Raipur: Citing lack of evidence, direct link and the deceased's own negligence, the Chhattisgarh High Court has acquitted two men convicted in an electrocution case.
The court overturned the lower court's verdict, which had sentenced the men to six months' rigorous imprisonment in the two decades old case.
"The prosecution has utterly failed to prove its case beyond reasonable doubt that the deceased died because of the act of the accused persons/applicants," the court said in its judgment.
"The death of the deceased was wholly of his own negligent act. The deceased was not trained in electrical work but skilled in mechanical tasks. Despite this, he climbed the electric pole to connect a wire, indicating his own negligence.
Being an adult and sensible person, he was expected to understand the risks involved in handling electricity. If he chose to proceed despite the dangers, he alone is responsible for the consequences," Justice Radhakishan Agrawal remarked in his order.
The case stemmed from an incident on May 4, 2004, where Shahjahan died after being electrocuted while connecting a thresher machine to an electric pole at Sitapur in Surguja district.

The prosecution alleged that the accused, Shabbir Khan and Shamim Khan, had asked Shahjahan to connect the wire, assuring him the power was disconnected.
The trial court and the appellate court had convicted the men under Section 304-A of the Indian Penal Code (IPC), which deals with causing death by negligence. However, Justice Agrawal, in his order, noted that the prosecution failed to establish a direct link between the accused's actions and the deceased's death.
The court observed that key witnesses, including Mansoor Khan, the deceased's brother, admitted in their statements that they did not witness the incident. Mansoor also acknowledged that his brother was not an electrician but a mechanical worker. HC noted that the deceased was an adult and aware of the dangers of working with electricity.
The court also pointed out inconsistencies in the witnesses' statements, including the omission of Shamim Khan's name in the initial police report. The judge cited Supreme Court rulings, emphasising the need for a direct nexus between the accused's negligence and the victim's death. The high court allowed the criminal revision and acquitted Shabbir Khan and Shamim Khan. Their bail bonds will remain in effect for six months, as per legal procedure.

1 2 Chandigarh: In a major crackdown on unauthorised food businesses, the food safety administration of the Chandigarh health department conducted a surprise raid early Wednesday morning in Bapudham Colony, Sector-26, seizing approximately 450 kg of paneer and other dairy products from a shop and a vehicle. The raid began around 7 am at house no. 714/2, where food safety officers discovered a large quantity of paneer, some stored inside the shop and a significant portion in a pickup vehicle parked outside. In addition to paneer, samples of desi ghee and dahi were also seized. All seized samples will be sent to a food analyst laboratory authorised by the Food Safety and Standards Authority of India (FSSAI). "Suitable action shall be initiated against the operator if it is found non-conforming to the standards," said an official. Also, two challans were issued under Section 63 of the Food Safety & Standards Act, 2006, one to the shopkeeper and another to the vehicle operator, for selling food items for public consumption without a valid FSSAI licence. Hyderabad: Telangana high court Wednesday suspended both the conviction and sentence of Karnataka former minister and mining baron Gali Janardhan Reddy in an illegal mining case while also giving him bail, an order that would save Gali's position as an MLA. Following the conviction and seven-year sentence imposed by a special CBI court, Gali stood disqualified as an MLA and the election authorities would have held a bypoll soon for his seat (Gangavathi). Agreeing with the arguments of the legislator's lawyer, senior counsel S Nagamuthun, that damages from the conviction were irreversible, Justice K Lakshman also ordered his release from jail with certain conditions. 1 2 Navi Mumbai: Senior police inspector Satish Kadam (55) of NRI Coastal police station in Navi Mumbai, who was suspended after being arrested in a corruption case by the Mumbai Anti-Corruption Bureau (ACB) in Oct last year, has now been booked for amassing wealth disproportionate to his known sources of income. The FIR under the Prevention of Corruption Act was registered on June 9 at Ulwe police station by Mumbai ACB unit's police inspector Krushna Mekhale. Inspector Mekhale said, "The examination of Kadam's and his family's property documents and financial records revealed that he amassed wealth worth Rs 3.48 crore during his tenure from Dec 1, 2013 to Oct 9, 2024, which is 297% more than his known sources of income." Mekhale said the disproportionate assets case against Kadam is being further probed by Mumbai ACB unit's assistant commissioner of police Suresh Shirshat. Mekhale stated that following Kadam's arrest last Oct, he spent six days in police custody at ACB's Worli unit, followed by over a month in judicial custody before securing bail from the High Court. Kadam was arrested by the Mumbai ACB unit after he was allegedly caught red-handed while accepting Rs 3.5 lakh in bribes from Ajay Kumbhar to help his builder-father Mahesh Kumbhar get bail in a cheating case.
