
The milestone ICJ opinion on climate obligations is not just a verdict from afar, but a compass
The case was initiated by Vanuatu, a Pacific island nation with a population of just 3,00,000. In March 2023, it led a coalition of small island states to secure consensual approval from the United Nations General Assembly to ask the ICJ two questions: What are states legally required to do to address climate change, and what are the consequences if they do not fulfil these duties?
Over 130 countries joined as co-sponsors. India did not join, but it did not oppose it either. This cautious posture reflects India's complex position in global climate diplomacy.
India's hesitation did not stem from disinterest. Rather, it reflected clear-eyed realism. As a developing nation still working to ensure universal access to electricity, healthcare, and employment, India undertakes a difficult balancing act. Unlike industrialised countries, India has not benefited from centuries of fossil fuel-powered growth. Although its total emissions are rising, per capita emissions remain among the lowest globally. Many households still rely on biomass for cooking and face irregular power supply.
Despite these constraints, India has taken ambitious climate actions. By 2030, it aims for half its electricity to come from renewables. Emissions intensity has declined, afforestation has expanded, and electric buses now run in several Indian cities, including Delhi, Mumbai, Bengaluru and Hyderabad. India leads the International Solar Alliance and the Mission LiFE campaign promoting sustainable consumption. During its G20 presidency, it ensured that climate finance remained in the global spotlight.
These are not peripheral gestures. They are structural shifts. By any fair measure, India has done more with less. By contrast, Canada emits seven times more per capita and continues to expand its oil sands production. Australia, a major coal exporter, sets modest domestic targets while profiting from global emissions. Considering historical responsibility, economic capacity, and present-day ambition, India's efforts stand out.
Yet, the sweeping ICJ opinion, though not legally binding, will have consequences for India. It draws not only on climate treaties but also on the United Nations Charter, customary international law, the law of the sea, and human rights law. The Court affirms that states have obligations to prevent environmental harm, reduce emissions, adapt to climate impacts, and cooperate internationally. These duties are no longer moral appeals. They carry legal weight.
The Court also ruled that climate change violates rights to life, health, and housing. States must act based on the best available science, adopt ambitious national plans, and may be legally compelled to strengthen them. Failure to act could invite claims for climate damage. Subsidies for polluting fuels are now within legal scrutiny. The opinion does not just outline obligations, it opens the door to legal consequences.
For communities that have long suffered without recourse, this is a potential game changer. It affirms the principle of common but differentiated responsibilities. India has long argued that those who contributed most to climate change must do more to address it. The ICJ has now given that argument legal grounding. It will bolster developing countries in global negotiations.
Yet, the new legal terrain raises at least three public policy challenges for India.
First is legal preparedness. Indian courts already interpret the right to a healthy environment as part of the right to life. The ICJ ruling may spur a wave of litigation demanding stronger climate action or even compensation. The Indian state could also face lawsuits from within or from affected neighbouring island states. Anticipating such claims will be vital for legal and policy stability. Otherwise, a torrent of litigation could emerge without clear legal standards.
Second is enforcement. India's environmental laws are strong on paper but patchy in practice. Pollution control agencies remain underfunded and compliance varies widely across different states and sectors. The ICJ has reinforced the importance of due diligence. Strengthening regulatory capacity must now become a national priority.
Third is the issue of fossil fuel subsidies. These remain crucial for economically vulnerable households, especially for cooking gas and kerosene. But they also delay the shift to cleaner alternatives. The ICJ opinion, including the separate declaration appended by Judge Dalveer Bhandari of India, makes clear that subsidies have legal as well as fiscal implications. India must rethink how it provides support to the poor without locking them into polluting fuels. That will demand both financial resources and policy innovation.
The diplomatic challenge lies in aligning climate ambition with fairness. India must continue taking climate action while defending the context of its development needs. Climate justice must not become a new form of injustice.
The milestone ICJ opinion is not just a verdict from afar, but a compass. It signals the end of voluntary climate ambition and invites all countries to chart a harder, but fairer course. For India, the challenge now is to align duty with dignity and ambition with justice.

