BGC accused of throwing spanner in the works on home repair orders

Long-suffering BGC customers in homes prone to leaks and flooding due to faulty piping have been dealt a major blow.
Builder BGC is taking legal action to overturn orders by the WA Building Commissioner that they remediate homes damaged by multiple pipe bursts.
The State Government has pledged to fight the move.
BGC clients were already in a worse predicament than other homeowners impacted by the Iplex pipe debacle because they were excluded from a deal brokered by the State Government last year to address the situation.
The latest development means the Building Commissioner's orders to fix their homes could be squashed in the State Administrative Tribunal.
'Companies within the BGC Housing Group have commenced proceedings to overturn remedy orders made by the Building Commissioner in complaints related to the piping,' a spokesperson for the industry regulator, Building and Energy, confirmed this week. 'The State Government is taking steps to vigorously defend the proceedings in the interests of affected homeowners.'
Thousands of homes across WA have been damaged by water leaks and bursts related to the Pro-fit (Typlex 1050) polybutylene piping, manufactured by Iplex Pipelines Australia.
BGC, which is suing Iplex, claims the pipes weren't fit for purpose, while the manufacturer has defended its product and claims the pipes failed because they weren't installed correctly. BGC companies built 50-60 per cent of the affected homes.
The State Government was frustrated last year when the building giant refused to join an agreement that followed months of negotiations between builders and Iplex, mediated by former Supreme Court Justice, the Hon John Chaney SC.
Former Commerce Minister Sue Ellery hailed the agreement, known as the Industry Response, as a 'great outcome' for affected homeowners.
Some 37 other builders signed up to the deal, which provides remedial work proportionate to the number of leaks experienced. Owners who had suffered three or more leaks have the choice of a full or partial replacement of all pipes. The State Government contributed $30 million to a fund to help pay for the works.
Although excluded, BGC customers could alternatively seek building remedy orders from the Building Commissioner, the Government said. BGC has long been urging the Government to issue a product recall.
'BGC continues to respond to the Iplex faulty pipe issue, having now spent $49m repairing 4800 bursts and completing 2000 ceiling repipes,' a spokesperson said on Friday.
'BGC is committed to a full and final resolution that addresses this issue for every impacted homeowner, while holding the manufacturer accountable.
'To ensure this is the case, BGC has commenced its own action against Iplex in the Federal Court, alongside the consumer class action, which is the appropriate jurisdiction to resolve this matter.
'BGC maintains its position that the fastest and most comprehensive path to a permanent solution is via a State Government enforced product safety recall. Impacted customers widely support this solution.'
'An expert report commissioned by WA's Department of Energy, Mines, Industry Regulation, and Safety determined that the primary cause of the pipe failure was due to the way it was manufactured,' the spokesperson added.
'BGC's proposal to the Government is a staged recall that follows the same burst response guidelines of the Joint Industry Agreement, balancing trade and funding constraints while providing certainty for all homeowners.'
West Australians whose homes were fitted with Iplex polybutylene pipes but built before mid-2017 have received no assistance because the pipe manufacturer switched to a different resin from that time.
The Government claims water bursts were more frequent after the Typlex 1050 resin was added to the product. However, the earlier cohort complain their pipes have also failed on multiple occasions, flooding their homes and wreaking misery.
A support group with more than 4000 members claims about 1500 had the pre-2017 pipes.

