SC drops bail cancellation proceedings against Senthil Balaji after he resigns as TN ministe
New Delhi: The Supreme Court on Monday disposed of an application seeking recall of its decision which had enlarged DMK leader and former Tamil Nadu minister Senthil Balaji on bail in connection with a money laundering case linked to an alleged cash-for-jobs scam.
A Raj Bhavan communique accepting the resignation of Balaji, who was Minister for Electricity, Prohibition and Excise in Tamil Nadu government, was placed before a bench of Justices Abhay S. Oka and A.G. Masih.
The Justice Oka-led Bench on April 23 told the senior DMK leader to choose between his ministerial post and bail in the money laundering case, as it dealt with an application claiming that Balaji may influence the case witnesses in his capacity as a minister.
It had cautioned Balaji that if he did not step down from his minister post, it would recall its bail order, noting that the top court had made a mistake by ignoring the previous judgments against him.
"We are giving him a choice. Freedom or post? [T]he judgment of the Madras High Court records how, as a minister, you tried to influence witnesses by entering into a settlement with them, based on which proceedings were quashed," the bench had said.
The Supreme Court had asked Balaji, who was immediately inducted into the Tamil Nadu Cabinet after he was granted bail, to decide by April 28 whether he preferred his liberty or his minister post.
Following the top court's ultimatum, Chief Minister M.K. Stalin on Sunday recommended the Governor to accept the resignation of Balaji and to reallocate his portfolios to other ministers.
"The Hon'ble Chief Minister of Tamil Nadu has recommended to the Governor of Tamil Nadu to accept the resignation of V. Senthil Balaji, Minister for Electricity, Prohibition and Excise, and Dr K. Ponmudy, Minister for Forests and Khadi. The Governor has approved the recommendation," read a Raj Bhavan communique issued.
It added that Transport Minister S.S. Sivasankar has been given the additional portfolio of Electricity, while Housing and Urban Development Minister S. Muthusamy has now been designated as the Minister for Housing and Prohibition & Excise.
The Enforcement Directorate (ED) had, on June 14, 2023, raided Balaji's house and other places in Chennai, Karur, and Coimbatore and interrogated him about a job for a cash scam while he served as the Transport Minister in the AIADMK-led government. After several hours of interrogation, Balaji was arrested and sent to judicial custody. Even as the opposition demanded the immediate removal of Balaji from the ministry, CM Stalin did not succumb to the pressure. However, Balaji finally tendered his resignation on February 12, 2024, eight months after his arrest and ahead of his bail plea hearing in the Madras High Court. After the Supreme Court granted him bail, Balaji walked out of Puzhal Central Prison after 450 days and was inducted again as minister on September 29 last year.

The project, approved by the bench of Justice Bela M Trivedi and Justice SC Sharma, enables the state to utilise temple funds to acquire about 5 acres of land near the shrine. Calls for redevelopment intensified after a stampede-like incident took place during the Janmashtami celebrations in 2022, which resulted in two fatalities. In Sept 2023, Allahabad high court directed the state govt to implement a corridor plan to manage crowds and ensure safety. Although the state said it engaged with all stakeholders, Shebaits and local residents have claimed they were excluded from discussions. On Monday, Agra's divisional commissioner Shailendra Kumar Singh, Mathura DM Chandra Prakesh Singh, Agra range DIG Shailesh Kumar Pandey and additional officials held a meeting with the stakeholders to seek a resolution. Shailendra Kumar Singh said, "The proposed corridor has been cleared by the SC. The locals have raised some issues, and we have reached out to them. In the issues related to the temple, we ensured that no change will be there to the customs and traditions of the temple. Shopkeepers had doubts related to compensation, and we cleared them. The streets in and around the temple are narrow and unsuitable for the influx of people who visit the temple daily, so this corridor will be beneficial for all the stakeholders. "

Mother's whereabouts ‘unknown' after detention by Assam police, son knocks on Supreme Court door
Monowara Bewa, whose son's Habeas Corpus petition the Supreme Court has agreed to hear next week, lives in Khagrabari village in Dhubri district with her family and is among several people who the Assam police have detained since May 23 in a crackdown against people declared foreigners by the state's Foreigners' Tribunals. Her son, 26-year-old Iunuch (Yunus) Ali, has alleged that she has been picked up for deportation, and her whereabouts since then are not known. Bewa was declared a foreigner by an FT in 2016 and placed in detention in Assam's Kokrajhar. She was released on bail in 2019 following the Supreme Court's directions to this effect for those who had completed three years in detention. The Gauhati High Court had upheld the FT order in 2017, and the family approached the Supreme Court through a Special Leave Petition the same year. While the Supreme Court has agreed to hear her son's petition, back in Dhubri, her family remains in the dark about her whereabouts since she was detained on May 24. 'That day, she got a call from the Gauripur police station asking her to report with her documents. Since she goes every month because of her bail conditions, we thought they needed her for something related to that. She and her son went around 5 pm. They were made to wait there until late at night, when a senior official came to take her away, saying he was following instructions from higher authorities. The next day, we went to the office of the border police SP in Dhubri, but the in-charge there said he did not know anything. It has been eight days, and we still don't know where she is,' said her nephew, Maminur Hussain (37). Bewa's neighbour, Jahanara Hussain (55), who is also a local women's leader who has been helping the family with the case, said that on Sunday, she received the link to a Facebook video that purportedly showed Bewa in Bangladesh alongside four others. 'It was circulated among people in the area on Sunday night. It is her in the video, but we still do not have any idea where she could be right now,' she said.
