Ex-Sabah minister fails to secure retrial of forgery case
PUTRAJAYA : Convicted former Sabah minister Peter Anthony today failed in his bid to secure a retrial of his forgery charge after the Court of Appeal dismissed his application for a review, filed on March 14.
Justice Azman Abdullah, chairing a three-judge panel, said there was no failure of justice regarding a police report lodged by prosecution witness Shukur Din, which was argued extensively in the final appeal last year.
'(Peter) was given the right to be heard. The application for review is rejected.
'The previous appeal bench's failure to include (Shukur's police report as fresh evidence) in its broad grounds does not amount to a failure of justice,' he said.
Also on the panel hearing the review application were Justices Noorin Badarudin and Hayatul Akmal Abdul Aziz.
On March 4, a Court of Appeal panel comprising Justices Ahmad Zaidi Ibrahim, Zaini Mazlan and Azmi Ariffin delivered its broad oral grounds of judgment on Peter's appeal.
The full judgment, written by Zaini and made available to parties early this week, explained why the fresh evidence did not help to exonerate Peter.
Shukur had alleged that a Malaysian Anti-Corruption Commission investigating officer concocted the last paragraph of his police report to implicate Peter in using Universiti Malaysia Sabah (UMS) to mislead then prime minister Najib Razak into securing a contract.
Peter contended that Shukur's police report on Aug 9, 2018 exonerated him. He said the non-disclosure of the evidence at trial had prejudiced him.
The former state minister in the Warisan-led Sabah government between 2018 and 2020 contended that he was deprived of the right to a fair trial by not being able to cross-examine Shukur on the report.
The Court of Appeal last year granted Peter's application to admit Shukur's police report as additional evidence, noting that he had only come across it through a friend.
The former Parti Kesejahteraan Demokratik Masyarakat president's review application had sought to set aside the Court of Appeal's final ruling convicting him of the offence, and for the ordering of a retrial.
Earlier today, lawyer Haniff Khatri Abdulla, appearing for Peter, told the court that the 16-page broad grounds made no reference to the fresh evidence admitted.
'It was only stated in the 24-page judgment, which amounts to an afterthought,' said Haniff, who was assisted by lawyer Rosal Azimin Ahmad.
Deputy public prosecutor Wan Shaharuddin Wan Ladin responded that Peter had failed to meet the legal threshold for a review, adding that the fresh evidence was already thoroughly examined during the appeal.
'There is no breach or miscarriage of justice to allow the application,' said Wan Shaharuddin, who was assisted by deputy public prosecutor Haresh Prakash Somiah.
Peter was sentenced to three years' jail and fined RM50,000 by the sessions court in Kuala Lumpur in 2022. He has paid the fine and is currently serving his sentence.
The former Melalap assemblyman was convicted of falsifying documents related to a maintenance and service contract at UMS 11 years ago.
He was charged in his capacity as managing director of Syarikat Asli Jati Sdn Bhd with forging a letter from the office of the UMS deputy vice-chancellor, dated June 9, 2014, by inserting a false statement to use it for fraudulent purposes.

(Bernama pic) PETALING JAYA : Charges against the five teenage girls for allegedly verbally bullying Form 1 student Zara Qairina Mahathir may be amended if new evidence emerges, home minister Saifuddin Nasution Ismail said today. He said it was not unusual for charges to be amended during the course of proceedings. 'Of course, the charges can be amended. It's a normal part of the legal process. Sometimes the accused is initially charged under Section 302 of the Penal Code (for murder), which is later reduced to Section 304 (for culpable homicide not amounting to murder). 'That's how the process works,' he said when winding up the debate on the 13th Malaysia Plan in the Dewan Rakyat for his ministry. He was responding to a question from Afnan Hamimi Taib Azamudden (PN-Alor Setar) on whether the charges could be revised should new evidence surface during the inquest into Zara's death. Saifuddin said the inquest was intended to establish the cause of Zara's death and that it was not an exercise in finding fault. Earlier today, the five teenagers were charged in the children's court in Kota Kinabalu, Sabah, with verbally abusing Zara, who died last month. They were charged with uttering abusive words against the victim which could have caused her distress. They are accused of committing the offence at Block A-3-6 of SMK Agama Tun Datu Mustapha in Limauan, Papar, between 10pm and 11pm on July 15. Zara was found unconscious at 4am on July 16 after allegedly falling from the third floor of her school's hostel in Papar, Sabah. She died at Queen Elizabeth I Hospital in Kota Kinabalu the following day. Her body was exhumed on Aug 9 to allow for a post-mortem amid allegations of bullying. The Attorney-General's Chambers yesterday defended its decision to charge the five teenagers, clarifying that the charges under Section 507C(1) of the Penal Code related specifically to acts of bullying and were not connected to Zara's death. The AGC also dismissed a suggestion by lawyers representing Zara's family that further investigations or an inquest could later justify a more serious charge under Section 507D(2), saying this was 'speculative and not supported by accurate facts'. The lawyers had urged the AGC to postpone the charges against the five minors.

Saifuddin said the government has approved RM28 million to develop seven additional security posts, including in hotspots in Lubok Antu and Ba'kelalan. Winding up the debate on the 13th Malaysia Plan for his ministry in the Dewan Rakyat today, he said an additional RM64 million had been allocated for 22 projects along the border, covering both physical and non-physical projects involving the police, the immigration department and border agencies. He also said another 390 senior and lower-ranking police officers would be stationed to protect the border. Illegal gambling centres disguised as coffee shops Saifuddin also addressed the increase in illegal gambling operations, often disguised as coffee shops, in Sarawak. He said the authorities carried out 509 raids across Sarawak, resulting in 535 arrests, from January to July. 'We will continue to take action including under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, and the Prevention of Crime Act 1959. 'We also cooperate with the Malaysian Communications and Multimedia Commission and Sarawak Energy Bhd when we cut power and water supply to them. We will review the laws to see if they need to be strengthened. 'We can take down their websites in split seconds, but they can immediately create mirror websites,' he said.

Cops probe upside down Johor flag at Segamat hotel
Segamat police chief Ahmad Zamry Marinsah said a foreign worker who put up the flag immediately corrected his mistake after being alerted by a colleague. (Facebook pic) SEGAMAT : Police have started investigations into a social media post that shows the Johor state flag being flown upside down at a hotel in the Taman Yayasan Commercial Centre here. Segamat police chief Ahmad Zamry Marinsah said a report was lodged yesterday, with initial checks revealing the flag had been put up by two hotel employees in conjunction with the Merdeka month. 'One of them, a foreign worker, had mistakenly hoisted the flag upside down. He corrected his mistake immediately after being alerted by his colleague,' he said in a statement today, adding the worker holds valid documents, including a passport and work permit. The case is being investigated under Section 504 of the Penal Code, Section 14 of the Minor Offences Act 1955 and Section 233 of the Communications and Multimedia Act 1998. Investigation papers will be referred to the state prosecution office, he said.
