came true when he found a man who was renting a room in his home lying on top of his seven-year-old daughter with his pants around his ankles. Daniel D'Angelo, 53 - a registered sex offender who did not disclose his status to the homeowner - was arrested and charged on August 17 with lewd conduct and failure to register as a sexual offender, according to the Charlotte County Sheriff's Office. An arrest report obtained by WFTX said the father of the alleged victim found D'Angelo shirtless with his jeans around his ankles, lying on top of the girl in her bedroom. The girl's father confronted D'Angelo, and an altercation between the two broke out. The father took photos of the horrifying scene to show the police as evidence. The photos allegedly depicted D'Angelo pulling up his jeans and leaving the girl's room. The girl told cops that she was sleeping in her bed and woke up to D'Angelo on top of her without his shirt. She said that he was touching her leg and put his finger in her ear before her father intervened. Investigators found D'Angelo's shirt in the girl's bed, but he denied that the photos were of him and claimed he was set up. D'Angelo did admit to being a registered sex offender and an alcoholic, confessing that he had been drinking that day. The suspect was renting a room from the girl's family and had moved into the home just a few weeks before the horrifying ordeal. Before moving into the home, which is located in Port Charlotte, Florida, about an hour north of Fort Myers, D'Angelo was living with a woman named Robin Hart. Hart told local CW affiliate, WINK News, that she was afraid of D'Angelo when they were roommates. 'I was afraid of him because he [kept] banging on my door and banging on my door all the time, and I kept saying, Go away, go away. Go away. Leave me alone,' she told the outlet. D'Angelo's former landlord, Kevin, told WINK that he would get so drunk that 'he didn't know what he was doing.' 'He could barely walk. He just did things that normal people actually never do,' the landlord added. D'Angelo is in jail on a second-degree felony charge of lewd conduct and a third-degree felony charge of failing to register as a sex offender. D'Angelo's former roommate, Robin (right) told local news that she was afraid of him, and his former landlord, Kevin (left) said he drank a lot When sex offenders move in Florida, they have 48 hours to register their new address. The girl's father and the owner of the home told police that D'Angelo didn't notify them that he was a sex offender. D'Angelo was given a $150,000 bond for lewd conduct and a $100,000 bond for failing to register as a sex offender. Daily Mail reached out to the Charlotte County Sheriff's Office for comment and additional information on the case.

Hulking schoolboy learns painful instant lesson after deciding to PUNCH school worker

A Northern California schoolboy learned a painful lesson after he decided to punch a staff member inside a high school gym - only to be dramatically body-slammed to the ground seconds later by a school resource officer. The wild confrontation unfolded Tuesday at Lincoln High School in Placer County, about 30 miles north of Sacramento, where a class of freshmen was watching from the bleachers. Video of the melee, which has gone viral on social media, showed the boy in a heated argument with a male teacher. The staffer appeared to lightly place a hand on the student's arm in an effort to guide him toward the exit, sparking the teen's fury. The student shoved the teacher and suddenly threw a jab that landed squarely on the man's jaw, according to the footage. As the teacher turned away and began walking off, the boy threw several more punches - even as another staff member tried to usher him through the gym doorway. Moments later, with tensions boiling over, the high schooler aggressively punched a second staffer. That's when a school resource officer suddenly charged into frame, grabbed the student, and lifted him off his feet before slamming him onto the ground through the closing gym doors - leaving his classmates gasping and jumping to their feet. The Western Placer Unified School District later confirmed the student will face disciplinary action, stressing in a statement: 'The safety and well-being of students and staff remain the highest priority for Lincoln High School and the Western Placer Unified School District. 'The behavior displayed in this incident does not reflect the values of respect, responsibility, and kindness that the District upholds, and actions of this nature are not acceptable at any school.' Lincoln Police said the student was arrested on the spot and booked into juvenile hall. While the district has not said whether the officer's takedown will be reviewed, the video has sparked fierce debate online. Some viewers insisted the body-slam was excessive, with one commenter writing: 'The officer should be sued. There are amicable ways to do this.' Others defended the intervention, joking that 'someone's parent is on the way after seeing this video lol.' School officials added that the incident was resolved quickly and the remainder of the school day continued without disruption.
