New Delhi, The Delhi High Court on Thursday asked the Delhi Development Authority not to take action against Shahi Idgah in the capital's Sadar Bazar area for using the park for a religious event last year.
Justice Vikas Mahajan issued notice to the DDA on a petition filed by the Shahi Idgah Managing Committee and asked the authority for a response.
"Renotify on September 10. In the meantime, having regard to the fact that the waqf tribunal is non-functional, where the petitioner has instituted a suit, it is directed that the DDA shall not take any action pursuant to its notice dated February 11, 2025," the court said.
The petitioner's counsel said DDA's notice of February 11 demanded ₹12 lakh for using the park surrounding the Idgah for holding Ijtema, a religious evet, in December, 2024.
The counsel said the park was part of the Idgah premises and DDA had no claim over it, and a suit was filed before the waqf tribunal against the authority's claim over it.
However, since the tribunal was non-functional due to lack of quorum, DDA should hold its hand, he said.
The DDA counsel said a single judge of the high court gave a finding on the park being DDA's property while dealing with the petitioner's plea for installing a Maharani Lakshmi Bai statue there.
The lawyer said the single judge's decision was appealed against by the petitioner before a division bench, which did not intervene.
DDA claimed the religious function was held in its park without prior approval.
The petitioner's counsel said the single judge had no power to rule on the issue of title of the park and the division bench had left open all contentions of the parties.

NEW DELHI: The Delhi High Court has ruled that the Central Board of Secondary Education (CBSE) cannot retain records that contradict a person's passport, warning that such discrepancies could create confusion regarding an individual's identity in matters of employment or immigration. 'A citizen of the country is entitled to a true and correct narration of all necessary and relevant particulars in the public documents that pertain to them,' a division bench of Justice Subramonium Prasad and Justice Harish Vaidyanathan Shankar observed in its judgment on June 4. The court noted that both the matriculation certificate and passport are regarded as 'an unassailable and valid proof of date of birth,' and reiterated that CBSE, as a record-keeper, holds a position of significant public importance. The ruling came while hearing an appeal filed by CBSE challenging a single judge's decision that allowed a correction of the date of birth in the case of one Prema Evelyn D Cruz. She had sought an amendment in her All India Secondary School Examination certificate based on her official birth certificate issued by the Greater Chennai Corporation. CBSE argued the request was barred by limitation under its Bye-laws and Weeding Out Rules, 1998, as documents older than ten years may be destroyed. It also claimed relevant records were unavailable. However, Cruz contended that procedural constraints or document destruction should not prevent CBSE from correcting errors based on valid public documents. Citing Supreme Court precedent, the High Court noted that official birth certificates carry a statutory presumption of correctness and found 'no cogent reason' for CBSE to disregard hers. 'If the CBSE record is at variance with the Passport, it could lead to considerable doubt... for employment, immigration or any other purpose,' the Bench observed, upholding the single judge's ruling and dismissing CBSE's appeal.

NEW DELHI: The AAP on Tuesday claimed its leader Atishi was detained by police when she went to meet the residents of Bhoomiheen Camp in Kalkaji where a demolition is to be carried out. Police, however, denied any detention. Eviction notices by the DDA have been pasted at houses in the jhuggi-jhopri camp, warning 'encroachers' to leave the spot within three days, or face action. The camp, where most residents are migrant workers, has seen demolition drives thrice in the past year —in May and June this year and July 2023. Despite claims of detention, a police officer said Atishi along with others were 'removed' under Section 65 of the Delhi Police Act. Section 65 of the Act, 1978 states that all persons must comply with reasonable directions given by a police officer in the discharge of their duties under the Act. If someone resists, refuses, or fails to comply, the police officer can remove the person, produce them before a Metropolitan Magistrate, or release them in trivial cases, it says. Calling this an act of dictatorship, Arvind Kejriwal posted on X: 'In just three months, the BJP has destroyed Delhi.' At Bhoomiheen Camp, Atishi addressed the media and residents, saying: 'BJP wants to demolish all jhuggis. Today they are taking me to jail because I raised my voice for jhuggi dwellers. CM will face the curse of the poor.'
