
Eastern Cape health department is breaking the law in the way it runs Dora Nginza Hospital
In a damning and scathing report the Public Protector has found that the Eastern Cape Department of Health is breaking a handful of laws and regulations in its management of the Dora Nginza Hospital.
The Eastern Cape Department of Health has been called out for breaking several of the country's health laws and regulations and violating the Constitution in the way it runs Dora Nginza Hospital in Zwide, Gqeberha. This follows an earlier, unannounced visit to the hospital by the Public Protector, Advocate Kholeka Gcaleka.
While the right of access to health is enshrined in the Constitution, government departments are allowed to claim they do not have the budget to implement all measures immediately. However, the Public Protector found that the department failed to use funds allocated for essential equipment.
It is well-known to hospital staff that prior to an inspection, an 'advance team' is usually sent to state hospitals in the province to make sure they are clean, equipment is working and overcrowding is under control, but this time Gcaleka did not inform the department's head office in Bhisho of her visit.
During the visit in 2024, the Public Protector identified numerous operational shortcomings. These included an insufficient number of security personnel on site and a defective closed-circuit television system. In addition, security protocols for maternity wards – including ID verification and visitor passes – were not properly implemented.
Damning report
Although the Public Protector visited the hospital in 2024, her report was released just days after two newborns were stolen from Dora Nginza Hospital's maternity ward in May. A 26-year-old woman, Sinovuyo Rabula, appeared in court on Friday, 30 May. Her bail application was postponed to 6 June.
Key findings from the Public Protector's investigation include:
A critical shortage of staff is negatively affecting healthcare delivery. The hospital is still operating on a 2016 organogram, which has become obsolete, especially considering the additional tertiary services it now provides.
The centralised recruitment process at the provincial Department of Health office significantly delays the hiring of both clinical and non-clinical staff.
The maternity ward is overcrowded, with some women who have given birth forced to wait on chairs for available beds – a situation that increases their risk of infection and other complications; and
There is no privacy during patient consultations.
Daily Maverick has been highlighting the crisis in state hospitals in Nelson Mandela Bay for years, including warnings about the unprecedented scale of resignations of doctors from these facilities.
The Public Protector echoed what health leaders and civil society groups have been saying for the past 15 years: the absence of a district hospital in the Nelson Mandela Bay District has placed immense strain on Dora Nginza Hospital. The facility is forced to serve simultaneously as a clinic, district hospital, regional hospital and tertiary centre – particularly for obstetrics, gynaecology and paediatrics.
The neglect of this key hospital in Nelson Mandela Bay — which provides specialist services to the entire western region of the province — was further underscored in the latest health statistics published in the District Health Barometer in April.
Nelson Mandela Bay was identified as one of the worst-performing districts in the country, recording the second-highest number of maternal deaths (35) in the province – an increase of seven from the previous year. The statistics also show that both neonatal and early neonatal death rates at health facilities in the metro have risen year on year, placing the district among the country's poorest performers in this category as well.
The report further highlighted the shortage of medical equipment such as blood pressure machines, haemoglobin machines, cardiotocography machines, Dinamaps (patient monitors) in the postnatal ward and infant warmers.
Investigators found that the department failed to spend the allocated budget for equipment.
'The low level of spending while there is a shortage of critical medical equipment suggests that there is a serious structural problem in the Eastern Cape Department of Health, which renders the provision of basic healthcare services less reliable or not delivered in a progressive and effective manner as contemplated in the Constitution and the law,' Gcaleka said.
She ordered national Minister of Health, Dr Aaron Motsoaledi, to 'take cognisance of the report and ensure that the remedial action is implemented'.
Eastern Cape Premier Oscar Mabuyane was also instructed to 'ensure executive oversight so that the remedial action by the Public Protector is implemented',
The head of the Eastern Cape Department of Health, Dr Rolene Wagner, was ordered to submit a detailed plan – with timelines – to address critical issues. These include:
Improving hospital security;
Implementing a plan within four months to convert Empilweni TB Hospital into a district hospital;
Addressing severe staff shortages (medical and non-clinical);
Relocating Dora Nginza's kitchen and laundry;
Finalising recruitment for non-clinical vacancies;
Procuring new trolleys and specialised cooking equipment and disposing of the defective ones; and
Completing and submitting a finalised organogram
At the time of the Public Protector's visit in 2024, Wagner was not in control of the department as she had been moved to the Office of the Premier in October 2023 to form part of his 'crack' team to solve the pressing problems in the province. She only returned to her job in August 2024.
