MACC officers acquitted of gang robbery charge
Judge Izralizam Sanusi ordered Muhamad Haffiz Mohd Radzi, 35, Mohd Fahmee Mohamad Nor, 43, and former officer Azwan Asli, 40, to be freed on Monday (Aug 4) after finding that the prosecution failed to establish a prima facie case against them.
In his judgment, he said the court took into account a police report lodged by the victim, who was the first prosecution witness (SP1), stating that the presence of three men at his house was related to an investigation into alleged money laundering offences.

"SP1 claimed he felt threatened because the three accused informed him that he could be detained if he failed to cooperate with the investigation.
"However, the court found that this did not amount to wrongful restraint, as the actions were carried out in the capacity of MACC officers," he said.
Judge Izralizam said that based on the victim's testimony, he did not feel afraid of the three accused during the incident, as he claimed he had not committed any offence.
"There is no evidence that the victim was threatened with a firearm by the three men, even though he alleged that one of them was carrying a firearm in his backpack,' said the judge, adding that the existence of the alleged firearm was not proven during the trial.

On Dec 13, 2023, the three accused were charged with jointly committing gang robbery against a man named Kun Gao, allegedly robbing him of cash, a silver suitcase, and a black Louis Vuitton bag.
The offence was said to have been committed at a condominium on Jalan Ampang at about noon on Dec 10, 2021.
The charge, framed under Section 395 of the Penal Code, carries a maximum sentence of 20 years' imprisonment and whipping upon conviction.
A total of 17 prosecution witnesses were called to testify throughout the trial, which began in November 2024. – Bernama

Burglar nabbed after returning to crime scene to retrieve belongings
BALIK PULAU: A man who broke into a house in Batu Maung was caught after he returned to the scene to retrieve items he had left behind. The matter came to light in a viral video posted on the Facebook account "Amigos Media Viral" this afternoon. Southwest police chief Assistant Commissioner Sazalee Adam said initial investigations revealed that the suspect had entered the home through the back door while the domestic helper was outside disposing of rubbish. "Upon realising the presence of the complainant, the suspect fled the scene. "However, he later returned to the house to collect belongings he had left behind. "The complainant and several friends managed to apprehend the suspect and handed him over to members of a patrol unit on duty in Batu Maung," he said in a statement. Sazalee said the suspect had been detained and would be brought to the Balik Pulau magistrate's court tomorrow for a remand application. "Preliminary urine tests showed the suspect tested positive for methamphetamine, amphetamine and benzodiazepines. "The suspect also has a prior criminal record for a drug-related offence," he added. Police advised the public to ensure that all doors and windows are properly locked and that home security systems are in working condition to prevent similar incidents. The case is being investigated under Section 448 of the Penal Code for house trespass, which carries a maximum jail term of three years, a fine of up to RM5,000, or both.

Baby boy found abandoned at Pasir Puteh bus stop
KOTA BARU: A baby boy was found abandoned, wrapped in a sarong at a bus stop located on Jalan Lama Kulim heading towards the Malaysian Fisheries Development Authority in Tok Bali, Pasir Puteh, at about 1pm on Monday (Aug 4). Pasir Puteh police chief Supt Zaizul Rizal Zakaria said the baby was placed on the ground at the bus stop. "The baby has been sent to Tengku Anis Hospital for examination and treatment," he said in a statement the same day, adding that the case is being investigated under Section 317 of the Penal Code for abandonment of a child.
