
Legal bill at Airborne Capital hits €4.2m after it is sued in UK
The scale of the firm's mounting legal bill is revealed in the latest set of publicly-available accounts for Airborne Capital, which is a specialised aircraft leasing and asset management firm.
The fees compared to just $443,000 incurred by the company in 2023. They were $2.3m in 2022.
Airborne Capital is embroiled in a legal battle with former shareholder, UK-based InterGlobe Aircraft Management Services (IGAM), a unit of InterGlobe Enterprises that owns India's largest airline, IndiGo.
IGAM has sued Airborne CEO and co-founder Ramki Sundaram and the Irish firm's chief financial officer, Anand Ramachandran.
InterGlobe has also sued a UK-based entity called Airwayy Partnership, which controls 90pc of Airborne Capital's ordinary shares. All the defendants are being represented by London-based global law firm Slaughter & May.
IGAM has claimed they and Airborne conspired to deliberately mislead it and induce it to sell an interest in the business 'at a far lower price than it otherwise would have done'.
Airborne Capital has insisted IGAM has no basis for the $28m (€25m) claim. The firm has said the claims made against it and its directors 'have no basis in fact or law'.
InterGlobe first invested in Airborne Capital in early 2019, acquiring a 42.5pc stake from Kerry-based financial services firm Fexco and taking a total 65pc shareholding in Airborne.
That involved InterGlobe investing $73m in Airborne. Fexco retains a working relationship with Airborne Capital.
In 2022, InterGlobe exited Airborne via an agreement whereby it received an upfront cash consideration of $43.2m and profit participating notes valued at $30.3m.
But InterGlobe claims the defendants misrepresented revenues by more than $15m in order to adversely impact Airborne Capital's valuation, resulting in InterGlobe selling its interest in the leasing firm 'at a discount to the full value'.
The case remains open, according to official court records.
The latest set of accounts for Airborne Capital show that it made a $4.3m pre-tax loss last year, compared to a $1.5m profit in 2023.
Revenue last year rose to $19m from $15.1m the year before.
Had the firm's legal bill not jumped, it would have been closer to a break-even position.
In 2024, the trend of increased travel continued with airlines returning to profitability, the directors note in the newly-filed accounts.
'Capital markets and investor demand for new aviation issuances/exposures is rebounding, offering aircraft trading and other opportunities,' they added.
Earlier this year, Airborne Capital and Daiwa Securities confirmed a joint venture to create Daiwa Airborne.
Airborne Capital said it continues to pursue emerging opportunities, supported by its business alliance with Daiwa Securities, that will offer 'comprehensive support' to high-net-worth individuals and corporations through Japanese Operating Lease products and the management of leasing services.
Last year, activist investment giant Elliott increased its stake in Airborne Capital by way of about $3m in payment-in-kind equity notes.

New boss at Dr Martens planning sales reboot
The new boss of Dr Martens is to reveal his strategy to get the bootmaker back on track amid a slump in sales. The Camden-based footwear specialist will reveal its latest annual results next Thursday, and is expected to post a drop in revenues and profits. However, investors are likely to focus on a strategy update from the company which is also due that day. Shares in the firm have tumbled by more than 80% since it floated on London's stock market in early 2021. The company has been blighted by sliding sales in recent years as it has fought waning consumer demand and supply chain disruptions. Ije Nwokorie, a former brand chief of the business, took over the top role in January in a bid to help revive its fortunes. This week the company also sought to strengthen its leadership team by appointing Carla Murphy from Adidas as its new chief brand officer and former Nike director Paul Zadof as its Americas president. The appointments come as Dr Martens seeks to bring more shoppers back to the brand and target new growth opportunities. Investec analyst Kate Calvert said: "Having taken over as CEO in January and knowing the company well (previously chief brand officer and a non-executive director), we expect more of an evolutionary strategy. "We are looking to hear what the team's growth priorities are from a range, market and channel perspective, and understand the differences in strategic approach to recent history. "We also expect an update on the delivery of two crucial system projects - its customer data platform plus a supply and demand planning system." Investec has forecast that the fashion firm will report revenues of roughly £803.5m (€953m) for the year to March 31. It would represent another significant drop from £877.1m (€1.04bn) the previous year. In its previous update in January, Dr Martens pointed towards a partial recovery over the key festive period amid progress to turn around its US operation. On Thursday, the company is likely to show further progress with its direct-to-consumer business, efforts to increase cost savings and strengthening its balance sheet. Susannah Streeter, head of money and markets at Hargreaves Lansdown, said: "Dr Martens is expected to deliver more evidence that it is pulling itself up by its bootstraps and the turnaround is lacing together. "It's been reducing inventories and debt, preserving cash and stabilising the business overall. "So there is more optimism around that Dr Martens can kick off a more sustained recovery." Shareholders will also be looking for guidance on how its important US business might be impacted by recent tariff rule changes and how the firm might mitigate any impact.

