Siddaramaiah, who belongs to the backward class Kuruba community, has cemented his position as a tall leader of the Ahinda (acronym for minorities, backward classes and Dalit) voters. Petitioners, poll panel invoke same case to back opposing stands during ongoing SIR debate in SC
New Delhi: Three writ petitions filed from erstwhile Bombay and Delhi in 1994 in the Supreme Court challenging the Electoral Registration Officer 's (ERO) powers to exclude a person's name from the electoral rolls over the question of citizenship are currently the centrepiece argument in the ongoing SIR debate in the apex court. The irony is that both --Election Commission (EC) and the petitioners opposed to SIR -- are citing it as a cornerstone SC order to justify their respective arguments. The Association of Democratic Reforms , in its rejoinder to EC's counter affidavit in the case, has pointed to para 98 in which the EC notes, "The burden to prove citizenship falls on the person who claims the right to be registered in the rolls". "The said stand taken by EC is contrary to this court's judgement in Lal Babu Hussain (1995) 3 SCC 100 where it was held that burden of proof of citizenship would be on those who are registering anew and not on those whose names are already on the electoral rolls," ADR has stated, a point reiterated by Prashant Bhushan on behalf of the petitioners on Wednesday. Live Events RJD MP Manoj Kumar Jha also a petitioner in the case, has echoed the same in his rejoinder to the EC counter affidavit. He has submitted that the June 24, EC notification on SIR 'seeks proof of citizenship from registered voters and the same is against the provisions of the RP Act, 1960 Rules and the judgement of this court in Hussein case'. EC on Lal Babu Hussein EC has also cited the case in its defence pointing out that the SC order of 1995 recognises two distinct categories of electors -- first-timers and those already in a previous electoral roll. EC has held that the SC has 'unequivocally held' that the ERO must satisfy himself on citizenship of a first-time elector and is thus 'fully justified in calling for evidence to establish Indian citizenship before inclusion'. In the second category -- of those already on the rolls -- EC has held that the SC 'judgement acknowledged that although a presumption of procedural compliance may arise from prior inclusion, it is not absolute' and errors found, if any, 'would have to be corrected' -- provided the individual is given 'reasonable opportunity of being heard and the suspicion is based on objective grounds'. It has held that the eligibility conditions in the SIR 'can be examined as upheld by this court in Lal Babu Hussein'. The 1995 case Three writ petitions -- Lal Babu Hussein & Others vs ERO, Husain Dalwai vs Union of India, PUCL vs ERO -- were filed in the Bombay HC challenging the EC's August 21,1992 directive to all district collectors to determine if any person was a foreigner or not -- for preparation and revision of electoral rolls. It was followed by a second directive on September 9, 1994 where EC asked EROs to identify and declare the names of foreign nationals and delete these from electoral rolls. Consequently, notices were issued to 1.67 lakh persons in Greater Bombay to produce one of these: (i) birth certificate (ii) Indian Passport (iii) certificate of citizenship (iv) extracts of entry made in the register of citizenship. A similar situation unfolded in Motia Khan, Paharganj, New Delhi which involved migrants from UP and Bihar-- their documents were rejected by the ERO as they did not fit the EC directions of the time. Quashing EC's two directives in 1995, the SC noted the EC guidelines put 'onus of proof of citizenship' with the person involved, even disregarding the fact that several persons were voters in previous elections. The latter, it pointed out, meant that their cases were already verified by EC before their names were entered in the preceding electoral rolls.
