Russell Simmons sues HBO for $20 million over doc alleging sexual misconduct

NEW YORK — Russell Simmons has filed a lawsuit against HBO and the makers of the 2020 documentary 'On the Record,' claiming defamation for their allegations of sexual assault and misconduct. The record executive, who's seeking $20 million in damages, is also accusing them of ignoring or suppressing evidence from witnesses who 'refuted and rebutted the accusations falsely made' against Simmons, according to lawsuit filed in New York. 'Despite voluminous support for Mr. Simmons in the form of credible information, persuasive evidence, witness statements and calls for further investigation by notable members of the media, politics and the civil rights movement, the defendants simply disregarded it, and released, and continue to re-release globally, a film that tremendously disparaged and damaged Mr. Simmons with salacious and defamatory accusations that he vehemently denies,' his attorneys, Imran Ansari and Carla DiMare, said in a written statement to Variety. In the complaint, Ansari claims the streamer ignored multiple polygraph tests that 'would have been discovered with due diligence and adherence to accepted journalistic standards.' The documentary made its debut at the Sundance Film Festival in January of 2020 and detailed sexual assault and misconduct allegations against the Def Jam Records founder from multiple women. The project was originally to be produced as a part of Oprah Winfrey's deal with Apple TV, but the media mogul later withdrew from the film and it ultimately landed at HBO Max. Along with the $20 million, Simmons is requesting a court order to have the title removed from all of HBO's platforms. Simmons has faced multiple lawsuits accusing him of misconduct. More than 20 women have come forward alleging sexual assault, many of whom participated in the documentary. A spokesperson for Warner Bros., the parent of HBO, told TMZ the company 'stand[s] by the filmmakers and their process, and will vigorously defend ourselves against these unfounded allegations.'

"I always had a very strong sense of how much it mattered to him to be... in the house and there," she said in a 2015 interview for the HBO documentary "Becoming Warren Buffett." "He was at the dinner table every night. Very present at the dinner table." It wasn't the typical hands-on, TV-dad kind of parenting. "He wasn't the dad out in the backyard throwing the football," she added. "And he wasn't really the dad, you know, sitting in the bedroom at night reading the stories with us." Buffett, known for being one of the busiest minds in finance, still made time to rock Susie to sleep and sing "Over the Rainbow"—a memory she holds especially close. "I have this insanely sentimental attachment to that song," she said, recalling how he even made a karaoke recording of it as a gift. While he may have been immersed in reading or mentally juggling investments, he wasn't off on business trips or inaccessible. "A lot of my friends had dads that traveled a lot. My dad was in the house and there," she said. "I never felt like... he wouldn't have time for us. That didn't happen." Susie recalled moments that were both simple and deeply thoughtful. "I remember one day coming home from school and there was a big box on the dining room table and there was a new dress in it and there was a Slo Poke sucker. "He was always there whenever we needed him, 'cause he was physically present." A new documentary, It's Never Over: Jeff Buckley, which examines the life of the late singer-songwriter, will open in movie theaters on Aug. 8. An HBO premiere will follow this winter. The film, by director Amy Berg (Phoenix Rising, West of Memphis), features never-before-seen footage from Buckley's archives. His mother, Mary Culbert, and former partners Rebecca Moore and Joan Wasser gave new interviews for the picture. It also includes commentary from Buckley's former bandmates, Michael Tighe and Parker Kindred, as well as singer-songwriters Ben Harper and Aimee Mann. The film looks at how he followed in the footsteps of his father, singer-songwriter Tim Buckley — who died at age 28 when Jeff was 8 — and launched his own music career, signing to Columbia Records. A concert recording, Live at Sin-é, came out in 1993, and Buckley's sole studio album, Grace, came out in August 1994, three years before his death at age 30. His own legacy has grown ever since. When the film premiered at Sundance in January, Rolling Stone wrote that the picture 'does justice to [Buckley's] legacy.' 'Buckley's mother, Mary Guibert, has been extremely protective over her son and his songs, but she's opened up the vaults for Berg's film,' the review said. 'There are pictures of Buckley as a chubby, smiling baby, and rocking a metalhead shag mullet as a teen; clips of him playing in high school bands, glimpses into notebooks filled with an elegant scrawl that you can only describe as Buckleyesque. Music from every phase of his career, in both rough-demo and finished form, plays over the soundtrack, along with voicemail messages — including the last one he left his mom — and recording session banter.