Homeless entrepreneur Sean builds babywear business inspired by daughter's eczema condition
It's not your average route to market: from living out of a car to starting your own business while in emergency accommodation. But that's the journey undertaken by one young homeless entrepreneur, inspired by his one-year-old daughter's health issues. Sean Fox has come through addiction, health scares, and homelessness in the past few years, so launching a start-up on a second-hand laptop is just another chapter. He has plans to move his online business into markets in Dublin and Cork. Goosey Goo, created with his partner Clodagh Kelly, sells organic hypoallergenic clothing for infants, clocking up almost €2,000 in sales since its inception last month, no mean feat for a business created on a battered second-hand laptop. The company is already in talks about linking up with a prominent Irish investor. All that would have seemed in a different world not so long ago for 26-year-old Sean, who hails from Finglas in Dublin, who stumbled his way through the education system. 'I failed my junior cert and then I got about 250 points in my Leaving Cert. I studied computers in Blanchardstown IT, but never completed it," said Sean. 'I went on undiagnosed with ADHD and found it hard to stick to things that didn't pique my interest. I fell into drug addiction on and off from the time I left school. Cocaine abuse and alcohol abuse were filling a void. I felt like I was lost and without purpose. Sean Fox with his partner Clodagh and their daughter Eabha. Photograph Moya Nolan "I had a bad relationship with my father growing up. He was a drug addict himself and that was my whole life in my teenage years. He'd pick me up on a Friday to bring me over to his place but it was always be a thing where he'd end up on the session and but I'd be left crying at the window every weekend. 'I think all of that had a part to play in where I found myself. You know, I went out looking for love through the street. I didn't always find it at home, so I looked elsewhere. I end up finding other things, and falling into addiction.' The negative spiral saw Sean 'going in and out of jobs' for seven or eight years. 'I went back to college a second time during covid; I studied automotive management and technology in Bolton St. I did that for two years before I dropped out. With cocaine, I'd have about six months and let me life get turn to ruin, then get back on my feet and get a job then would end up falling off again.' Two events got Sean on the road to recovery: meeting partner Clodagh, and the death of his father. 'When my father passed away about three years ago, I got myself back on the straight and narrow. I started going to NA meetings and started to get my head together.' Meeting Clodagh brought another positive into his life. By the time they found out Clodagh was pregnant with baby Eabha, Sean was already started on his journey of recovery, settled and was working as a service advisor for a national car firm. 'I had worked hard, and then I got an offer to work as a service advisor across the city with better money and. It was a dream.' Eabha was born in July 2023, and life was looking up, when fate too another twist. A trip to the dentist saw a sore on his lip misdiagnosed as a squamous cell carcinoma. It turned out to be benign but when Sean told his employer he believed he had oral cancer, he was still on probation in his job. He was let go days later. The young couple, with baby in tow, now had no income and had to leave their accommodation. 'I come from a big family, so there was no space for us in my mother's house in Finglas. We ended up sleeping out of the car, and my Ma would take the baby at night, and we'd call to her during the day. 'I was sacked at start of January 2024, and in mid February we got emergency accommodation, in a converted hotel. We were then moved to an old Magdalene laundry, where my grandmother had been 56 years before.' Eabha had developed eczema, which was another worry. 'It was severe. It was literally head to toe and we'd be wake in the morning, and she'd be scratching her neck. 'When your child has a skin condition you are cutting back all your other spending about 20% for medications and for different skincare products. And like us, when Eabha was raw head to toe, you need specific clothing. Bamboo clothing is realy soft to the touch and children don't sweat as much. But it was expensive, it could cost €30 a piece,' said Sean. 