Group sues Central Texas Regional Mobility Authority over ‘refusal' to release info on MoPac South expansion

AUSTIN (KXAN) — The Save Our Springs (SOS) Alliance filed a lawsuit in civil court Friday against the Central Texas Regional Mobility Authority (CTRMA) to try to prompt the release of information related to the proposed MoPac South Expansion, accusing the authority of withholding information that should be released publicly.
The 8-mile project could add express lanes in each direction between Cesar Chavez Street and Slaughter Lane.
The SOS Alliance said in a press release Monday that because the project runs directly over the Barton Springs Edwards Aquifer Recharge Zone from Enfield Road to Slaughter Lane, it 'threatens iconic landmarks and public spaces, including Lady Bird Lake, Zilker Park, Austin High School, the Barton Creek Greenbelt, and Barton Springs,' and that its years-long construction 'will harm air and water quality, public and student health, and critical habitat of the endangered Barton Springs and Austin Blind Salamanders.'
The expansion project has been in the works for over a decade but has faced delays due to legal reviews and the COVID-19 pandemic. The most recent development was an open house held from Nov. 12, 2024, to Jan. 28, 2025, according to the project website.
New renderings for MoPac South Project released
KXAN reached out to the CTRMA to ask for a comment on the lawsuit. The authority responded with the following statement:
We will respond to the lawsuit through the legal process. While we typically don't comment on pending litigation, we assure you that CTRMA follows all of the requirements of the Texas Public Information Act, including seeking a ruling from the Texas Office of the Attorney General when appropriate, and we are complying with the Attorney General's ruling with regard to Mr. Levinski's and Mr. Bunch's requests.

The next steps, outlined in the open house document, are to publish the Draft Environmental Assessment Document for public review, then hold a public hearing on it, and then finalize and submit the Environmental Assessment Document. After that, CTRMA would receive the Environmental Finding. There are no projected dates for these steps to occur, other than all except the last being identified to happen sometime in 2025. Receiving the finding is projected to occur in 2026.
SOS Alliance said in its release that it filed the lawsuit 'based on CTRMA's refusal to provide factual data and traffic modeling analyses that underpin CTRMA's public claims on improving traffic flow and avoiding any 'significant' environmental damage made during its recent and ongoing public engagement process.'
The suit details three separate public information requests made to CTRMA by the SOS Alliance. The suit says CTRMA has refused to fully respond to the three requests, with CTRMA citing 'deliberative process' or 'draft document' privileges, according to the release.
Those requests were detailed in the lawsuit as follows:
June 26, 2024: SOS, through its Senior Staff Attorney Robert 'Bobby' Levinski, submits a request for records to CTRMA regarding the proposed MoPac South Express Lanes Project
July 11, 2024: CTRMA, through its attorney, requests a letter ruling from the Texas Attorney General on the information requested by SOS
Sept. 16, 2024: Texas AG determines CTRMA could withhold the requested information
Dec. 23, 2024: SOS, through its Executive Director, William 'Bill' Bunch, submits another request to CTRMA seeking information relating to and serving the basis for CTRMA's decisions to reject alternative proposals for the Mopac South Lanes project and to adopt the recommended '2C' option.
Dec. 31, 2024: SOS, through Bill Bunch, submitted a request to CTRMA for the release of memoranda or reports on the Mopac South project summarizing or analyzing modeling results that predict travel times and travel-time changes under different alternatives, including both tolled and free lanes.
Jan. 15, 2025: In a letter to the Attorney General, CTRMA stated that it had provided SOS with certain information requested on Dec. 23, 2024, and would withhold the remaining information. The lawsuit also claimed that CTRMA 'mischaracterized' Bunch's Dec. 31 request as a 'clarification' to the Dec. 23rd request. CTRMA then requests a ruling from the Texas Attorney General regarding the withheld material.
The lawsuit said that as of the date of the suit's filing, 'while Defendant [CTRMA] has released some limited responsive information, the vast majority of the requested information continues to be withheld.'
The Texas Attorney General's office issued preliminary opinions supporting CTRMA's denial, but SOS Alliance said in its release that those opinions 'are not binding' and are 'often misapplied,' noting that the deliberative process exception does not shield factual information or technical observations from public disclosure.

