BECKLEY, WV (WVNS) — Senate Bill 3145 would require homebuyers to sign a buyer's agreement with any real estate agent before the agent takes the homebuyer to see a property.
The agreement would lock the buyer into a time period of working exclusively with the real estate broker who holds the contract, and it would set up a payment agreement and confidentiality between the homebuyer and their agent.
The National Association of REALTORS already requires members in West Virginia to have their buyers sign the agreement, which typically lays out the responsibility of the homebuyer to compensate the agent a percentage of the sales price, if the home seller does not agree to pay both the selling agent's and buying agent's commission.
The agreement may also lay out an hourly rate the homebuyer will pay the agent and set a time period for the exclusive agent/buyer relationship.
Previously, home buyers did not enter contracts to view homes, but NAR passed the policy as part of a lawsuit settlement.
A REALTOR is an agent who belongs to NAR, but real estate salespersons in the state who do not belong to the organization are not bound by the NAR policy.

A non-NAR real estate agent may decide to have a homebuyer sign a 'buyer's agreement' but may also show houses to a buyer without requiring a commitment.
Supporters say the bill is better for consumers, because it lays out confidentiality and payment agreements between agent and buyer.
David Chinn, a broker with Altruist Realty in Beckley, said on Tuesday, March 11, 2025, that he does not support the bill.
'It's not fair to the consumer to have to sign a buyer's agreement to go look at a house, and that's why we are against it, because they're trying to make it look like a consumer advantage, but it's definitely not,' said Chinn.

He said that under such contracts, an agent could 'snare' a homebuyer for a period of six months and that the homebuyer could not leave the brokerage if she was unhappy.
Chinn said it is ideal for a seller to pay commission for both the selling and buying agent, so that the home sells more quickly and the homebuyer does not have an extra cost.

Jun. 9—Families hoping to send money to loved ones in other countries may be hit with additional fees from a tax and spending bill proposed by the Trump administration that would slap a 3.5% tax on remittances sent by anyone who is not a U.S. citizen. The "One Big Beautiful Bill Act" passed through the House in May and is now being debated by the Senate. The budget bill has several proposed tax changes, which include taxing money sent from an estimated 40 million non-US citizens — including green card holders, temporary workers and undocumented immigrants — to family and friends in other countries. The bill had a 5% tax but was reduced to 3.5%. The bill is another way the Trump administration is hoping to dissuade immigrants, both documented and undocumented, from coming into the country and moving money out of the U.S. economy. Republicans believe the bill would increase the average take-home pay of U.S. citizens, while Democrats believe the bill and increased taxes are "a transfer of wealth from the working class to the rich," said Daniel Garcia, spokesperson for the Democratic Party of New Mexico. What is a remittance? Remittances refer to sending money from one person to another and is typically done between family members from one country to another. A person living and working in the U.S. would send money to family members typically living in a developing country, where this money is a source of income that contributes to the country's gross domestic product (GDP). Payments are typically sent using an electronic payment service or a money transfer app. Banks, credit unions and money transfer services charge a fee for processing remittances, and fees average 10%, according to the International Monetary Fund. Cryptocurrency exchanges are not as heavily regulated and can be a way to avoid additional taxes and surcharges. "Taxing remittances would amount to a form of double taxation, since migrants already pay taxes in the country where they work," Esteban Moctezuma Barragán, Mexican Ambassador, wrote in a statement. "Imposing a tax on these transfers would disproportionately affect those with the least, without accounting for their ability to pay," Barragán added. However, some believe the 3.5% tax fee would give financial support to public services and is the most "pro-worker, pro-family and pro-American legislation we've seen in decades," said Amy Barela, chairwoman of the Republican Party of New Mexico. "Let's be clear, this measure is not about targeting individuals," she wrote in a statement to the Journal. "It's about ensuring the 3.5% fee, although modest, would also have a very meaningful impact in helping offset costs associated with public services, border security, and community infrastructure — relieving some of the financial pressure on hardworking New Mexicans who continue to bear the burden of an imbalanced system." Crucial source of revenue Mexico is the second-largest receiver of personally wired money behind India, according to the Center for Strategic and International Studies. In 2024, Latin America received $160.9 billion, with the U.S. accounting for 96.6% of all remittances to Mexico. They also make up 20-30% of GDP in countries like El Salvador, Guatemala, Haiti and Honduras. "Remittance is a very important source of revenue in our government," said Patricia Pinzón, consul of Mexico. "This would affect Mexican families and the economy in general, but I would say the basic needs of Mexican families is the most worrying thing." However, "whatever happens in one economy will affect the other," said Pinzón. "Our economies are so interrelated that everything that happens here has a consequence in Mexico," she said. "Mexicans will not stop sending money; they'll just look for alternative ways to send it." Mexican migrant workers sent 16.7% of their labor income back to their families, and more than 80% of the income remains in the U.S. economy. The average amount of remittance sent to Mexico is roughly $350 every one to two months, which "could seem like nothing for the U.S., but it's money that a whole family lives on and covers their basics in Mexico," Pinzón said.