Nearly $57 million in road safety funding will deliver upgrades across several routes in Perth's northern suburbs, including two major intersections in Wanneroo. The funding is part of the State Government's recently announced latest round of road safety investments, totalling nearly $60 million and split between about $27 million for the State Black Spot Program and $30 million for the Safer Roads Program. As part of the Black Spot Program, the City of Wanneroo will receive $536,600 to install traffic lights at the intersection of Hartman Drive and Prindiville Drive in Wangara, and to restrict right turns from Buckingham Drive onto Hartman Drive. The city has also allocated $580,000 for safety upgrades on Santorini Promenade in Alkimos, which will include speed humps and raised plateaus along key sections of the road. The Santorini Promenade upgrade is expected to be completed in the 2026-27 financial year, with the Hartman Drive project scheduled in two stages across 2025-26 and 2026-27. An additional $60,000 was also allocated for upgrades to Shorehaven Boulevard, which were completed last financial year. The funding, totalling $1.12 million, will cover about two-thirds of the cost of the upgrades in the city. Wanneroo mayor Linda Aitken welcomed the funding and said it was crucial that roads and intersections were upgraded to a high standard as traffic increases. 'These locations were selected following analysis of the latest crash data from Main Roads WA, and we've been working closely with Main Roads to identify the best road treatments for each location,' she said. 'A total of 68 crashes have occurred at the black spots along these roads over the past five years. 'We will continue working with the State Government to ensure our local road network can safely manage the anticipated growth in the northern corridor.' The City of Stirling will receive $638,000 to install raised intersection plateaus across five projects. These projects include upgrades at the intersections of Joyce Street–Manning Street, Lockwood Street–Hector Street, Hector Street–Stoneham Street, Princess Road–Amberley Way, and Lawley Street–French Street. The City of Joondalup will receive $10,000 for a staged project to install median safety barriers on the Mitchell Freeway between Hodges Drive and Moore Drive. Road Safety Minister Reece Whitby said while not grand in scale, these upgrades at high-risk sites were vital to improving road safety across WA amid ongoing road fatality challenges. 'These sites have a proven crash history or are high risk for drivers, which is why the Cook Government is ramping up its efforts to fund important projects like these,' Mr Whitby said. 'Despite another devastating year so far in road fatalities, we're working hard in delivering road upgrades, increasing the safety for all drivers across our State.'

Users of another WA port have been whacked with fee increases following on from big hikes ushered in at the Port of Fremantle. The State Government-owned Southern Ports told customers as of July 1 they would be hit with a new fee schedule featuring blanket increases across pilotage, navigation services, berth hire, mooring and wharfage charges. The increases to the Port of Esperance come as the port grapples with the exit of several major customers and a weaker commodity market. Latest results for parent Southern Ports — which also runs the Bunbury and Albany ports — showed profits had dropped from $61.4 million in 2023 to $21.5m for 2024. Total traded tonnes across the three ports were also down from 37.1 million tonnes to 35.3mt. The largest of the price hikes will be applied to vessel mooring and unmooring fees, which have been hiked by 27 per cent. It means a carrier mooring at the Port's largest berth would be paying approximately $4194.50 — or $1130 more — to park up for less than four hours. Scheduled hikes on Fremantle Ports' ship and cargo charges — the highest of which had been 295 per cent — triggered backlash among its customers who lashed charges as an 'excessive cash grab'. Notable remaining exporters through the the Port of Esperance are junior miner Gold Valley Iron Ore, grain handling major CBH and battery metals miner IGO. Mineral Resources had been shipping iron ore through the port from its Yilgarn operation until the end of 2024. The idled mine was then sold to Yilgarn Iron Investments in June. First Quantum Minerals had also been a user of the port until cratering nickel prices forced the Ravensthorpe nickel mine shut in April last year. And it's expected the port will lose IGO as a customer once the Nova nickel mine in the Fraser Range comes to the end of its life at the end of next year. Despite the declines operators were encouraged by a sharp uptick in yearly fertiliser imports reported last month. Southern Ports chief executive Keith Wilks said charges were reviewed annually to ensure the port stays 'competitive and continues delivering value to the State. Meanwhile, Pilbara Ports has elected to extend a 'sustaining infrastructure due' that had been due to expire on June 30 2025 for another 12 months. A spokeswoman said Pilbara Ports, government trading enterprise, was expected to trade 'in a commercial manner'.