Do you remember that day in March 2020 — five years and several eternities ago — when Tom Hanks tested positive for COVID-19, the NBA announced they were suspending their season and profound upheaval suddenly seemed inevitable? I've felt echoes of that feeling the past few days, as downtown businesses boarded up their windows and the facts on the ground grew ever more fantastical. Are we at the edge of some irreparable rupture in American democracy? Or is this just another strange and absurd chapter in a long series of them? On Sunday, the president sent federalized National Guard troops into a city against the will of the state's governor for the first time in 60 years. On Thursday, California's senior senator was tackled to the ground by federal agents and handcuffed at a news conference. Hundreds of active duty Marines were sent into the Los Angeles area, where for days they appeared to be performing heavily armed training exercises on what looked like a high school sports field. (A looming scoreboard, palm trees and jacaranda blooms were all visible behind their riot shields, according to a social media post from the U.S. Northern Command.) The president and the governor are having a momentous fight about constitutional rights in the courts, and flaming each other with insults and photoshopped memes on Truth Social and X. The ICE raids have thrown some Angelenos into a state of fear and virtual hiding. But for many others, ordinary life continues apace. Mayor Karen Bass has repeatedly cautioned that L.A. is being treated like 'a grand experiment' — a testing ground for President Trump to see if he can usurp the authority of Democratic mayors or governors in other states. Warning signs of democratic breakdown have been pointed out by scholars and Trump's critics since he took office for his first term in 2017 — so much so that many have grown numb to them. Has this week been any different? I called Federico Finchelstein, a historian of fascism and dictatorships who chairs the history department at the New School for Social Research in New York, to ask whether he saw this week as a turning point for the country. Finchelstein characterized Trump's federalizing of the California National Guard as a clear turn toward authoritarianism. He cited the move, along with attacks on the press and the judiciary and the manhandling of Sen. Alex Padilla on Thursday, as assaults on democratic norms that 'create the conditions for a further erosion of democracy.' But he hesitated about categorizing recent events as a turning point. It's hard while living in the middle of history to know precisely where you stand, he explained. 'It's very difficult to know what is the exact outcome of this sort of militarization of politics,' Finchelstein said. 'What we know is that democracy is at the other end, and this path is towards either disabling, denigrating or even destroying democracy. It's hard to know where it ends.' The outcome would also depend on more than Trump's next move, according to the historian. History has shown that when anti-democratic attempts are met with institutional and public resistance, they are less likely to succeed, Finchelstein said. Despite firing every member of the federal vaccine advisory committee, Health and Human Services Secretary Robert F. Kennedy Jr. has retained one key figure with a radically pro-passport past. Kennedy, who recently disbanded the Advisory Committee on Immunization Practices (ACIP), kept Dr. Marcus Plescia in a top post at HHS as Deputy Assistant Secretary and Director of the Office of Science and Medicine. Plescia's past comments in favor of vaccine passports place him well to the left of even the Biden White House's stance during the height of the COVID-19 pandemic. In 2021, Plescia — then serving as chief medical officer for the Association of State and Territorial Health Officials — told The New York Times that vaccine passport credentials were 'going to be necessary,' calling it 'perplexing' that the federal government was keeping its distance from such a proposal. His remarks came even as White House Press Secretary Jen Psaki assured reporters that 'there will be no federal vaccinations database and no federal mandate requiring everyone to obtain a single vaccination credential.' Plescia's position, made public at the time through The New York Times' reporting, stood in contrast not only to Biden's hesitancy but also to an ongoing wave of state-level opposition. Governors from Texas, Florida, and Mississippi issued orders banning or opposing any form of vaccine credentialing, arguing it violated basic liberties and privacy. Kennedy's implicit decision to retain contrasts with his other decisions. On June 9, the new health secretary made headlines for his sweeping removal of the 17-member ACIP panel, citing what he called a 'crisis of public trust' caused by conflicts of interest and pharmaceutical industry influence. 'The committee has become… little more than a rubber stamp for any vaccine. It has never recommended against a vaccine—even those later withdrawn for safety reasons.' Kennedy wrote in an op-ed for The Wall Street Journal, adding that many members had received 'substantial funding from pharmaceutical companies.' But the retention of Plescia — whose support for vaccine passports predates the Biden administration's relatively more cautious approach — raises questions. Plescia's 2021 endorsement of vaccine credentials aligned more with European-style digital health passes and apps like those trialed by Cathay Pacific Airlines and implemented by companies such as Walmart. 