In a statement on the matter, a spokesperson said: 'An Garda Siochana is precluded by law from commenting on protected disclosures.
"An Garda Siochana does not comment on matters before the courts.

"In general and without commenting on any specific case, An Garda Siochana use a range of internationally recognised investigative techniques when tackling serious crimes such as the sale and supply of drugs and procuring of firearms, either of which could then be used to cause significant harm to the public.
"One of these is controlled deliveries. In controlled deliveries if any material is used it is made safe by the law enforcement agency before being used, ie firearms are deactivated.
'ALLEGATIONS REFERRED'
"Following these allegations being published by a national newspaper in May 2025, the Garda Commissioner referred these allegations to Fiosru for independent examination in line with the 'incidents of concern' provision in the Policing, Security and Community Safety Act, and relevant material was provided.
"As stated by the Commissioner, Fiosru has informed An Garda Siochana that it would not be taking any further action on the matter.

"The individual involved was charged following independent evaluation of the Garda investigation by the Director of Public Prosecutions.'
During Fitzgerald's first court appearance, gardai initially objected to his bail but then acceded to it under strict conditions which the accused had stuck to until the day of taking his own
Another source explained that Fitzgerald did not have any criminal history, which made it difficult to prevent him from getting bail when charged last year.
'NUMBER OF FACTORS'
This source added: 'There are a number of factors that the gardai could object under, such as being a flight risk, interference of witnesses or the risk of committing a serious offence while on bail or the seriousness of the alleged crimes.

'But this all has to be backed up by examples and facts.
"The fact is that this man had no criminal history whatsoever to back up any such concerns.'
The Irish Sun last week revealed how cops probing Fitzgerald's death seized a USB stick found taped to his friend's bedroom window.
They are now examining its contents in a bid to get answers behind his actions.

The juvenile was later charged as part of the garda investigation and granted bail on strict conditions by the Children's Court. It's understood the four-man gang arrested on Wednesday night and reside in different parts of the inner-city. Some of them have previously been investigated for drug intimidation related violence. A source said: 'This was a great capture for gardaí following a particularly violent incident where these lads forced their way into a couple's home before beating them. 'The circumstances surrounding the motive behind this is continuing but the victims are innocent and it seems like it was a very much targeted incident'. Four people, including two juveniles, have been arrested after a couple in their 60s were subjected to a terrifying ordeal in their home in Co Dublin on Wednesday. Gardai have launched an investigation into an aggravated burglary which occurred at a property in Shanganagh Cliffs, Shankill at approximately 7.30pm last night. During the course of the aggravated burglary, four individuals entered the home of a couple in their 60s and assaulted and threatened the couple with a firearm. The four individuals then fled the scene in a vehicle and on an electric bike. Emergency services were called to the scene and the owner of the home, a man in his 60s, was transported to St Vincent's University Hospital to be treated for non-life threatening injuries. Gardaí also responded to the incident and officers attached to Shankill Garda station conducted a search of the area. Gardaí subsequently arrested three individuals when they stopped a vehicle and a fourth individual was arrested a short distance away, who was on a electric bike. During the course of the search of the area, a semi-automatic firearm was recovered. All four men - one aged in his 60s, one in his 20s and two juveniles - are currently detained under Section 30 of the Offences Against the State Act, 1939 at Garda stations in Dublin.
