‘Very, very questionable ethically': Dodgy movie marketing hits social media sites

It's a recent but common phenomenon, you're scrolling through Instagram or TikTok when you get a reel for a recently released movie or TV show, it's crudely edited, maybe even an AI mashup of readily available material like trailer and teaser videos. Yet it draws you in and gives you the push you needed to watch on streaming or go and see it in cinemas.
Such reels posted on 'ghost' accounts, arrive out of nowhere with no official branding, are mass produced, and may not even appear like an advertisement.
But some believe they are.
Are 'ghost-edits' the newest form of dodgy advertising? And are they even legal?
Australian National University marketing expert Dr Andrew Hughes says the phenomenon represents the core difficulty that lays at the heart of marketing – as soon as audiences know they are being marketed to it becomes significantly more difficult to market to them successfully.
Social media and its 'wild west' regulations are proving the new frontier for marketers to get around this and it's a technique that Dr Hughes says 'is ethically very, very questionable.'
'If I see Warner Brothers Studios on like an official account and it's got the blue tick and everything, I'm like, it's just an ad and I'll skip it,' Dr Hughes told news.com.au.
'But if I see it's from say username156, I might go, oh okay, this is interesting. Maybe they've got their own take on it.
'So it seems to be more authentic and more honest and probably a lot more trustworthy than an ad. Because I probably won't trust the ad to tell me whether it's a good movie or not, and that's why they're doing it.
'It's better than an ad because if that was an ad and you knew it was an ad, you'd be going, 'oh, this is just a trailer for an upcoming movie or an upcoming show' and you get out of it. But this is a lot more powerful and has a lot more impact and an influence on your behaviour.'
In Australia content that is sponsored in any form must contain an indication that the content is an advertisement.
However its an area Dr Hughes says our advertising regulator, the Australian Competition & Consumer Commission (ACCC) is incredibly weak in.
'The ACCC are so weak in this area. There's been very few cases I can think of where they've actually taken action against people, and all they usually do anyway is they take it down. They don't fine you. You're not going to face a court somewhere or a judge. 
You don't have to explain why you've done it.'
A spokesperson from the Australian Competition & Consumer Commission (ACCC) said they were unable to comment on the specific phenomenon but that 'under the Australian Consumer Law (ACL), a party that is carrying on a business, should not engage in misleading or deceptive conduct'.
They added the creation of social media content by burner and ghost accounts is – in its current form – unlikely to contravene the ACL, leaving the social media giants to essentially self regulate.
It's a gap between legislation and ethically marketing Dr Hughes said is becoming extremely problematic.
'Legally, they're fine to do it … in terms of the ethics, it's highly questionable because they know what they're doing. This is someone with marketing knowledge, someone who knows this theory, someone who knows the effect of it.
'They've designed this communication. 
These are burner accounts, in other words, you can set them up very quickly and then kill them very quickly as well and there's virtually no evidence they existed.
'It's ethically very, very questionable.
They shouldn't do it. But then again, they won't be the first or last organisation or brand to have done it.'
Dr Hughes said ironically the best way to tell if content is studio approved is to check how long it's been up for.
'Nine times out of 10, the bigger brands in entertainment and content production will take down content if they don't approve it personally. So that's the giveaway, that's how we spot it. Most of the bigger brands will go, 'yeah, no, you can't post that it's copyright. That's our movie or our entertainment product' and they'll get it taken down very quickly.'
'Now when I see content, the first thing I ask myself is: 'okay, so why is the big content owner of this letting this stay up?' And usually the reason why is because it comes from that organisation.'
Because the content is coming from burner accounts it's almost impossible to link to official marketing campaigns and studios however Dr Hughes says to the consumer there is 'no practical difference' between if the content is studio produced or merely allowed to stay up by the studio.
'It's the same thing.
The outcome's the same for the consumer, it's to obtain a change in the consumer behaviour, where they buy the product or adapt the behaviour being specified or influence their preference towards the brand.
'So if it's an [agency, brand or unaffiliated content producer] doing it, it doesn't really matter in terms of the person behind it, they still need to be identified as marketing to the consumer.' 
The issue currently falls between the cracks of Government agencies, federal law and the social media giants self-regulations. But Professor of Media Studies at Monash University Mark Andrejevic, says a legislation change needs to be eyed up in order to put the onus back on the social media giants to not allow unethical marketing to take place on its platforms.
'I think to the extent that [social media] platforms are behaving as publishers, which means the extent that they're making active decisions about what content to pump into our feeds, that they, in a regulatory sense, should be held responsible for that. 

'They're not going to … they won't self-regulate. I don't think we can rely on them to do that. 
So where we do see real social harms obtained from the specific ways in which they push information at us, I think the only response is to regulate them.'