'There is going to have to be some kind of system where [vaccination status] is verified,' he said, arguing it was the only way to safely reopen businesses and restore public trust. The White House was unwilling to go that far at the time, concerned about the ethical implications and civil liberties involved. Instead, Psaki emphasized the government's position that any such system should 'meet key standards, including accessibility, affordability and privacy,' but would ultimately be left to the private sector. President Biden never fully implemented a vaccine passport system, but he did issue an executive order requiring nearly every private sector employee to get the COVID shot, which in turn prompted companies to create systems of verification for employees and customers. RFK Jr., a longtime COVID vaccine critic, ran a presidential campaign and later accepted his appointment to HHS on promises to dismantle what he called medical 'fascism.' His decision to purge the ACIP panel came after immense pressure from MAHA allies, including Dr. Mary Talley Bowden of Houston, who slammed the secretary for not taking more aggressive policy action to date, The Dallas Express reported. Kennedy's shakeup alarmed some congressional figures. Sen. Bill Cassidy (R-LA), a physician, said, 'Of course, now the fear is that the ACIP will be filled up with people who know nothing about vaccines except suspicion. I've just spoken with Secretary Kennedy, and I'll continue to talk with him to ensure this is not the case.' Kennedy was contacted for comment in the production of this story, but he did not respond. A spokesman for HHS did not immediately respond. Plescia's HHS bio describes his duties as follows: 'He advises the Assistant Secretary and OASH leadership across scientific and medical issues covering the full suite of public health priorities. He oversees staff and program work focused on state and federal health systems, infection-associated chronic conditions, vector borne disease, data-driven decision making and healthcare innovation.' The bio qualifies him for the job by saying, '[He] has widespread experience in medicine and public health. He is Board Certified in Family Medicine and practiced for over 20 years in a variety of settings serving homeless, urban poor and rural underserved populations.'

A now-deleted Army video of tanks being loaded onto a train to Washington, D.C., to appear in the massive June 14 military parade for the Army's 250th anniversary showed a graffitied message spray-painted on the side of the train car – "Hang Fauci & Bill Gates." The video, posted to the Army's X account on Saturday, has since disappeared. It showed an M1A2 Abrams – a 70-ton battle tank – rolling onto a train car at Fort Cavazos in Texas. The death threat to Fauci and Gates – two people who have drawn the ire of President Donald Trump's MAGA base – was painted on a train car marked DODX, property of the Defense Department. Steve Warren, an Army spokesperson, said the Army has no plans to investigate. "We removed the post once notified of graffiti on the train that didn't align with Army values," he said. "We are excited to celebrate 250 years of service to the nation next week." Dr. Anthony Fauci, who led the government's response to COVID during Trump's first term, and Bill Gates, the billionaire Microsoft founder, are frequent targets of criticism from Republicans and Trump's supporters. Fauci has said he received a deluge of death threats and harassment since he became a magnet for right-wing outrage as the head of the National Institute of Allergy and Infectious Diseases during the Pandemic, making him the public face of many pandemic social distancing policies and the COVID vaccine. Republicans have accused him of funding the Chinese government to create the virus and conservative firebrand Rep. Marjorie Taylor Greene said he "belongs in prison." "I still think deep down that there's a possibility that somebody's going to kill me," Fauci told USA TODAY in a 2024 interview. Former President Joe Biden issued a preemptive pardon for Fauci before he left office, anticipating that Trump would seek revenge against the doctor. Days into his second term, Trump pulled federal funding for Fauci's security detail. Gates, a Democratic Party donor who contributed millions to Kamala Harris' presidential campaign, also frequently pops up in some conspiracy theories. He has funded vaccination campaigns in poor countries, fueling online speculation that his vaccines contain microchips to track people. The tank in the video was one of 28 tanks and more than two dozen armored vehicles making the weeks-long, cross-country journey to appear in the Army's 250th anniversary parade in the nation's capital on June 14. Washington Mayor Muriel Bowser said on May 29 she is still "concerned" about road damage. The parade has faced scrutiny for conspicuously falling on President Donald Trump's birthday – also June 14. Trump pushed for a military parade during this first term but canceled his plans after pushback from Democrats and local politicians over the cost and logistics. This time around, the parade is estimated to cost as much as $40 million. Around 7,000 soldiers will also arrive in Washington for the occasion, which will also feature historic warplanes, helicopters, parachutists, and a bevy of events and entertainment.
