ActionSA prepares for court battle against eThekwini Municipality over sewage crisis

The legal battle between ActionSA and the eThekwini Municipality over the municipality's failure to address sewage pollution is set to commence at the Durban High Court next week.
The case will be heard on July 24 and 25.
ActionSA said it was pleased that the matter is finally before the courts and was looking forward to the opportunity to fight this long-overdue battle on behalf of all residents of eThekwini.
In a statement, the party said, 'Following long-term failures to resolve its sewage crisis, ActionSA filed papers in 2022 against eThekwini Municipality, citing violations of the constitutionally enshrined rights of eThekwini residents to a safe and clean environment and their right to economic development."
ActionSA said the sewage crisis has profoundly impacted the city, leading to the frequent closure of beaches due to high E. coli levels, the pollution of water systems, and communities suffering the indignity of sewage overflows.
The impact on the domestic economy has been devastating, with annual tourist visits to eThekwini dropping from 15 million in 2015 to less than 800,000 in 2023, the party said.
ActionSA's legal action seeks to have the court declare the failures of the eThekwini Municipality unconstitutional and to compel the municipality to produce a turnaround plan for the crisis, which will be made a time-bound order of court.
If ActionSA is successful, the party stated, either the sewage crisis will be resolved, or senior eThekwini Municipality officials will face jail time for contempt of court if they deviate from the court-ordered turnaround plan.

The party explained that in 2024, the Democratic Alliance filed similar papers in the Pietermaritzburg High Court. However the court had decided to join DA's legal action to ActionSA's case.

Pharas is a shortened version of the Zulu word amaphara, which means hobos, street beggars, and drug addicts. 'These terms, directed at a group of predominantly black ActionSA supporters, are not only deeply offensive but, in the context of our country's painful history, cannot be divorced from their racially charged and dehumanising connotations,' said Beesley. He said it was unethical for Macpherson, as DA's senior leader, MP, and minister, to 'resort to such racist and inflammatory rhetoric'. 'This kind of conduct is fundamentally incompatible with the values enshrined in the Constitution and the responsibilities of elected public officials. 'Despite ActionSA's public call on 28 July 2025 for an immediate apology, Minister Macpherson has refused to retract his remarks or offer any sign of remorse for the harm caused,' said Beesley. In the video, Macpherson is heard saying: 'There is a smallanyana (little) party, (referring to ActionSA), they just brought up some people and we don't know who they are since they are paras, they gave them some green T-shirts. 'When you asked which party (they belong to), they said 'angazi' (I don't know), 'I am just here for one meal and one drink', and they were here for just singing and dancing.' Beesley called for the Ethics Committee to act against Macpherson to preserve Parliament's dignity, 'but more importantly, to affirm the fight against racism in South Africa'. 'We have therefore called on the Ethics Committee to take decisive action against this errant minister and at the very least ensure that he issues a written public apology to ActionSA supporters and to the people of South Africa at large,' he said. The animosity between the two parties was laid bare outside the court, where their supporters were there to support the court action. The DA supporters who carried placards picketed against the eThekwini Municipality as their party had been granted the right to do so. The ActionSA's provincial leader, Zwakele Mncwango, alleged that Macpherson had approached the police to disperse his party members because their party had not applied for picketing. Mncwango said ActionSA members were not picketing when they were approached by police, adding that police stopped removing ActionSA supporters after he and Rodgers intervened. In response to questions sent by this reporter, Macpherson described ActionSA as 'nothing other than an attention-seeking organisation with dubious motives'. He said ActionSA seemed to be always working on distracting him whenever he fights corruption, for reasons he did not understand. 'It was in January of this year that they called for me to be suspended after they tried to push claims that I bribed journalists in relation to the exposes being written about the IDT (Independent Development Trust), and now they come up with bogus claims of racism, just as we have concluded the investigation into IDT. 'Their agenda is very clear: to attack and discredit me so that I back off investigating corruption and maladministration in the department,' said Macpherson.

The council has resolved to write off the asset under construction during a council meeting at Tshwane House on Thursday. ActionSA councillor Thabang Sebotsane condemned the waste of funds, saying the money allocated 13 years ago for the centralised command centre project has been squandered on unimplemented designs and discarded plans. 'These are not just numbers; they represent broken promises by those who came before us for police officers who work day and night without adequate stations, tools, and the residents who endure crime while projects gathered dust,' he said. 'Every project must answer how it will serve the people of Tshwane (and) not irregular and unjustified expenditure that benefits politicians and contractors,' he said. ANC councillor Christopher Masia explained that the project aimed to establish a centralised command centre within the city. Initially included comprehensive design and planning phases, but as it progressed, the city faced significant budget constraints. 'From an accounting perspective, assets write-offs are standard practice when the future economic benefits of an asset are no longer expected to be realised,' he said. Masia stressed that the city must take corrective action regarding asset management and classification to meet internal audit requirements. 'The assets cannot be used for any other purpose due to changing technologies, and current facts are that the designs and planning represent fruitless and wasteful expenditure,' he said. DA councillor Alfred Makhafula said his party, which previously led the city's administration, understands the reasoning behind writing off the metro police department's assets categorised as designs and planning. He cited the designs were no longer viable and the project stalled due to budget constraints. 'We are of the view that it is within the purview of the municipal public account after having scrutinised the report to determine the category of this expenditure,' he said. Makhafula recommended that the R5.3m expenditure on the project be referred to the municipal public accounts committee for further investigation.

ActionSA has reported Public Works Minister Dean Macpherson to the joint standing committee of ethics and members' interests in parliament. This comes after Macpherson allegedly referred to ActionSA supporters as 'Amaphara' and on a separate occasion as 'hobos'. This recently happened in Pietermaritzburg, where ActionSA and DA supporters had disagreements about sharing a picketing area during their court challenge against the eThekwini municipality. In a media statement on Thursday, ActionSA MP Alan Beesley described Macpherson's utterances as 'racist'. 'These terms, directed at a group of predominantly black ActionSA supporters, are not only deeply offensive but, in the context of our country's painful history, cannot be divorced from their racially charged and dehumanising connotations. 'It is unconscionable that a senior party official, member of parliament, and Cabinet minister would resort to such racist and inflammatory rhetoric,' he said. ActionSA still wants an apology Beesly said ActionSA had written to Macpherson requesting him to reflect on his utterances and make a public apology, but he had not done so. 'This kind of conduct is fundamentally incompatible with the values enshrined in the constitution and the responsibilities entrusted to elected public officials. 'Despite ActionSA's public call on 28 July 2025 for an immediate apology, Minister Macpherson has refused to retract his remarks or offer any sign of remorse for the harm caused,' he said. Beesly believes Macpherson had broken several sections of the code of conduct for parliamentarians. These include section 5 (e), which requires members to 'maintain public confidence and trust in the integrity of parliament,' and section 5(f), which requires members to 'be committed to the eradication of all forms of discrimination'. He described the party as merely seeking attention. 'It was in January of this year; they called for me to be suspended after they tried to push claims that I bribed journalists in relation to the exposés being written about the IDT, and now they come up with bogus claims of racism just as we have concluded the investigation into IDT,' he said.
