Former AG Bill Barr blasts judges for 'usurping' Trump's national security authority on deportation flights
Legal battles continue over President Donald Trump's migrant deportation flights, particularly those involving Venezuelan migrants sent to El Salvador. Former Attorney General Bill Barr says the judges blocking these flights are overstepping their authority.
"There's a pattern whereby these district court judges are trying to usurp the responsibility of the president in the national security area," Barr said Tuesday on "America's Newsroom."
"The president is absolutely right to be frustrated and concerned about the way the courts are handling this."
Barr's comments follow U.S. District Judge James Boasberg's decision to halt the deportation of individuals alleged to be gang members, citing due process concerns. Boasberg also ordered the government to return planes carrying migrants who had already been deported.

According to Barr, the ruling goes beyond the judge's authority and interferes with the president's constitutional powers.

"The Constitution gives the president the power to make the judgments about how we deal with foreign nationals when we are animated by national security concerns," said Barr, who served as Trump's attorney general in 2019 and 2020.
"It's his call, not a district court judge's call."
Judge Boasberg has requested further details about the El Salvador flight, including when it landed and who was on board. However, the Trump administration has invoked the state secrets privilege, allowing it to withhold that information from the court.
On Monday, government attorneys asked an appeals court to lift Boasberg's order and allow the deportation flights to resume. The judges on the panel appeared divided, with Judge Patricia Millett comparing the situation to World War II policies.
"Nazis got better treatment under the Alien Enemy Act than has happened here," she said, arguing that even Nazis had hearing boards before being deported, while the migrants in this case allegedly received no due process.

Barr says this case underscores a broader issue of district court judges issuing nationwide injunctions that impact the entire country.
"Even where it's appropriate for the court to play its traditional role of safeguarding the liberties of American citizens, we have this phenomena of nation-wide injunctions where the lowest level judge, district judges, try to bind the entire nation and bind the president in their initial decision. That is not what we have meant by the judicial power under our Constitution," Barr said.
Supreme Court Justice Elena Kagan voiced similar concerns in 2022 during a speech at Northwestern Pritzker School of Law.
"It can't be right that one district judge can stop a nationwide policy in its tracks and leave it stopped for the years it takes to go through normal process," she said.
Barr is calling on the Supreme Court to intervene and resolve the issue.
"If they [the U.S. Supreme Court] finally stand up and decide a case instead of hanging back from these decisions, I think it'll come out the right way," he said.

Dr. Phil McGraw, the longtime television personality and author, was on the ground with a camera crew Friday to interview Trump border czar Tom Homan and document the ICE raids in Los Angeles that sparked weekend-long protests throughout the city. McGraw did not personally tag along with ICE officers for the raids. Instead, he remained at the Homeland Security Investigations field office in L.A. and interviewed Homan for his conservative TV channel, MeritTV. The conversations he had with Homan throughout ICE's L.A. operation will air Monday and Tuesday night as part of the week's 'Dr. Phil Primetime' broadcasts. According to MeritTV representatives, McGraw was in L.A. to 'get a first-hand look at the targeted operations.' He was also given exclusive access to Homan and spoke to the border czar about ICE's aggressive deportation efforts this year both the day before and day after the agency's L.A. raids. This is not the first time McGraw has gotten to see an ICE operation quasi-firsthand. In January, he became embedded with ICE officials stationed in Chicago. On Friday, however, he chose to sit-out the raids that turned Los Angeles, once again, into a cultural and political hotspot. 'In order to not escalate any situation, Dr. Phil McGraw did not join and was not embedded,' a MeritTV spokesperson said. ICE's recent L.A. operation is far from the first, headline-worthy immigration effort that the agency has conducted since President Trump took office again in late January. The administration made waves months ago when it deported hundreds of Venezuelan migrants it claimed had ties to a notorious gang to an El Salvadoran prison. Homeland Security Secretary Kristi Noem, nicknamed 'ICE Barbie,' has gone out of her way to promote the administration's aggressive immigration policies and efforts as well. She has accompanied ICE raids throughout the year, posed for photos wearing the same gear as immigration officers and been at the center of certain filmed ICE operations. In March, she even visited the El Salvadoran prison where the Trump administration deported hundreds of purportedly illegal immigrants and stood for photos in front of its full jail cells. McGraw's presence at ICE's recent L.A. raids is, in other words, part of an ongoing effort on the Trump administration's part to publicize and increase the visibility of its immigration strategy. ICE's L.A. raids were met with fierce opposition from the city's residents. They sparked protests, some of which turned violent and resulted in multiple injuries, that have continued throughout the weekend and into Monday. President Trump, in response, sent hundreds of National Guard troops to the city. Trump's decision has been fiercely criticized by California Governor Gavin Newsom, who released a letter Sunday denouncing the move as a 'serious breach of state sovereignty' and requesting that the president recall the National Guard. Over 12,000 Harvard alums lend weight to court battle with Trump in new filing
More than 12,000 Harvard University alumni have signed onto a legal document in support of the university's lawsuit against the Trump administration. The document, known as an amicus brief, hasn't been officially accepted by the court as of 2 p.m. Monday. It is a reaction to the federal government pulling or freezing nearly $3 billion in funding to the university. 'As alumni, we are deeply alarmed by the Government's reckless and unlawful attempts to assert control over the core functions of Harvard and its fellow institutions of higher education. Without due process or any recognizable basis in law — and with complete disregard for the freedoms the Constitution secures and the constraints it imposes — the Government has embarked on a campaign to deploy every power at its disposal to damage Harvard,' the brief reads. The 12,000 alumni range from being a part of the Class of 1950 all the way through the Class of 2025. Crimson Courage, a community of Harvard alumni whose mission is to stand up for academic freedom, kicked off the campaign for signatures. Several other individuals and groups have or aim to submit court documents in support of Harvard's lawsuit. Among them have been two dozen universities, Massachusetts Attorney General Andrea Campbell, the American Civil Liberties Union, the American Council on Education, the Foundation for Individual Rights and Expression — also known as FIRE — and Columbia Alumni for Academic Freedom, according to court filings.