USTR eases proposed penalties, fees for non-US LNG tankers, vehicle carriers

By Lisa Baertlein LOS ANGELES (Reuters) -The U.S. Trade Representative softened fee proposals for non-U.S.-built LNG tankers and car carriers amid its ongoing effort to counter China's dominance on the high seas and revive domestic shipbuilding. The revised proposal, unveiled by USTR on Friday, would remove LNG-related penalties for failing to export a percentage of fuel on U.S.-owned ships. It also would reduce fees when foreign-built car carriers visit domestic ports and exempt those vessels when they are serving the U.S. military. USTR previously exempted ships carrying U.S. exports as well as operators of smaller ships from port fees originally aimed at China-linked vessels. The agency also exempted vessels that service the Great Lakes, Caribbean and U.S. territories. "This is a step in the right direction, and we look forward to working with USTR on a solution that ensures U.S. LNG remains competitive on the global stage," Rob Jennings, vice president of natural gas markets for the American Petroleum Institute, said on Monday. USTR caught the liquified natural gas industry off guard in April with new rules for outbound shipments of that fuel, sparking an outcry. It also surprised the vehicle carrier industry with a plan to impose port fees on all non-U.S.-built vessels in that segment - including U.S.-flagged and U.S.-crewed ships admitted to the U.S. Maritime Security Program (MSP) that supports Washington's military readiness. USTR on Friday removed language saying it could suspend LNG export licenses until its rules for moving a percentage of outgoing shipments on U.S.-built and operated vessels were met. On April 17, USTR said LNG producers would have to transport 1% of their exports on U.S.-built ships starting in April 2029. That percentage would escalate to 15% in April 2047 and beyond. The World Shipping Council, whose members vehicle carriers such as Norway's Wallenius Wilhelmsen, did not immediately comment on the revisions. The vehicle carrier fee effective October 14 was to be $150 per car capacity of a non-U.S.-built ship known as roll-on/roll-offs, or RoRos. Typical RoRos have capacity to carry nearly 5,000 vehicles. In the revision, USTR lowered that fee to $14 per net ton. It also exempted vessels in the MSP, as well as U.S. government cargo - matching previous exemptions made for other vessel segments. Companies with ships in the MSP include Florida-based American Roll-On, Roll-Off Carrier Group, a U.S.-flag operator of vehicle carriers that is part of Wallenius Wilhelmsen Group, which did not immediately comment. The RoRo fees come on top of steep, 25% fees on auto imports imposed by Trump. These affect mainly European vehicles. U.S. exporters also use RoRos to export U.S.-made BMW SUVs, John Deere tractors and other goods. Shipping industry groups and attorneys have said USTR overreached by levying fees on RoRos made in countries that were not part of the Biden administration's fast-track investigation into China. The USTR's revisions continued to reference "non-U.S. built" vehicle carriers. Interested parties, which were not previously given the opportunity to comment on rules for RoRos or LNG tankers, have until July 7 to submit feedback on the revisions. As the U.S. electric vehicle market continues to grow, EV drivers expect powerful features from their vehicles, such as fully integrated mobile apps that can unlock their vehicles, plan when to charge and remotely control the air conditioning or heating. Although EV owners are increasingly using their vehicle brand apps, there's room improvement, especially when it comes to connectivity and speed, according to the J.D. Power 2025 U.S. OEM EV App Report, published May 29. Non-Tesla EV drivers are shifting gears in favor of their vehicle's app. Just 17% of non-Tesla EV drivers in 2024 reported using their brand's app each time they got behind the wheel, increasing by 15 percentage points to 32% this year. Tesla drivers are much more likely to use their vehicle's app than other EV drivers, with the report finding 79% of Tesla drivers use the Tesla app each time they drive. That's up from 69% last year. App performance varies across brands, which affects whether drivers choose to rely on their apps. Tesla's high proportion of app usage makes sense, as the J.D. Power report ranked Tesla as the highest performing EV mobile app overall. Among premium EV brands, the Mercedes Benz app ranked second, and the MyBMW app ranked third. MyHyundai with Bluelink was the highest rated mass-market brand app, followed by Kia Access and MINI. 'Top-performing apps deliver fast, consistent remote controls and have desired features,' Violet Allmandinger, mobile apps lead at J.D. Power, said in a statement. 'However, most other apps are still closing that gap.' EV owners surveyed for the report flagged connectivity and app speed as major areas where apps could improve. In fact, app speed was the best predictor of customer satisfaction, J.D. Power said. The majority of EV drivers (70%) also reported interest in app features such as in-app charge payment and trip planning, but many non-Tesla EV drivers had never used such tools, suggesting that they were either unaware of what their apps could do or that their apps had limited features. Indeed, more than half (54%) of non-Tesla EV drivers said they had never tried to pay for a charging session through their vehicle's app. In order to compile the report, J.D. Power surveyed 1,966 EV owners in the U.S. about their EV app usage, the app features they desired and app performance. J.D. Power also assessed apps from 28 EV brands in the United States (as well as 10 in China and 8 in Europe) based on app functionality, features, usability and other indicators of product performance and customer satisfaction.