'The friendships we had in homeless accommodation helps get you through, and one evenig we were sitting down with a few of those friends having dinner, when Clodagh saw bamboo clothing could be purchased online. 'The cogs started turning in my head,' said Sean. 'Why don't we sell our own clothing? I just started working from my old laptop. Sean Fox's Goosey Goo baby clothing orders ready for postage. 'I have no background in business. I started getting in contact with suppliers,. It was literally me and Clodagh paying our social welfare to pay for the samples. I put everything into it, this became like a drug to me." The business needed a name. 'Sometimes we'd call baby Eabha our little 'Goose' so we said what about Goosey Goo?' Sean created a goose design emblem and started putting together a business plan. He enrolled in the Enterprise Ireland New Frontiers national entrepreneur development programme, which supports start-ups in Ireland. One of his mentors there was Dr Colin Keogh, a leader in the Irish start-up space, and a specialist in commericalisation, who helps companies and entrepreneurs to bring research and ideas to reality. 'I deliver a lot of content on those courses around the country teaching and training entrpreneurs on building companies. Sean told me his story fully, and that sort of honesty is quite rare in the start up space. It was so impressive,' said Mr Keogh. Building the brand has taken on a life of its own in the year since. Sean sourced a supplier in China who could supply Ecotech standard 100 FSC-certified organic bamboo, hypoallergenic and antibacterial. Bamboo keeps the skin about two degrees cooler than cotton. The babywear prints are designed in Ireland, manufactured in China. The Goosey Goo website is up and running, with babygrows selling for €15. 'We are solving affordability of organic materials for children who suffer from severe skin conditions,' said Sean. Last February, Clodagh was attacked by a service user at the homeless accommodation the family were using, so the family were moved to a new emergency accommodation flat across Dublin city. That's now serving as HQ for Goosey Goo, which was incorporated as a business in April, with the first products ready for market. 'It's my office, my fulfillment centre, team meet-up spot, everything,' said Sean. Clodagh acts as the eyes and ears of the business, the creative director and company secretary. Nicola, who the couple described as their 'homeless mum' in their previous accommodation, previously worked in corporate travel before she found herself and her family homeless. She is now acting as operations director for Goosey Goo. The company even has a young marketing professional on board. 'Alan has just finished his degree in marketing and communication so is jumping on board to gain experience with social media and website marketing,' said Sean. Sean is now looking at the next step in the company's development. 'I'm looking at getting into the Herbert Park market and the St Anne's Park market in Dublin, and I'd like to go down into Cork's Marina Market, which has a huge footfall,' said Sean. 'I'm hoping to do 500 units a month. That might drop off in summer, but should pick up again towards the winter.' This week, Sean was a guest speaker for third level students at the ID8 innovation hub in Dublin who are looking at becoming innovators themselves. He has also held discussions with an angel investor interested in taking a stake in the company. 'That would be a gamechanger but we don't have a valuation yet. I've worked so hard to set up this up, I don't want to give it away,' said Sean. Colin Keogh works with entrepreneurs and business leaders of the future every day, at Trinity, UCD, and other institutions around the country. He doesn't hold back in his praise for Sean. 'I've been in the start-up space for 10 or 15 years, I've started seven or eight companies and I have been involved in 40 or 50 others. I've seen some companies fail, lots of companies grow. Sean's dedication is unmatched, despite the fact he had less resources and much more precarious life situation. 'Goosey Goo has found a massive need. I have an 18-month old so I am aware of the cost, particularly for people that can't afford expensive clothing. "This isn't going to be Sean's only company because he has that bug now that he knows what is possible. 'There's lots of entrepreneurs, a handful may have once been homeless, but to be actively homeless setting up a business, Sean is a one in a million.'