Much of Australia is set to celebrate ahead of King Charles III's 77th birthday, with a parade honouring the monarch kicking off the long weekend at Sydney's Government House on Saturday. The Ceremonial Parade, hosted by NSW Governor Her Excellency the Honourable Margaret Beazley AC KC, kicked off with sunny skies on Saturday afternoon. The Scots College Old Boys Popes and Drums carried out a march-on during the event, while a tri-service Australian Defence Force Cadet Royal Guard was marched on by the NSW Police Force Band. Mounted police also followed the tri-service. A Royal Australian Air Force fly-past was featured during the event, while Uncle Chicka Madden delivered a Welcome to Country. The unfurling of The Royal Standard took place on the Parade Ground to symbolise His Majesty's presence. A garden reception was also hosted on Government House's eastern terrace to celebrate the King. Images from the event showed a large marching band performing outside Government House, as well as rows of marching soldiers and police on horseback. A large seated crowd was also pictured on the lawn, watching as the event unfolded. The King's 77th birthday is not until November 14, however it's celebrated at different times of the year depending what part of the globe you're from. The ACT, NSW, Northern Territory, South Australia, Tasmania and Victoria will celebrate on June 9 this year, while most in Western Australia will mark the holiday on September 29, followed by Queensland on October 6. Mother Mother will never "pander to the TikTok era" with their songwriting. The Canadian rockers - who have exceeded nine billion streams globally - found themselves going viral on the video-sharing platform in 2020, after their 2008 song Hayloft was used in edits, cosplay, and creative transitions. As a result, the group dropped Hayloft II, which also became a hit. Frontman Ryan Guldemond subsequently noticed on Reddit that some people were critcising them for going after commercial success with their music - but he insists that couldn't be farther from the truth. He told "I was reading people saying, 'Oh, they pander to the TikTok era with their new writing.' And it's like, Huh? I don't think that's true. If anything, it's the opposite, like, yeah, you know, the TikTok thing came along and made a bunch of songs that were really unviable, commercially famous, and that was to us that sent a message like, Oh, just be yourself. Like, just write from the heart and follow your whims. And that's the best thing you can do, is to be just totally authentic. And if that means you're writing kind of weird, unconventional songs, then so be it." The 'Finger' singer insists the whole TikTok viral experience taught them to "reject writing strategically for anything". He continued: "And so I've sort of taken that message and really ran with it, because I agree. I think the best thing anybody can do, whether you're writing a song or just, I don't know, whatever in life, just to be who you are. So I'm grateful for the TikTok thing, for sending that message, and if anything, yeah, like I said, it has made us reject writing strategically for anything." The legend of Chris Waller went to a new level as the champion trainer combined with James McDonald to narrowly deny an extraordinary Queensland fairytale at Eagle Farm. Joliestar snatched victory from the jaws of almost certain defeat in the Kingsford Smith Cup to mow down Tony Gollan's Queensland bolter Zarastro and deny jockey Angela Jones her maiden Group 1. It gave Waller his 19th Group 1 of the season, breaking his previous record for the most Group 1 winners in a season in Australia. It was also the first time a female horse had won the Kingsford Smith since Sea Siren saluted in 2012 and Black Caviar a year earlier. But this was a race that was about far more than raw statistics. Just about everyone seemed to have it pegged as a clash between Newmarket Handicap champion Joliestar and Giga Kick, the former The Everest champion. But no-one told young Queensland jockey Jones, riding in just her third Group 1 race and only partnering Gollan-trained Zarastro because the race had been rescheduled from the washout a week earlier. Zarastro, having his first lash at a Group 1, fought like a caged tiger to head off a challenge from Golden Mile and he looked to be heading for an incredible triumph. Then came Joliestar from so far back that even McDonald thought it was a near impossibility, snatching an incredible last gasp win. Joliestar will almost certainly not contest next Saturday's Group 1 Stradbroke Handicap, with owner Brendan Lindsay saying it's not on the cards. Waller felt that what ended up being the winning move was McDonald getting Joliestar across ahead of Giga Kick in the early stages. But, watching the race, Waller still felt it was a tall order to be able to run down the leaders. • Dale ponders shot at Stradbroke with Front Page 'It's been hard to run the leaders down today but we discussed things pre-race and we couldn't change our racing pattern,' Waller said. 'James went straight across from the barriers and got in front of Giga Kick and one or two others and that was what probably won him the race. 'Joliestar was off the bridle at the 500(m) but her class got her home. 'We missed out on (winning) The Everest last year, so we would like to have another crack this year.' McDonald described Joliestar as a 'big rocket.' 'She wasn't entitled to win, but that's how good she is,' he said. 'When I looked up at the 600 (m) I thought I was OK. 'Then I got on my bike but as soon as I did that, the pace quickened and the margin went from five lengths turning for home to seven lengths. 'It just didn't feel like I was making ground. 'I was lucky I was on a proper horse, even though she didn't like the ground at Eagle Farm today.' • Sunrays ends stellar campaign as trainer resists Group 1 lure There has rarely been a happier second-placed finisher in a Group 1 than Gollan who was proud as punch of Zarastro which started as a $17 chance. 'He ran the race of his life, he was so tough,' Gollan said. 'He was beaten three times down the straight, but he kept putting his head out. 'I couldn't have been prouder of the horse, he hasn't raced in many weeks due to track conditions and things like that. 'Then to go down to such a good, strong race like that and race that well, I'm so happy. 'I knew we got beat on the line but it took a multiple Group 1 winner to beat him. 'I'm very proud of my horse and I'm very proud of Angela.' Giga Kick battled away but could only manage sixth while potential Stradbroke Handicap contender Rise At Dawn was fifth. The connections of Giga Kick said it was one of the few times in his career that he has produced a disappointing run.