Other findings included that the province's health department was not delivering healthcare services in a 'progressive and effective manner' as contemplated by the Constitution; that treatment of patients, especially of pregnant women, at the hospital 'may be a violation of the national health regulations, which places an obligation on the functionaries of the hospital to maintain an environment which minimises the risk of disease outbreaks, the transmission of infection to other users, healthcare personnel and visitors.'
The ongoing shortage of midwives and delays in filling vacant posts since 2017 – along with a lack of nurses in the postnatal ward to manage patient overflow during peak periods – continues to place a heavy burden on the hospital's limited staff and their mental wellbeing, the report noted.
'The delay in implementing intervention measures such as the establishment of a level 1 maternity service at [the] Port Elizabeth provincial hospital, which should have been done in March 2023, and the conversion of Empilweni Tuberculosis Hospital to a district hospital which would also offer level 1 maternity services has negatively impacted the delivery of antenatal and postnatal services at the hospital,' it said.
Investigators also found that the outdated 2016 organogram had led to severe staff shortages in key departments, including the kitchen, laundry, theatres, maintenance, surgical units and casualty wards.
Other findings include that 30 cardiotocography machines that were ordered in January 2023 had not been delivered. Only one infant warmer was working during the inspection.
'Despite regulation 13(1) of the National Health Act (NHA), placing an obligation on the hospital to ensure that the medical equipment is available and functional in compliance with the law, the functionaries of the facility and the head of Department for Health in the Eastern Cape have failed to ensure that the hospital has essential equipment in all clinical service areas,' Gcaleka said in her report.
'The undue delay in the procurement of medical equipment has [the] potential of endangering and compromising the lives of people who depend on the hospital for healthcare. The responsibility of ensuring that timeous procurement of adequate medical equipment is delivered to the hospital is the responsibility of the department to safeguard the health and safety of all workers and patients,' the report said.
The hospital reportedly has only two washing machines, one of which was broken — meaning that its laundry had to be done at Livingstone Hospital.
'This is not sustainable,' the report said, adding that the issue should be speedily resolved to 'mitigate the risk of patients contracting infections and address the serious impact on the operations of the hospital. This negatively affected the availability of linen for the wards, to the extent that the linen provided to the patients was not properly cleaned.'
Investigators also flagged long-standing issues with the kitchen at the hospital.
These were highlighted two years ago by civil society groups in Nelson Mandela Bay.
'The equipment in the kitchen is dilapidated and very old, has surpassed its life expectancy; [it] constantly breaks down and should be replaced. The breakdown of pots is also caused by the lack of trained staff to operate the pots and over utilisation of the pots which have reached their life span.'
The pots, which cost R500,000 each, should have been replaced but Gcaleka said the budget was not used. She added that new pots 'could have been procured to replace the old pots that have reached their life span'.
'The Government Immovable Assets Management Act (GIAMA) provides for the management of an immovable asset that is held or used by a national or provincial department and to ensure the coordination of the use of an immovable asset with the service delivery objectives of a national or provincial department.
'The progressive realisation contemplated by the constitution can only be understood to mean that, no matter what level of resources the department might have at its disposal, it must take immediate steps within its means towards the fulfilment of the right of access to health services, by availing resources to address the challenges relating to the shortages of medical equipment, clinical and non-clinical staff which impacts negatively on the delivery of health care services in a progressive and effective manner. The conduct of the department in not addressing these challenges is inconsistent with the Constitution,' the report added.
