
Whistleblowers lodge 67 valid HSE disclosures, with a third about patient health and safety

last year, of which more than a third related to the alleged 'endangerment of health and safety' of patients or service users.
On Friday, the HSE published its 2024 annual report, which found there were 135 protected disclosures received by the executive last year, up 38 per cent when compared with 2023.
A total of 67 disclosures were deemed to be 'valid'. Of these, 26 were closed over the 12-month period and 41 are 'still under examination'.
More than 80 per cent of disclosures were made by HSE employees, with the remainder coming from Section 38/39 workers who were not HSE employees.

A total of 37 per cent of disclosures related to the endangerment of health and safety, 15 (22 per cent) related primarily to alleged unlawful or improper use of funds, with a further 15 relating to 'oppressive, discriminatory or behaviour that constitutes gross misconduct by a public body'.
The responsible area that had the highest number of disclosures was HSE Dublin and Midlands with 15, followed by HSE Dublin and North East at 12 and HSE Dublin and South East at 10.
According to the annual report, Ireland's population grew by approximately 100,000 people last year, reaching 5.38 million.
The number of people aged 65 and over has increased by 37 per cent since 2015 and life expectancy now stands at 82.6 years – above the EU average.
As a result of the ageing population, the burden of chronic disease and cancer 'remains high, particularly among older adults'.
The report highlighted a number of areas in which services have improved, including a reduction in waiting times for elective procedures as well as fewer people on trolleys.
However, it also acknowledged the provision of disability services as a key challenging area for the health service.
'A major priority for the HSE is to significantly improve access for children and families to services,' the report said.
'There is still much to do to significantly improve access when needed, particularly for children and young people.'

Speaking about the annual report, HSE chief executive Bernard Gloster said last year marked 'real progress'.
'We reduced the number of people waiting on trolleys by over 10 per cent, expanded community services and improved access to scheduled care with an additional 24,000 patients seen within target time frames,' he said.
'Our focus in 2025 will be to build on this momentum, improve patient flow and continue to reform how care is delivered across seven days.'

Why have there been so many food recalls over listeria?
THE FOOD SAFETY Authority has recalled almost 150 food items since last week due to the possible presence of harmful bacteria called Listeria monocytogenes. Listeria is a pathogenic bacteria which can cause the listeriosis disease. Last week, one person in Ireland died as a result of listeriosis, while as of last Tuesday, nine people were confirmed to have the infection. Yesterday, seven different spinach and mixed leaves products produced by McCormack Family Farms were recalled due to the detection of listeria monocytogenes, with two more spinach products affected by another recall today. The Food Safety Authority of Ireland (FSAI) had released a statement earlier today to say there are no cases of listeriosis associated with the spinach and mixed leaves products that are the subject of this recall. It said there is currently no evidence that this food recall is linked with the separate listeriosis outbreak, which first emerged last week and is related to ready-to-heat meals. The food safety watchdog acknowledged consumers may be anxious at the news of a second series of recalls involving Listeria monocytogenes. It said: 'While we urge people to be aware of the risks, and to take precautions when using ready-to-eat foods, they can be assured that there is a robust food control system in place in Ireland, which contributed to the identification of the latest need for a recall.' What has been recalled? 142 different ready-made meals and side dishes sold in major supermarkets across Ireland, which are made and distributed by Dublin-based Ballymaguire Foods , were recalled last week due to the possible presence of the bacteria. Seven different spinach and mixed leaves products produced by McCormack Family Farms were recalled yesterday due to the detection of listeria monocytogenes, with two more batches recalled today. The full list of the dates of the affected products is available on the FSAI website . Recall notices will be displayed at point-of-sale in stores. Supermarkets impacted by the recalls include Tesco, Supervalu, Centra and Aldi. Advertisement What are Listeria monocytogenes and listeriosis? Listeriosis is an infection caused by the bacterium Listeria monocytogenes. The pathogenic bacteria, according to the FSAI, can cause diarrhoea, fever, headache and muscle pain. Consumption of contaminated food and feed is the main route of infection by Listeria in humans and animals, although human infection can also result from contact with infected animals. The Listeria bacteria that can cause illness is killed by cooking food thoroughly. The FSAI said there are between 14 and 22 cases of listeriosis reported in Ireland each year. In rare cases, the infection can be more severe, causing serious complications. Some people are more vulnerable to Listeria monocytogenes infections, including pregnant women, babies, and people with weakened immune systems, including the elderly. These individuals are advised to avoid higher risk foods and ensure that they cook ready-to-heat meals thoroughly until piping hot, and in line with manufacturer's instructions. What should I do if I've come into contact with a recalled food? If you have eaten any recalled foods and you feel unwell, seek medical advice. If you feel well, you don't need to do anything. The incubation period (time between initial infection and first symptoms appearing) is three weeks on average, but can range between three and 70 days. Consumers are advised not to eat recalled products. The FSAI has advised consumers to dispose of them, or return them to the store where they purchased them, as directed by the retailer. Retailers are requested to remove the implicated products from sale and display recall notices at the point-of-sale. Wholesalers and distributors are requested to contact their affected customers and recall the implicated products and provide a point-of-sale recall notice to their retailer customers. Caterers should not use the implicated products. Measures to reduce the risk of listeriosis: Always wash your hands before and after preparing food, and before eating Cook food thoroughly, especially meat and meat products, chicken and vegetables, and pre-prepared, ready-to-heat meals, ensuring that they are cooked through to the middle and piping hot (food that requires cooking should reach 75 degrees Celsius for at least 30 seconds) Wash salads, fruit and raw vegetables thoroughly before eating, or peel if appropriate Keep uncooked meats separate from vegetables and from cooked and ready-to-eat foods Wash hands, knives, and cutting boards after contact with uncooked food Make sure that your refrigerator is working correctly (it should be kept between 0 degrees Celsius and 5 degrees Celsius) When heating food in a microwave, ensure you follow heating and standing times recommended by the manufacturer Keep foods for as short a time as possible and follow storage instructions, including 'use by' dates Throw away left-over reheated food. High Court confirms suspension of physiotherapist who gave Botox-like drug to clients
A physiotherapist who administered an unlicensed Botox-like product to a number of clients and was found guilty of poor professional performance has been suspended for three months by the High Court. High Court president Mr Justice David Barniville confirmed the sanction of Coru, the regulatory body of health and social care professionals, to suspend the Dublin physiotherapist from the register of physiotherapists for three months, starting in October. Igor Castro, who operates a practice on O'Connell Street in Dublin, appeared before a fitness-to-practise inquiry earlier this year over his use and promotion of Liztox, a Korean botulinum toxin product similar to Botox which is used for aesthetic treatments. The fitness-to-practise committee found an allegation proven that Mr Castro had administered Liztox to three clients at his practice in October 2023. READ MORE The committee also found it proven that the Brazilian native had posted one or more posts on his Instagram account between October and November 2023 promoting the fact that he was administering the Botox-like product to clients. In the High Court on Monday, Coru solicitor JP McDowell, of Fieldfisher solicitors, said the committee regarded it as a very serious matter 'and it goes to the issue of public safety'. He said mitigating factors were considered including that Mr Castro had 'considerable insight into the error of his ways'. Confirming the suspension to begin in October, Mr Justice Barniville noted that Mr Castro had made a full admission and was very apologetic for what happened. At the Coru fitness-to-practise committee inquiry last January, the inquiry's chairwoman, Geraldine Feeney, said the committee made its findings on the basis of Mr Castro's own admissions and the uncontroverted evidence of a number of witnesses, including an enforcement officer with the Health Products Regulatory Authority (HPRA). She said Mr Castro's actions in administering Liztox when it was outside his scope as a physiotherapist also represented breaches of the profession's code of professional conduct and ethics. The committee observed that an expert witness had pointed out that Mr Castro was not legally qualified to administer an unlicensed product which was a 'potentially harmful substance'. Ms Feeney said the physiotherapist had demonstrated extremely poor judgment and brought the profession into disrepute. She acknowledged that Mr Castro had co-operated fully from the outset with an investigation by the HPRA and subsequently the Coru inquiry and had made complete admissions about his conduct which she said had demonstrated insight into his wrongdoing. She noted that the committee was satisfied that there was little or no risk that Mr Castro would repeat the conduct in future based on his evidence, insight and statement of regret. She acknowledged that he had provided the inquiry with several references which described him as a 'conscientious and good' physiotherapist. Ms Feeney said the committee was also impressed by the fact that Mr Castro was undertaking continuous education for the purpose of improving his skills and providing physiotherapy services.

