Wife's conduct amounts to mental cruelty, says HC, grants divorce to 52-yr-old

The bench on Monday noted that the wife had deliberately abandoned her husband and son after her income increased.
The man, an advocate, had filed for divorce in the family court on the grounds of cruelty and desertion. His application was dismissed on Oct 25, 2023 by the additional third principal judge, family court, Durg.
According to the court documents, the applicant got married on Dec 26, 1996 in Bhilai. They have a 19-yr-old daughter and a 16-yr-old son.
The court was informed that the wife, after completing her Ph.D. with her husband's help and securing a job as a school principal, began to quarrel with him over minor issues.
The husband's legal counsel submitted that during the Covid-19 pandemic, when his income stopped due to court closures, his wife taunted him for being unemployed and made unreasonable demands. Following a dispute on Aug 2, 2020 she left home with their daughter.
The husband and son tried to bring her back but were allegedly forced to leave.
The court was also presented with a letter from Sept 16, 2020 which the wife had written, stating that she was leaving the home of her own free will. She informed the police about her decision four days later.
The bench ruled that the wife's actions constituted desertion, citing that she had intentionally left the matrimonial home without a justifiable reason and had not returned despite the husband's efforts. The court referenced previous judgments from the Supreme Court to support its finding on cruelty and desertion.
The HC concluded that since the couple had been living separately since Sept 16, 2020, their marriage had broken down irretrievably. Accordingly, the appeal was allowed, and the marriage was dissolved.

‘2.27 lakh transactions using single account': CAG flags Rs 59.32-cr excess in Covid-time benefit transfers in Karnataka
A report of the Comptroller and Auditor-General (CAG) of India tabled in the Karnataka Assembly on Wednesday flagged some payments made to beneficiaries in the state during the first wave of the Covid pandemic. The CAG has found that Rs 59.32 crore was paid in excess, while 2,195 beneficiaries could not be verified. The Karnataka Building and Other Construction Welfare Board provided details of around 16.46 lakh beneficiaries to whom aid to the tune of Rs 823.12 crore was provided using direct benefit transfer during the pandemic. 'An analysis of the data provided by the Board revealed that 2,27,231 transactions were conducted multiple times using the same bank account number,' the report noted. Further, 1,08,5689 beneficiaries received benefits multiple times through various payment methods. The CAG audit identified repetitive transactions resulting in excess payments amounting to Rs 59.32 crore. The CAG report on the board said that due to incomplete data provided by the Government, the genuineness of payments amounting to Rs 1.1 crore could not be verified. Irregularities that took place during the Covid pandemic are the subject of an ongoing investigation by the Justice Michael D'Cunha Commission, which has submitted two interim reports related to the procurement of various goods and services and the distribution of benefits during the pandemic. The CAG report also highlighted the registration of ineligible people as construction workers. The CAG scrutinised randomly selected 399 applicants for registration and renewal of beneficiaries available. Its report observed that 'employment certificate furnished along with the applications did not contain the details of employment but were accepted by the Registering Officer'. Tailors, clerks, weavers, and people pursuing some other occupations were registered as construction workers and availed of the benefits, the report said.

HC orders screening of CCTV footage of Nainital poll counting
Dehradun: The Uttarakhand high court (HC) bench of Chief Justice G Narendar and Justice Subhash Upadhyay on Wednesday directed that CCTV footage of the zila panchayat president election counting in Nainital be screened. The court was hearing a petition filed by Poonam Bisht, one of the 22 voters in the election, who alleged that a ballot was tampered with during counting on the intervening night of Aug 14-15. The bench ordered that the footage, preserved in the treasury locker, be shown at 11 am on Thursday at the district magistrate's (DM) office. DM Vandana Singh will arrange for the screening and ensure videography of the process. Bisht's counsel has alleged that an officer tampered with a ballot paper, adding to the controversy surrounding the result. The HC directed that the petitioner, govt counsels, the State Election Commission's advocate and both presidential candidates -- Deepa Darmwal and Pushpa Negi -- be present during the review of CCTV and video recordings. The bench clarified that only nine individuals will attend the screening: three advocates from the petitioner's side, three from the govt, the SEC advocate, and the two candidates. "The tally was equal, so a lottery was conducted to decide the winner. I saw the entire process, as did the observer and it is recorded in the CCTV footage," she told the court. Singh added that both candidates were given two opportunities to examine the process and review the ballots, once during the counting itself and again on Aug 19. Smart Meter tender probe against K J George: Karnataka High Court extends interim order
Bengaluru: The Karnataka High Court on Wednesday extended till August 28, the interim order of stay on the proceedings before the special court in a complaint against state energy minister K J George and officials of the Bangalore Electricity Supply Company (Bescom).