While the Eastern Cape Department of Health has not yet commented on the Public Protector's report, provincial health minister Ntandokazi Capa's spokesperson, Sizwe Kupelo, said earlier in May that R143-million had been earmarked to improve services at Nelson Mandela Bay's two largest hospitals, Livingstone and Dora Nginza. He confirmed last week that 10 new doctors and a number of nurses had been appointed at Dora Nginza Hospital. DM

Electronic death registration is a win-win for SA — let's make it happen
Several studies have flagged problems with South Africa's death registration processes. To address it, a critical first step is to replace our paper-based process with an electronic one. A recent report by the South African Medical Research Council (SAMRC) highlights the underreporting of HIV in official mortality statistics. Official cause of death statistics are based on what doctors write on death notification forms. As part of the process of death registration, medical practitioners are required by law to provide information about the medical conditions resulting in each death. Multiple studies have identified concerns about the quality of the information provided by doctors and the Department of Health has been urged in a policy brief to address them as it clearly undermines the quality of data used by our government for health planning and resource allocation. The recently reported study found extensive underreporting of HIV as a cause of death. Only 28% of deaths that occurred in a national sample of public sector hospitals where the medical record had clear clinical indications of HIV, had HIV specified on their death notification form. Aside from ensuring that medical certification of the cause of death is part of the medical training curriculum, and that additional training is provided during internship periods, another key issue to address is that many doctors are reluctant to record HIV/Aids as a cause of death due to concerns about maintaining patient confidentiality. In 2014, a self-sealing section was added to protect information about cause of death on the death notification form, but this has clearly not had the desired effect. Following the deaths of at least 22 children from contaminated food in 2024, President Cyril Ramaphosa announced that the Department of Health would develop an electronic system for recording causes of death as one of several responses to the emergency. The move to an electronic system offers a strategic opportunity to address the challenge around confidentiality and promises a lot more. It allows for secure, institution-based data management that protects confidentiality, encourages accurate reporting and strengthens the integrity of vital statistics. Benefits of this digital transition will include: Improved data quality and confidentiality, encouraging accurate reporting of sensitive conditions like HIV/Aids; Automated validation checks, reducing certification errors at the point of data entry; Real-time access to mortality data, enabling rapid public health responses; and A platform for quality assurance and feedback, currently not possible in the paper-based system. Ultimately, moving away from a paper-based process of death registration will reduce the administrative burden and improve efficiency across the system. This presents a timely and valuable opportunity to collaborate across departments, including health, home affairs and Statistics South Africa, to modernise the country's civil registration and vital statistics system. We are at a pivotal moment for such coordinated policy action. Investing in a robust electronic system for cause-of-death certification will strengthen South Africa's public health planning, improve disease surveillance and increase accountability. The long-term returns – through faster, more reliable data – are substantial for both governance and health outcomes. It is a win-win. Pride Month in South Africa: the gap between legal rights and lived realities

On paper, South Africa boasts one of the most progressive constitutions in the world — a beacon of equality, dignity, and protection for all, regardless of sexual orientation or gender identity. But for many in the LGBTQIA+ community, especially those living on the margins, that promise remains unfulfilled. Legal protections offer hope, but discrimination persists, violence goes unchecked, and many queer South Africans still live in fear, forced to justify their existence in a society that too often refuse to see them. For organisations like Ilitha Labantu, Pride Month is not just about rainbow flags and celebration — it is a solemn call to affirm the rights, dignity, and safety of LGBTQIA+ persons. Siya Monakali of Ilitha Labantu said: 'The LGBTQIA+ community is not a homogenous group. Our experiences are shaped by race, class, gender, and geography — and too often, those at the intersection of these identities bear the brunt of exclusion and violence.' Monakali explained that while the Constitution offers strong protections, systemic discrimination persists — particularly against Black lesbian women, transgender individuals, and those living in poverty. This is a reality Taswald Ruiters, a transgender woman based in Cape Town, has experienced first hand. 'There is no question that the Constitution is set to protect the transgender community,' Ruiters said. 'It makes us feel seen and heard. However, there is still work that needs to be done.'Despite legal protections, economic exclusion remains widespread. 'Our brothers and sisters are jobless. The Constitution says no person should be discriminated against based on sexual orientation or gender identity — but that's just not enough. The public sees you as different, and that is not what the workforce wants.' She recalled an incident in which she was discriminated against for using a female restroom in a government building. 