Staff at special care centres miss thousands of days due to violence and sickness
Tusla's special care centre staff have lost tens of thousands of days at work due to being harassed, injured or forced to take sick leave since 2021. A briefing note on Tusla's residential care capacity said more than 10,000 days of work had been lost to sickness or harassment at three special care units in 2023 alone. Detention in special care is a last resort for children aged 11 to 17 whose health and safety are at risk. They can only be held in special care on the order of the High Court. Tusla, the child and family agency, is legally obliged to find a special care place for a child once such an order is made. READ MORE A national shortage of special care places has been exacerbated by a recruitment and retention crisis, leading to Tusla being criticised in the courts if and when it is unable to find a place for some of the country's most at-risk children. According to the internal Tusla report – released by the agency under the Freedom of Information Act – by spring last year the total number of staff leaving special care was 'greater than the number of staff hired'. Overall, between 2021 and last year, 168 staff had been hired, but 134 had left, with 37 transferring to different roles. Another two people retired, while one was unable to work due to ill health. The report, prepared in April 2024, also noted that absenteeism among staff in special care was 'relatively high, largely driven by a significant number of incidents of violence, harassment and aggression in the context of escalation of a young person's behaviour because of their complex needs'. The State has three special care units: Ballydowd and Crannog Nua in Dublin and Coovagh House in Limerick. In 2023, there were a total of 10,199 days lost across all three units to violence, harassment, harassment, aggression or illness experienced by staff. Tusla said this included 2,240 days lost to assault of staff working in the three special-care units. In 2022, the total for days lost to violence, harassment, aggression or illness was 8,981. In 2021 there were 10,019 days lost. Reports of violence, harassment and aggression incidents to the Health and Safety Authority from the three special-care facilities and mainstream children's residential services increased from 27 in 2021 to 44 in 2023. Staff in special care reported most incidents, accounting for 39 of the 44 incidents reported in 2023. In the report, Tusla said that it was 'anticipated that for the foreseeable future, [Tusla] will continue to experience ongoing and significant difficulties in staff recruitment and retention which will impair its ability to make available beds in residential care'. It also said: 'This is an ongoing and systemic problem, which is not confined to a simple question of financial resources or the responsibility of a single agency, but which relates to the need for additional resources, policy and legislative changes, creative thinking and an inter-agency and whole-of-government approach.'
