The Madurai Bench of the Madras High Court has directed the Transport Secretary to bring in a suitable amendment to the Tamil Nadu Motor Vehicle Rules, and frame proper rules to take action such as cancellation of permit and seizure of share autorickshaws in the event of dangerous driving or overloading of the vehicles.
Justice K.K. Ramakrishnan directed the Transport Secretary to rein in instances of share autorickshaws carrying more passengers than the legally permissible limit, and dangerous driving, which put pedestrians and drivers of other vehicles to hardship.
'Accidents due to drunk driving cannot be taken lightly. It is common knowledge that the autorickshaw drivers operate the vehicles in a rash and negligent manner. They are to be dealt with in a strict manner,' the court observed.
'Carrying more passengers than the permissible limit is to be viewed seriously. The drivers are the custodian of the passengers, and they have a duty to drive carefully. The court has time and again directed the authorities to monitor the share autorickshaws...The government is not taking cognisance of the alarming rate of violation and the consequential loss of human life,' the court said.
It directed the Transport Secretary to submit a report on the action taken, and posted the matter to August 22 for reporting compliance.
The court was hearing an appeal preferred by Chellapandian of Ramanathapuram district. In 2015, the appellant rode his share autorickshaw, carrying more than 10 passengers, in a rash and negligent manner under the influence of alcohol, and hit a police van on Madurai-Kamuthi Road. Three persons died on the spot and several others were injured.
The Additional District and Sessions Court in Paramakudi sentenced him to two years' imprisonment. He challenged the judgment. The High Court observed that the appellant acted contrary to the rules, with total disregard for public safety, and dismissed the appeal.

The Centre had challenged the decision of the principal bench of AFT Delhi that granted special family pension to the widow of Major Sanjeev Chadha, who was found dead in the bathroom 25 years ago, detecting it as a case of brain haemorrhage due to hypertension. On Nov 3, 2023, the tribunal asked the authorities not to adopt any 'mechanical or hyper-technical' method to deny relief. Aggarwal contended that it does not matter if hypertension was never detected when the officer was alive, and pointed out that the officer did not have any habit of smoking or drinking, and there is no recorded history of hypertension in his family either. When he served in various field and peace areas in different climatic conditions, there was continuous stress and strain of service, the counsel said. While dismissing the Centre's petition, Delhi HC held that at the time of joining service, Major Chadha was not noted as suffering from hypertension. Ultimately, however, after he served in the Army for 12 years, he suffered a cerebral haemorrhage and died. "We have seen the post-mortem report. It merely states that Major Chadha died due to ICH (intracerebral haemorrhage) due to hypertension... No cause, other than military service, has been identified, either in the post-mortem report or otherwise by the petitioners, as having caused the hypertension from which Major Chadha suffered," observed HC in an order last week, while upholding the AFT's findings. CHENNAI: Enforcement Directorate ( ) officials on Saturday launched fresh search operations at properties linked to state rural development minister I Periyasamy in Chennai and his hometown Dindigul. While the minister was in Dindigul, a five-member ED team reached his official residence around 7am, accompanied by two CRPF personnel for security. Though the ED has not disclosed the background of the searches, it may be noted that the Madras High Court recently overturned the order of the Dindigul trial court, which had acquitted the DMK leader and his family in the Rs 2.01 crore disproportionate assets case. The case relates to the alleged accumulation of assets worth Rs 2.01 crore between 2006 and 2010, investigated by the Directorate of Vigilance and Anti-Corruption (DVAC). A chargesheet was filed against Periyasamy, his wife Suseela, and sons Senthilkumar and Prabhu. Although the trial court acquitted all of them, Justice P Velmurugan of the Madras High Court in April set aside the order and directed a fresh trial.

CHENNAI: The Madras High Court has questioned the Directorate of Vigilance and Anti-Corruption (DVAC) over the delay in obtaining sanction from the competent authorities of the government to prosecute the accused persons in the alleged Rs 98.25 crore tender irregularities in Greater Chennai Corporation (GCC) and Coimbatore Corporation (CC) when SP Velumani was the municipal administration minister during the previous AIADMK government. Velumani and some government officials, including two IAS officers, have been arraigned as accused. Justice N Anand Venkatesh, in a recent order, directed respondent DVAC SP to file additional affidavit explaining why there was substantial delay in obtaining sanction. He directed the special court for cases registered under the Prevention of Corruption Act (PCA) in Chennai to submit a report on the delay in taking on file the charge sheets filed by the DVAC against the accused persons and companies as per orders passed in another contempt petition on April 4, 2024.
