Poverty prevents people from filing appeals, says Madras High Court; orders release of life convict citing parity
A Division Bench of Justices M.S. Ramesh and V. Lakshminarayanan concurred with the argument of advocate R. Sankarasubbu that if the convict Balu, alias D. Balasubramanian, had approached the top court along with the three co-convicts, there was every possibility of his sentence also having been reduced from life imprisonment to 10 years of rigorous imprisonment.
The judges allowed a writ petition filed by the convict's wife Indira Gandhi, seeking the release of her husband on the ground of parity. They recorded the submission of Additional Public Prosecutor E. Raj Thilak, who also did not dispute the proposition of law laid down by the Supreme Court, in at least three cases, regarding the principle of extending parity to an unappealed convict.
'When the petitioner complains that her husband's constitutional right under Article 21 (right to life and personal liberty) had been violated, we cannot shrug off our duties and ask the petitioner to... prefer an appeal to the Supreme Court,' the judges wrote and pointed out that the criminal case was from the year 2002, and that more than two decades had passed since he was convicted.
'All that we are doing is performing our constitutional duty of rendering parity between A1, A2, A4 and the petitioner's husband. Our powers under Article 226 of the Constitution are wide and they have been granted only to enable us to do justice. This court also has the inherent power and the jurisdiction, while dealing with situations as presented in the present case, to render justice and prevent manifest injustice,' the judges said.
According to the prosecution, the convicts had robbed 4.7 kg of gold and 5.5 kg of silver from a jewellery shop after killing a person who was sleeping inside the shop. Though the petitioner's husband had not committed any overt act with respect to the murder, he too was convicted under Section 391 of the Indian Penal Code, which makes all members of a gang liable for punishment even if one of them had committed murder.
Though the trial court had imposed only 10 years of imprisonment on the convicts, the High Court had enhanced their punishment to life imprisonment in 2010 while allowing a 2006 State appeal for enhancement of sentence. However, allowing a further appeal by three of the convicts, except the petitioner's husband, the Supreme Court had reduced their sentence to 10 years in 2018 and ordered their release.
Hence, the petitioner had now approached the High Court, by way of a writ petition, seeking parity and obtained the relief.

Congress Leader's RSS "India's Taliban" Remark, BJP's Mahatma Gandhi Reply
New Delhi: Senior Congress leader BK Hariprasad's "Indian Taliban" remark for BJP's ideological parent, Rashtriya Swayamsevak Sangh (RSS), has drawn a sharp response from the ruling party. The BJP has said that the Congress abuses every nationalist organisation and loves banned radical outfits such as PFI and SIMI. Speaking to news agency ANI, Mr Hariprasad, former MP and currently a member of the Karnataka legislative council, criticised Prime Minister Narendra Modi for praising the RSS in his Independence Day address. "They (RSS) are trying to disturb peace in the country. I will only equate RSS with Taliban, they are Indian Taliban and the Prime Minister is appreciating them from Red Fort," he said. "Did any 'Sanghi' participate in the freedom struggle? It's a shame that RSS is not a registered organisation. We don't know where they get funds. Any NGO that wants to work in the country should register, as per the Constitution," the former Rajya Sabha MP said. Mr Hariprasad said the BJP and RSS are "masters of twisting history". "BJP and RSS are the masters of twisting history, and they are trying to rewrite history. It was AK Fazlul Huq (Bengal Prime Minister before Independence) and (Sangh ideologue) Syama Prasad Mookerjee who moved the first resolution in Bengal for the Partition. (Muhammad Ali) Jinnah and (Vinayak) Savarkar were of the opinion that both religions need a separate state. They are trying to blame Congress for it," he said. Delivering his 12th Independence Day address, the Prime Minister on Friday congratulated the RSS for completing 100 years. "Today, I would like to proudly mention that 100 years ago, an organisation was born - Rashtriya Swayamsevak Sangh (RSS). Hundred years of service to the nation is a proud, golden chapter. With the resolve of 'vyakti nirman se rashtra nirman', with the aim of the welfare of Maa Bharati, swayamsevaks dedicated their lives to the welfare of our motherland... In a way, RSS is the world's biggest NGO. It has a history of 100 years of dedication," Prime Minister Modi said, ahead of the Sangh's centenary celebrations on September 25. BJP spokesperson Shehzad Poonawalla responded sharply to Mr Hariprasad's remarks and said the Congress sees goons in Indian forces, surrender in Operation Sindoor, Taliban in RSS and considers Pakistan its own. "Insulting the forces, constitutional institutions, social organisations and Sanatan has become Congress's identity. Courts have pulled them up multiple times because of targeting nationalist organisations," he said. "The Congress's mindset is Taliban. Why did Mahatma Gandhi and Jayaprakash Narayan praise RSS? Why did (former President and Congress veteran) late Pranab Mukherjee visit the RSS headquarters?"

Gunmen fire several rounds at YouTuber Elvish Yadav's Gurugram home
Gurugram: Unidentified attackers opened fire outside the residence of controversial YouTuber Elvish Yadav in Haryana's Gurugram early Sunday morning, triggering panic in the upscale locality. Police said the firing took place between 5.30 and 6 a.m. when three bike-borne assailants sprayed more than two dozen bullets at Yadav's house before fleeing. The bullets struck the ground and the first floors of the residence. Bigg Boss OTT winner Yadav, who lives on the second and third floors, was not present during the attack. His caretaker and some family members were inside at the time, but no one was injured. "Today, on 17.08.2025, at around 5:30/6:00 a.m., some unknown persons fired at a house under the jurisdiction of Police Station Sector-56, Gurugram. No person has been shot in this incident," Gurugram Police said in a statement. Additionally, the attackers are absconding. Police teams rushed to the spot, gathered forensic evidence, and began scanning CCTV footage from nearby areas. Officials said legal action is being initiated, and further investigation will proceed once Yadav's family registers a formal complaint. Relatives of the YouTuber said he had not received any threats before the incident. Yadav is currently outside Haryana for work. According to the investigation so far, the attack was carried out by three individuals riding a motorcycle. Multiple police teams are stationed at the site to track down the assailants. Yadav has been surrounded by controversies since he was arrested over allegations of using snake venom as a recreational drug at parties he allegedly organised. The YouTuber, who was later released on bail, was named along with other accused in an FIR lodged at Sector 49 police station in Noida on November 3, 2023, following a complaint by animal rights NGO People for Animals (PFA). Based on the FIR filed by the Gautam Buddha Nagar Police, the Enforcement Directorate (ED) also launched a parallel probe against the influencer under the Prevention of Money Laundering Act (PMLA) and questioned him on various matters, including details of rave parties, the supply of snake venom, and its sources. Earlier in the month, the Supreme Court stayed the trial court proceedings against the YouTuber. As per the computerised case status reflected on the apex court's website, Elvish's SLP is tentatively listed for hearing on September 23. Senior advocate Mukta Gupta, instructed by advocates Raman Yadav and Aman Jha, represented Elvish before the Supreme Court.
