The High Court of Karnataka has directed the State Chief Secretary to streamline, using information technology, the process of acquisition, award of compensation, redetermination of compensation, etc., all land acquisition cases.
The Chief Secretary should also lay down some guidelines of standard operating procedure with the assistance of e-government department to bring about transparency and efficiency in the system relating to grant of compensation on account of acquisition of land and while doing so, protect the interest of the land-losers, who are rendered voiceless in the proceeding, the court said.
The court also said that the information technology tool to be used for streamlining the process should be capable of capturing the details of the acquisition notification, inquiry, report of the Special Land Acquisition Officers (SLAOs), final notification, court proceedings, reference of award to the courts, and all related proceedings and documents from the time of issuance of a preliminary notification till the final notification, including notices, file notings, etc.
Justice Suraj Govindaraj issued the directions while pointing out the delay in the process of redetermination of compensation based on the civil court's order with respect to certain land that was acquired in 1991 for the Upper Tunga Project in Haveri district and for Konkan Railway project in Karwar of Uttara Kannada district. The SLAO had passed order on redetermination only in 2022, the court noted.
The technology should have tools for day-to-day follow-up of the proceedings before the reference court, and day-to-day actions, and the responsibility of the each of the persons for the proceeding before the reference court, and other proceedings in the acquisition process, the court said.
Meanwhile, the court directed the Chief Secretary to institute an enquiry on the delay in redetermination process in this case and submit a report within six weeks.

The Supreme Court on Wednesday said that the power of the governor to permanently withhold assent to bills would leave the state government, which is elected with majority, at his 'whims and fancies'. 'Would we not be giving total powers to the governor to sit in over an appeal. The government elected with the majority will be at (the) whims and fancies of (the) governor,' Chief Justice of India(CJI), Justice B R Gavai, said. The court was hearing the maintainability of the reference made by President Droupadi Murmu under Article 143. The reference was concerning the April 8 ruling of the top court that set timelines for governors and the President to grant assent to bills passed by the legislature. In the April 8 judgment, a bench of Justice J B Pardiwala and Justice R Mahadevan invoked its special powers under Article 142 of the Constitution to fix deadlines for the President and governors to act on state bills. Replying to the query of the CJI, Solicitor General Tushar Mehta, appearing for the Centre, told the Constitution Bench of CJI B R Gavai, Justice Surya Kant, Justice Vikram Nath, Justice P S Narasimha, and Justice Atul S Chandurkar that everyone derives power from the Constitution. On the powers of the governor under Article 200, Mehta said the governor has four options- assent to the bill, withhold assent, reserve the bill for consideration of the President or send it back to the legislature. He said that when the governor withholds assent, the bill falls through. Article 200 of the Indian Constitution outlines the governor's powers regarding assent to bills passed by the state legislature. If a bill is returned, the legislature can pass it again with or without amendments, and the governor is then bound to give assent. The bench, however, remarked that the governor has to communicate his or her decision and that the focal point of the debate would be whether withholding is temporary or permanent. Mehta said the power to withhold is to be used rarely and only in the first instance, as it leads to the death of the bill. 'The governor is not just a postman. He represents the Union of India, appointed by the President. The President is elected by the entire nation by way of the entire election and that is also a way of democratic expression,' Mehta said. After the April 8 judgment, the President invoked Article 143(1) of the Constitution of India to consult the Supreme Court. This Article, commonly referred to as the power of 'Presidential Reference', empowers the President of India to seek the Supreme Court's opinion on questions of law or fact of public importance. President Murmu, on May 13, posed 14 questions to the Supreme Court of India on several aspects of law, including the ambit of the powers under Article 142. In response, the states of Kerala and Tamil Nadu filed an application questioning the maintainability of the reference. It urged the Supreme Court to return the reference unanswered and said it was an attempt by the Centre to indirectly overrule binding judgments without disclosure. Meanwhile, the central government supported the reference, arguing that the power of governors and the President to act on bills cannot be bound by judicial timelines. The hearing will continue on Thursday.

Bengaluru: The Karnataka High Court on Wednesday extended till August 28, the interim order of stay on the proceedings before the special court in a complaint against state energy minister K J George and officials of the Bangalore Electricity Supply Company (Bescom). Justice M I Arun adjourned the hearing by a private complaint was filed by three BJP legislators against George, Mahantesh Bilagi, former Managing director of Bescom (presently MD of Karnataka State Minerals Development Corporation) and HJ Ramesh, Director (Technical), Bescom alleging irregularities in the issuance of a tender for procuring and installing smart electric meters across the petitioners have sought quashing of the private complaint before the special court for MPs/MLAs in a complaint filed on July 17, 2025. The petitioners further sought quashing of the order passed by the special court on July 23, directing the superintendent of police, Lokayukta, to file his report by the next hearing date under Section 175(4) of the polls: BRS will extend support to candidate who supplies urea to Telangana farmers, says KT Rama Rao .The complaint, filed by C N Ashwath Narayan (Malleshwaram MLA), S R Vishwanath (Yelahanka MLA) and D Muniraj (Doddaballapur MLA), alleged offences under sections 314, 316 and 61 of the Bharatiya Nyaya Sanhita (BNS) and sections 13(1)(a) and 13(1) (b) of the Prevention of Corruption (PC) Act. The High Court of Karnataka has directed the State government to create a central integrated geospatial platform combining data of all types of lands, including Unique Land Parcel Identification Number (ULPIN) or Bhu-Aadhaar and digitised data of forests by geo-tagging of all forest lands along with their demarcated boundaries as per historical gazette notifications. Also, the court directed for setting up an inter-departmental land dispute resolution cell (IDLDRC), directly working under the supervision of the Chief Secretary and comprising representatives from departments of revenue, forest, urban planning authorities, to mediate and issue binding inter-departmental orders on the issue of conflicting land records. Automatic conflict alerts The central platform should have an automated system to streamline all land-related applications to ensure that no land-related action is taken without the mandatory, real-time verification against the unified land database. For example, the court said, the Deputy Commissioners or planning authorities, would have to be legally barred from processing any land conversion or layout sanction applications until the automated system performs a check against the integrated forest map. If a parcel of land falls within a forest boundary, the system must automatically reject the application and generate a 'conflict alert' for all the departments concerned, and the office of the sub-registrars should get alert to prevent registration of any sale deed of such land. The online portal for building plan approvals would also be required to be integrated with this system to automatically verify that the land is legally converted and free from disputes, the court said. Devanahalli land Justice Suraj Govindaraj issued the series of directions while dealing with a dispute over certain lands situated in Devanahalli taluk of Bengaluru as the Forest Department has issued notice Mohammed Shoaib and other land owners, who have already formed layouts by securing statuary approvals from the Bangalore International Airport Planning Authority. These lands had changed several private individuals' hands between 1930s and 1970s. The court said that State Forest Department has to prepare maps of forests using high-resolution satellite imagery from agencies like the Forest Survey of India and the Indian Space Research Organisation and integrate the maps with ULPIN. Mobile app for public Using data from this central platform, a portal and a mobile app should be created for public to get a comprehensive colour-coded reports on land-use classification, ownership history (mutation records), details of litigation, encumbrances, warning if land falls in the boundary of forest or reserved for public purposes, by entering survey numbers or other identifiable details. 'This transparency mechanism of giving access to public would serve as a powerful deterrent to fraud, enabling citizens to perform their own due diligence and effectively acting as a 'fraud alert' for every future buyer,' the court said. The court directed the government to set up a high-level committee (HLC), comprising officers from Chief Secretary's office, to implement these directions in a phased manner spread over two years.