'The facility had no specific protections in place for transgender persons. When I reported it, the response I received from authorities was that they would look into it and update the regulations in due time. These are not future issues — they are happening now. 'It felt impossible at first, like it was too late in my life — but I regret nothing,' she said. After five years on hormone replacement therapy, she saw improvements — but recent funding cuts have limited access. 'The medications we need to aid in our transition are no longer being provided. The influence of other countries has unfortunately diminished the efforts we've made towards inclusivity.' She reflected on how the gap between law and lived experience affects dignity. 'This country has come far. It sometimes feels like a privilege just to be able to practice your basic human rights. But why should we be made to feel privileged when, for the rest of society, it's just life as normal? 'I cannot blame anyone for their ignorance if they've never been educated about what a transgender person is, or how the Constitution protects us. But people must know — every action gets a reaction. Treat others the way you want to be treated.' She called for inclusive LGBTQIA+ education in high schools. 'We have progressive young people. Education would help promote inclusivity and allow them to make positive changes in their homes and communities,' she said. As a parent to a five-year-old, she said that primary school learners may not yet be ready for conversations about gender identity — but respect can and should be taught early. Globally, increasing anti-trans rhetoric — especially in the United States — casts a shadow. Former President Donald Trump has pledged to ban gender-affirming healthcare and restrict transgender participation in sport if re-elected, a stance that emboldened right-wing movements worldwide. South African advocates warn these ideas, spread online and through media, risk reversing hard-won progress. Luiz De Barros, founder and editor of — South Africa's largest LGBTQIA+ news platform noted even the most advanced legal systems can fall short. 'Although South Africa's Constitution and legal framework offer strong protections for LGBTQ+ people, these rights often do not translate into lived realities. Discrimination, stigma, and violence remain persistent challenges in our communities,' said De Barros. 'Although the Hate Crimes Act was passed in 2023, it has yet to be fully implemented. SAPS continues to struggle with providing appropriate and sensitive services to LGBTQ+ survivors.'On transgender exclusion in sports, De Barros challenged the idea of unfair advantage. 'The notion of an 'unfair physical advantage' as grounds to exclude transgender athletes is often based on misinformation, sensationalism, and a lack of scientific understanding… If trans women had a consistent competitive advantage, we would expect to see them dominating podiums and breaking records regularly but this is not the case.' 'All individuals, including transgender and intersex athletes, deserve the right to participate in sports,' he added. 'We must work together across sectors — sports, science, and civil society — to develop equitable, inclusive, and evidence-based policies that uphold the dignity and rights of all athletes.' Eastern Cape teacher accused of beating learner with a hosepipe
The Eastern Cape Department of Education has issued a stern warning to teachers against using corporal punishment to discipline learners. This comes as a teacher from Zamokuhle Junior Secondary School in Matatiele is due back in court later this month, accused of beating a 12-year-old learner with a hosepipe. The learner's mother, who asked that we not name her or her son, told GroundUp that her child returned from school with dark bruises on his buttocks on 19 May. According to the learner, on the day of the incident, he and three other learners were washing their dishes after lunch, after the bell had rung for them to return to classes. He said a male teacher approached them and instructed them to follow him to the staff room to 'punish them' for being late to class. 'He took the hosepipe and hit my classmate three times on his hand. The second classmate was beaten three times on the bum. The third classmate was also beaten on bums seven times,' said the learner. 'I stopped counting at eight while he was beating me. I started feeling numb, I didn't cry anymore,' he said. The learner said he returned to class and was in pain for the rest of the day. 'I wanted to go home but I didn't want to get in trouble again. The pain was unbearable, I was crying but trying to be strong at the same time,' he said. His mother said she went to the school to report the matter, but she was snubbed by the other teachers. She then decided to open a case at the police station. The teacher has since apologised. 'To be honest I now feel sorry for him, I don't want him to lose his job,' said the mother. When GroundUp contacted the school for comment, we were told by the person who answered the call that the teacher had resigned. National Prosecuting Authority (NPA) spokesperson Luxolo Tyali said the teacher faces charges relating to corporal punishment at the Maluti Magistrates Court. His next court appearance will be on 25 June. Eastern Cape Department of Education spokesperson Vuyiseka Mboxela warned that corporal punishment is against the Constitution and the department's policies. She said she had asked the school for more details. Equal Education Law Centre Attorney Ebrahiem Daniels said though it is illegal, corporal punishment continues in schools. He said the organisation gets reports of corporal punishment from across the country. Daniels said there is a lack of training and support for teachers about other forms of discipline. 'Without the tools to manage classrooms constructively, some teachers continue to resort to physical punishment. Research consistently shows that corporal punishment is not only ineffective but also harmful. 'It is linked to increased aggression, anti-social behaviour, and long-term emotional harm.
