
Queensland's mandatory life imprisonment for murder lacks public support, law reform body finds
In a consultation paper released on Thursday, the Queensland Law Reform Commission described the state's sentencing scheme for murder as 'the most inflexible in Australia' and raised three options for amendment for public debate.
The proposed reforms directly contradict the headline policy of the new Liberal National party government. Premier David Crisafulli last year sponsored new laws expanding the mandatory sentence to children, which the government concedes is a violation of their human rights.

'The community does not support the mandatory penalty of life imprisonment for murder. The community expects sentencing to reflect the culpability of murder defendants,' according to the QLRC paper.
Queensland's combination of mandatory sentencing and minimum non-parole periods of at least 20 years makes it the most inflexible in the country, the commission said.
South Australia, the Northern Territory, Canada and the United Kingdom are among the other jurisdictions that impose mandatory life sentences for murder.
The independent law reform institution was tasked with undertaking the review as a result of a recommendation of the Women's Safety and Justice taskforce in 2021, which examined coercive control and the experience of women and girls across the criminal justice system.
It conducted preliminary consultation, including 96 meetings with stakeholders including judges, prosecutors, criminal defence lawyers, DFV victim survivors, legal aid, community justice groups and Aboriginal and Torres Strait Islander elders.
The QLRC raised four options for the state's approach to murder sentences:
Making no change
Keeping mandatory life for particular killings such as of very vulnerable victims like children
Setting a presumptive life sentence which the defence would have to argue down
Or a maximum life sentence.
The latter is most common in comparable jurisdictions, it said.
The mandatory penalty creates several problems, the QLRC said, including discouraging guilty pleas, with almost three-quarters of convicted defendants to a murder charge pleading not guilty, compared to just 11.2% of those guilty of manslaughter.
It also does not adequately reflect the particulars and 'nature of the crime and 'may disproportionately impact disadvantaged persons, including Aboriginal peoples and Torres Strait Islander peoples … and (domestic and family violence) DFV victim survivors', the QLRC said.

'In jurisdictions, such as Victoria, where the penalty for murder is maximum life imprisonment, the rate of guilty pleas is higher than in Queensland,' the paper reads.
The commission also found that the state's self-defence laws are unnecessarily complex and hard to understand, and do not work effectively for victim survivors of domestic and family violence who use force against their abuser.
It found that the defence of domestic discipline – which permits the legal use of corporal punishment by parents and teachers for purposes of behavioural discipline or correction – is used to excuse the unreasonable use of serious violence.
And the defence of 'killing on provocation' continues to be used by domestic violence perpetrators who have killed out of jealousy or anger.
The QLRC chair, Fleur Kingham, said: 'our preliminary assessment is that significant reforms are required.'
The Crisafulli government's 'adult crime, adult time' policy was a key commitment at the election in October. The government conceded it directly discriminates against children by limiting their 'protection from cruel, inhuman or degrading treatment'.
The commission is open to submissions from the public until 20 April. A final report with recommendations is expected in December this year.

Indigenous group lodges application for federal protection of Brisbane stadium site
SYDNEY, Aug 5 (Reuters) - A group representing Brisbane's two Indigenous peoples lodged an application with the Australian federal government on Tuesday for the permanent protection of the site where the city plans to build the main stadium for the 2032 Olympics. The Yagara and Magandjin peoples want the inner city Victoria Park, known to them as Barrambin, to be protected for perpetuity under the Aboriginal and Torres Strait Islander Heritage Protection Act as a "significant Aboriginal area". "Barrambin is living country, possessing sacred, ancient and significant relationships within our cultural heritage systems," elder Gaja Kerry Charlton said in a statement on behalf of the Yagara Magandjin Aboriginal Corporation (YMAC). "It was a complete shock when the Premier came out with his stadium plans ... I thought the park was safe. Now the government wants to destroy it. We are very concerned there are ancient trees, artefacts and very important eco-systems existing there. There may be ancestral remains. "We stand resolute in our responsibility to protect it." No one at the organising committee for the Games, or the Office for the Deputy Premier of Queensland Jarrod Bleijie, who is responsible for Olympic construction, was immediately available for comment. After years of political wrangling, Queensland Premier David Crisafulli announced in March that a 63,000-seat stadium would be constructed and Victoria Park's Centenary Pool rebuilt to provide a 25,000-seat aquatics centre for the Olympics. In June, Crisafulli's government enacted legislation to exempt the Olympic building projects from normal planning rules. The Save Victoria Park campaign, which released a shared statement with YMAC on Tuesday, said June's legislation was "unprecedented" and overrode existing acts of parliament on environmental protection and First Nations rights. "And as we face this profound and irreversible loss of cultural heritage and human rights, Olympic organisers continue to promote 2032 as being the first Games with a Reconciliation Action Plan. Organising committee President Andrew Liveris told Reuters last month that anyone who objected to the development would be heard, but that June's legislation was essential to keep the project on track to deliver the venues before 2032.