Keys to the Kingdom at €650k developer's former home in Caherdaniel
HOUSING developers aren't known for living in modest homes. Given their stock-in-trade is putting roofs over people's heads, it wouldn't look great if their own properties were demonstrably shoddy. To build confidence in a product and in your own reputation, it's wise to make plain that you're happy to road test your own creation. The woman who bought this Caherdaniel home in Co Kerry eight or so years took it as a good sign that a developer had built it and was also happy to spend his downtime in it. 'I believe he was a developer in Dublin who built it as his own holiday home,' she says, adding that 'he didn't skimp on anything'. 'It was built at the height of the Celtic Tiger, but it wasn't one of those homes that was thrown up. It's a very high-quality build,' the owner says. As any developer worth his salt will tell you, location is everything, and the chap who picked his spot on the Iveragh Peninsula knew in his heart that it doesn't get much better. The holy trinity of mountains, coast and captivating views is hard to beat. Coad, Caherdaniel Moreover, the site had great privacy, in a cul-de-sac, just off the consistently busy, peerlessly scenic Ring of Kerry, and within a short drive of a handful of villages: Castlecove (c five mins), Caherdaniel (eight mins); Sneem (15 mins). Westcove Pier, ideal for swimming, is 15 minutes on foot. Westcove Pier The current owner of this home in the townland of Coad, Caherdaniel, Westcove, was well acquainted with the natural beauty of the landscape when she made the purchase. 'I bought in an area that I knew very well in my childhood and into my 20s. I grew up in London, but my mother was Irish and we always came here for our summer holidays. 'I bought the house very much as a holiday home, with lots of space for family and friends and for entertaining. Open plan kitchen with views of Kenmare Bay 'There was lots of room for people to stay over and even a separate games' room for the kids. It's been perfect,' the owner says. She's used it as a permanent home these past few years and says the area is very nice off-season too. 'It's a great community, and it's not just people coming on holiday. There's lots to do, like books clubs and coffee mornings. I've been living here full-time but it's time now for a new family to enjoy it,' she says. If a family was to buy it as a permanent home, there's a national school in Caherdaniel village and a secondary school in Caherciveen. At almost 2,700 sq ft, it's a fairly capacious home, laid out in a way that seaviews are on display from all the main daytime living accommodation and from two of the four upstairs bedrooms. Open plan dining/living/kitchen Selling agent Ron Krueger of Engel & Völkers says the main open-plan living area is a 'wonderful space, ideal for entertaining' — which it patently is. Natural light floods through floor-to-ceiling windows which frame radiant Kenmare Bay. Across the water is the beautiful Beara Peninsula, cleaved by the Caha Mountain range. Two sets of French doors lead to a terrace, which overlooks the lawn and down towards the bay. It's tailor-made for barbecues. Mr Krueger says the location is 'a haven for outdoor enthusiasts'. Beaches abound and there are Blue Flags everywhere: O'Carrolls Cove; White Strand; renowned Derrynane. Closer to home, Westcove Pier has a modern slipway and safe moorings for boats of all sizes in a tranquil harbour. Fishing opportunities are rife along the coastline. The peninsula has a trio of golf courses, including Waterville links, which attracts a global elite. The Kerry Way hiking path passes a few hundred meters from the front door. When you're done with all the activity, you can kick back in comfort, by the wood burning stove in the lounge area of the open plan space, or outside on the elevated terrace, or on the separate patio by the games room. Games road Lounge If you're too tired to venture upstairs — where two of four bedrooms are en suite with walk-in wardrobes — you can use the downstairs bedroom (there's also a downstairs wet room) — which a new owner may put to another use, such as a study or home office. The separate games room, on the opposite side of a feature arch in the grounds of the house (with storage on the other side), could also be adapted. It has running water. A home gym or artist's studio are other possible uses. As the Iveragh Peninsula is an internationally recognised beauty spot, favoured by visitors, the chances of this home going to an overseas buyer are high. Mr Krueger says they are expecting interest 'very much from within Ireland but also from overseas'. 'So far we've had both Irish interest and enquiries from the US, with showings due to start this week,' the agent says. His guide price for the impressive property is €650,000. Cork and Kerry airports are two hours and one-and-a-half hours away respectively, by car. Kenmare town is a 45-minute drive. VERDICT: Location and setting will get pulses racing among buyers searching for the ultimate holiday bolthole. Overseas interest is a given because of where it is. The quality of the build will also appeal to those looking for a permanent home.