More than $1 billion has been lost on poker machines in South Australia in the past year, with experts saying the issue is "spiralling out of control", as cost of living pressures encourage some people to gamble more. Revenue from gaming machines in SA exceeded $1 billion for the first time over the 2024–25 financial year, up nearly $53 million from the previous 12 months. Of that, over $453 million was collected by the state government, while venues shared in nearly $555 million over the past financial year. Losses were particularly bad in regional areas; $24 million across the Mount Gambier and Grant councils and $20.7 million in Whyalla. The Alliance for Gambling Reform's Martin Thomas said gambling losses were "spiralling out of control" across the country, with Australians losing about $32 billion annually to gambling. Mr Thomas said while it is "counterintuitive", studies had shown some people were more likely to gamble when under financial pressure. "Research shows that when people are doing it tough, sometimes it impairs their decision making and the idea of a windfall game, a dopamine hit and escapism — all these factors play into it," he said. "The impacts are in a cost of living crisis are hugely profound. People go without food, people quite often can't pay their rent and it has dire consequences for families." Monash University associate professor Charles Livingstone said while online betting was growing, representing "around 30 per cent" of wagering in Australia, pokies were "still the biggest game in town". He said the social costs of gambling were likely far more significant than the amount people wager. "The most recent study in Victoria estimated that the social costs from gambling [in Victoria] are around $14 billion a year, which is almost three times the amount that people gamble," he said. "When you factor in all those costs, it doesn't look like such a good proposition and, of course, many of those costs are ultimately met by state governments." Across SA's south-east alone, $42 million were lost on poker machines in 2024–25. "Regions certainly have challenges with gambling because pubs and clubs, particularly when it comes to poker machines, are quite often, a central social place and a meeting place for people," Mr Thomas said. "Sporting clubs, likewise, really form the heartbeat of many regional communities. "Unfortunately, that's where poker machines are, and we hear countless stories of people who perhaps are playing football, and they're quite young and they start playing poker machines just as part of that culture and it's a bit of fun. "But for some people it becomes a real obsession and causes enormous financial losses." The Greens called on the SA government to commit to phasing out all pokies by 2030, calling them a "scourge on our state". Greens MLC Robert Simms said poker machines had caused "massive social harm" since their introduction 30 years ago. "There are established links between problem gambling, family violence and violent crime," Mr Simms said in a statement. "It's completely unethical for the state government to continue to use poker machines to raise revenue when they have such a devastating impact on our community." Mr Simms urged the SA treasurer to commit to phasing out poker machines over the next five years and to establish a transition fund to support pubs and clubs to find alternative revenue streams, as had been proposed in other states. "The state government should urgently take up these measures before even more lives are destroyed," he said. "Instead of raising revenue from the gambling losses of struggling South Australians, the state government should instead be funding our essential services by scrapping subsidies for fossil fuel companies and imposing a big bank levy." While the losses are significant, Australian Hotels Association SA chief executive Anna Moeller said the revenue from gaming machines could be "a very important part of helping to make hotels viable". "They act as cross subsidisation, so it means that they can subsidise the cost of food, for example," she said. "That's particularly important now where we've got a cost of living crisis so we're not having schnitzels that are costing $45. "Did they not have the capability of incorporating gaming machines as part of their business model, there are many, many hotels that simply would not be viable." Ms Moeller said poker machines could also be more easily regulated than other online forms of gambling. "South Australia is … the pin-up state in terms of harm minimisation in that space and regulations," she said. "Your danger is that if you over regulate too much, you push people onto those other underground platforms that we don't have optics over." In a statement, Consumer and Business Affairs Andrea Michaels said the government was "committed to reducing the number of poker machines in SA". "SA has some of the strictest laws in the country when it comes to poker machines, including mandated facial recognition and automated risk monitoring of each session of play," she said. "It is certainly a significant amount of money and … we are focused on ensuring that there are protections in place and support available for those who may be struggling with gambling harm."