Albanese criticises ‘dry gully' of culture wars as he promises more funding to close Indigenous gap
Anthony Albanese says investing in closing the Aboriginal and Torres Strait Islander disadvantage gap is more useful than the 'dry gully' of culture wars. The prime minister will use a major speech to the Garma festival in north-east Arnhem Land on Saturday to promise delivery of the economic sovereignty fundamental to self-determination for First Nations communities, including through $75m in new funding to help native title holders secure better deals and faster project approvals. Ahead of the second anniversary later this year of the defeat of the voice to parliament referendum, Albanese will also announce mobile Tafe programs and a new economic partnership with leading Indigenous organisations. High-profile jockey Noel Callow is under investigation after a video surfaced online in which he filmed himself racially abusing Aboriginal people. Queensland Racing Integrity Commission officials confirmed they are reviewing the footage, which was reportedly filmed in Darwin last year. 'A video was recently brought to the attention of the Commission,' a QRIC spokesperson told Racenet. 'It is presently the subject of an investigation.' Callow, 50, is a veteran rider with 1,632 career wins, having won jockeys premierships from Melbourne to Singapore, but has a number of controversial moments in his past. In June he was suspended for three months in Queensland after a post-race jockeys room brawl with a rival hoop. The video shows Callow strike up a conversation with an Aboriginal man he was passing on the street, offering him some pizza before the seemingly friendly conversation turned offensive. 'What's doing crackers,' Callow says, before asking, 'Have you showered? F*** you stink like f***.' The man responds, 'Nah, I haven't got a job [inaudible].' 'You stink like f***. Have some pizza. Take the pizza. Eat. Eat the pizza,' Callow continues. 'I don't want to eat,' the man remonstrated. 'Have a shower then, do me a favour. Have a shower. You stink like f***,' Callow said. 'I sleep on the street,' the man replied. 'So you don't want a pizza … what do you want?' Callow asked. 'I want a beer,' the man replied. 'You want a beer … if you have a shower, I'll buy you a beer,' Callow offered. 'There's no shower in the friggin area,' the man said. 'Well jump in the f***ing creek … for f*** sake man,' Callow responds. Callow then tries to guess the man's name, calling him 'Yothu Yindi' - an indigenous music group - and singing their hit song Treaty. The man replies, 'What's wrong with you?' before the clip ends with Callow saying, 'Good to have you on the show, man.' A second clip, filmed during the day, also contained offensive remarks. It begins with Callow riding a bicycle behind a group of Aboriginal people who are blocking his way on a footpath. 'Look at these co**s,' he says towards nearby pedestrians. After a pedestrian warns him, 'Watch out where you're riding your bike,' Callow responds aggressively. 'Stop walking on the f***ing footpath, you f***ing co**s,' he says. Riding away, the then says 'Get up the co**s.' Both clips have since circulated widely after initially being shared privately. Callow is currently in Darwin preparing to ride Bear Story in Monday's $200,000 Darwin Cup. He finished third on the horse in last year's race. The veteran jockey, who says he has recently given up alcohol to sustain the final stages of his career, is the son of a jockey and is the father to Toowoomba-based apprentice hoop Stacey Callow.
