SC judge highlights need to create awareness on rights of disabled people

Supreme Court judge Justice Manmohan on Saturday highlighted the need to create sensitisation and awareness about the rights of persons with disabilities.
Justice Manmohan said the courts have and will deliver verdicts on issues concerning the rights of persons with disabilities, but the other organs of the State also have to rise to the occasion.
He was speaking at a conference held here on 'Judging and lawyering at the margins disability rights and beyond'. The conference was organised by Justice Sunanda Bhandare Foundation in collaboration with Qable.
"The need of the hour is to create sensitisation, to create awareness. And I think the more awareness is there about the Act, about the rights that are available, the more the society will understand, the more the courts will understand and it will ensure more compliance," said Justice Manmohan when asked about the issue concerning implementation of the judgements.
He also spoke on the issue regarding continuous monitoring by the court for compliance of its verdicts.
"First of all, the court dockets are absolutely full and really to say that court will pick up this issue and give it absolute priority is not feasible because every day the court is grappling with so many issues," he said.
Justice Manmohan said keeping in view the constraints, it has to be ensured that other organs of the State also rise to the occasion.
The judge said the legislature will have to be aware of the issue and will have to put in place some mechanism whereby the court orders are given effect to.
"Everything cannot be done at the pain of contempt. And if we start using the power of contempt repeatedly, it also loses its utility at some point of time," he added.
Justice Manmohan said it has to be ensured the executive machinery understands that this is an obligation on them and this is "not some charity being done".
"I think the basic problem that is arising is because everyone is believing that this is some sort of a charity which is being done. You think of any concept, whether it's gender justice, whether it is persons with disability, the mindset of the executive as well, to a large extent, the people who have been adjudicating these matters in the past have been that we will deal with it as if one is doing a bit of a charity," he said.
Justice Manmohan further said things will change once people will realise it is a rights-based approach and not charity.
"But yes, I agree with you. As a short-term measure, the court will have to monitor and will have to ensure that its judgments are implemented," he said.
Justice Manmohan also cautioned if people think the court is going to monitor a matter on a daily basis, it may be raising the hopes too high.
"We have to be realistic and we have to ensure that all organs of the State work towards it. Today, everything can't be left at the judiciary's doorstep. If you think that only judiciary is going to resolve the problem of this country, you are sadly mistaken," he said.
Justice Manmohan said until and unless all organs, including the society, works for it, there will be issue at hand.
"Just see, you need empathy in the society which is lacking," the judge said.
"So, the real issue is to sensitise the society to ensure all organs of the society work together and one should not expect that it will be solved only by the judiciary," he added.
Justice Manmohan said the judiciary may take the lead in the matter, but it will only get implemented at the ground level when everyone works together.

Prayagraj, Aug 7 (PTI) The Allahabad High Court on Thursday adjourned till August 20 the hearing on a writ petition challenging the validity of an ordinance related to the Bankey Bihari temple at Mathura. When the matter was taken up before a two-judge bench comprising Justices Arindam Sinha and Manjiv Shukla, it was informed by Additional Chief Standing Counsel R N Pandey that the validity of the Uttar Pradesh Shri Bankey Bihari Ji Temple Trust Ordinance, 2025 has been challenged in the Supreme Court and it is pending. The petition has been filed by Sri Bankey Bihari Ji and two others. Counsel for the petitioner argued that there is no order of the Supreme Court regarding stay of any proceedings in the matter nor any order to transfer the petitions pending or being filed in other courts, and thus the present writ is maintainable here also. However, the court fixed August 20 as the next date of hearing in the case. On Wednesday, while hearing a separate plea challenging the validity of the ordinance, a single bench of the court fixed August 26 as the next date of hearing in the case. Maharashtra Government has accepted Vantara's offer for elephant Mahadevi's rescue rehabilitation in Kolhapur, confirmed Chief Minister Devendra Fadnavis on elephant Madhuri, in what is a welcome move for the elephant that has caused so much pain and anguish for people and governments. Underlining that it is a humane step, Fadnavis further added that the elephant rescue rehabilitation center in Kolhapur will be set up in close consultation with the Forest Department and Jain Math and will meet international standards for elephant care. In a press statement following a meeting with Vantara's managing director Santosh Kumar Jain, Chief Minister Fadnavis wildlife statement has offered to set up the Kolhapur elephant rescue center for elephant Mahadevi in Nandani in Kolhapur district, Maharashtra. He added that Vantara will support the petition filed by the Jain Math in the Supreme Court in favour of the elephant's return to Kolhapur. 'Vantara has also assured that this step has been taken out of love for the elephant and is not at all part of any political or personal ambitions. The offer to set up a rescue rehabilitation centre for elephant Mahadevi in Kolhapur is also an expression of Vantara wildlife initiative support to the joint petition filed in the Supreme Court by the Jain Math and the state government for the safe, secure and dignified return of elephant welfare Maharashtra to her home state. Fadnavis added that Maharashtra government and Vantara will work together for the elephant rescue and Madhuri elephant rehabilitation along with the Jain Math and in strict adherence with the SC order and to 'bring a dignified closure to the long-drawn-out case'. Elephant Mahadevi or Madhuri was shifted to Vantara's elephant sanctuary in Jamnagar last November by order of the Bombay High Court (on animal welfare grounds in response to a petition filed by PETA) and the decision was subsequently upheld by the Supreme Court.

BJP delegation meets Union Minister over raising Almatti Dam height to 524 m

Taking exception to an objection raised by the Maharashtra government to Karnataka's move to raise the height of the Almatti dam to 524 m from 519 m under the second phase of Upper Krishna Project, a delegation of BJP MPs from the State, led by Union Minister Pralhad Joshi, met the Union Jal Shakti Minister C.R. Patil in New Delhi on Thursday. The delegation apprised the Union Minister of the factual situation and said that the move to raise the dam height is being unnecessarily opposed by the Maharashtra government. Terming the opposition condemnable, they told the Minister that as per the order of the Krishna Water Disputes Tribunal, increasing the height of the Almatti dam is Karnataka's right. Later, addressing media persons, party MP Basavaraj Bommai said that consequent to Maharashtra Chief Minister Devendra Fadnavis leading a delegation of MPs to the Union Water Resources Minister opposing the State's move to increasing the height of Almatti dam, a BJP delegation, led by Mr. Joshi, met Mr. C.R. Patil and also Minister of State for Railways V. Somanna to convey that Maharashtra's objections to raising the dam's height are unwarranted and motivated. Mr. Bommai said that the Krishna Water Disputes Tribunal II has approved raising the height of the Almatti dam to 524 m. 'Prior to this, a joint survey by the Centre and three State governments was conducted, including a hydrological study, which concluded that raising the dam will not cause flooding. Even during the 2005 floods, the Central Water Commission stated that there will be no flooding in Sangli and Kolhapur due to the dam. Therefore, Maharashtra's objection is unwarranted. And, it seems to stem from ill intent,' he said. Mr. Bommai said that the tribunal's order is equivalent to a Supreme Court decree and the right of Karnataka to raise the height of the dam as per the tribunal's order has been clearly communicated to the Union Minister. The government will act in accordance with the court order as the issue of gazette notification is pending before the Supreme Court, he said. The former Chief Minister said that the Union Minister told the delegation that nothing will be done outside the purview of the law. Mr. Bommai said that he will also urge the State government to use its legal resources to ensure that the matter is heard by the Supreme Court at the earliest so as to get the gazette notification published. The BJP delegation comprised Govind Karjol, P.C. Gaddigoudar and Ramesh Jigajinagi.