Wrote to parties to push for bill on statehood restoration in Parl: Omar
As demand for restoration of statehood has gained momentum, chief minister Omar Abdullah said he has written to several parties with a sizeable presence in Parliament, seeking their support for the introduction of a Bill for the restoration of statehood in Jammu and Kashmir in the ongoing Monsoon session. (File) J&K CM had written to 40 MPs, including the Congress president Malikarjun Kharge, and other prominent Lok Sabha members urging them to raise the issue of J&K's statehood in the Parliament. 'I have written a letter to all those parties who have a good number of MPs in Parliament and requested them to help on the promise made to J&K on statehood and raise the issue in Parliament so that a Bill is brought in this session itself and J&K gets its statehood back,' Omar told reporters in Srinagar. 'The act of reducing J&K from a state to a Union territory in 2019 and the prolonged delay in restoring its status as a full state... has profound implications for the future of Indian polity,' the three-page letter stated. The CM said the reorganisation of J&K into a UT in August 2019 was presented as a 'temporary and transitional measure' and cited repeated public assurances from Prime Minister Narendra Modi. On the Supreme Court likely to hear a plea for the restoration of statehood on August 8, Omar said the restoration should come through the court if the government does not do it. 'It is a good thing and I hope the Supreme Court keeps in mind is that when they gave a judgement on the August 5 case (in December 2023), they had said that the statehood should be restored as soon as possible. Now, many years have passed but we have not got it yet,' he said. The CM also highlighted the 'remarkable and enthusiastic participation' of the people of J&K in last year's assembly elections and said that they turned up in record numbers and demonstrated an unshaken faith in our constitutional processes and democratic institutions. In a 'respectful acknowledgement' of this, his government's first act was to pass a unanimous resolution calling for the immediate restoration of statehood. He said had the SC not set a deadline for conducting assembly elections in Jammu and Kashmir, 'perhaps I would not have been talking to you as the chief minister today'. 'We got elections last year as SC had set a timeframe. Otherwise they (centre) would have never held elections and I wouldn't have been a CM. Let's hope, government gives a time for statehood restoration. It has been promised to people of J&K in parliament, meetings and rallies.' Will take issue in INDI alliance meeting: Farooq Abdullah National Conference president Farooq Abdullah on Wednesday said that he will raise the issue of statehood of J&K in meeting of INDI alliance. PDP, NC on same page on statehood demand The Jammu and Kashmir Peoples Democratic Party (JKPDP) welcomes the recent appeal by chief minister for a collective push toward restoring statehood in J&K. However, JKPDP expresses concern over the selective focus on statehood, while overlooking the far more critical demand for restoring Article 370 and Article 35A, which form the constitutional foundation of Jammu and Kashmir's identity, rights, and autonomy. JKPDP chief spokesperson Mehboob Beg said that while the party wholeheartedly supports the call for statehood and stands ready to back any meaningful initiative that fulfils promises made to the people in Parliament, public forums, and before the Supreme Court, it is disheartening to see that the NC, under CM Omar Abdullah's leadership, has not demonstrated equal urgency or clarity on the restoration of J&K's special status. 'The abrogation of Article 370 and 35A in August 2019 was a historic betrayal that struck at the heart of our political and cultural identity. Ignoring this reality while demanding statehood alone dilutes the larger struggle for justice and dignity,' Beg said. 'Statehood without special status is akin to treating the symptoms while ignoring the root cause,' Beg asserted. The JKPDP reiterated its position that statehood, while important, cannot be the ultimate goal. The restoration of Articles 370 and 35A must remain central to any political roadmap for Jammu and Kashmir.

Trump non-committal on whether extra India tariffs will go with Russia-Ukraine ceasefire
U.S. President Donald Trump did not confirm whether the additional 25% tariffs he had announced on Wednesday (August 6, 2025), on Indian exports to the U.S., for New Delhi's trade in arms and energy with Moscow, would be cancelled if Russia and Ukraine agreed to a ceasefire. 'Well, we'll determine that later, but right now, they're paying a 50% tariff,' Mr. Trump told a reporter who asked if the additional 25% tariff on top of the 25% 'reciprocal tariff', would go following a ceasefire. Mr. Trump was taking questions at an event at the White House with Apple CEO Tim Cook. The President said he would be imposing a tariff of 100% on computer chips and semiconductors, while announcing that Apple would invest $100 billion in the U.S. Mr Trump had reportedly told European allies on Wednesday that he would have an in-person meeting with Russian President Vladimir Putin as early as next week and had plans for a follow-up with Mr. Putin and Ukrainian President Volodymyr Zelenskyy. Also, on Wednesday, Mr. Trump's special envoy Steve Witkoff met with Mr. Putin on Wednesday. Talks 'productive' Mr. Trump described the talks as 'productive' and said he did not know if the additional tariffs on India had anything to do with this. 'And as you know, we put a 50% tariff on India on oil. They're the second largest [purchaser of Russian oil]. They're very close to China in terms of the purchase of oil from Russia. So, I don't know if that had anything to do with it, but we've had very productive talks today,' he said. After imposing additional tariffs on India for trading in arms and energy with Russia, U.S. President Donald Trump said other countries could follow suit, suggesting China by name as a possibility. Asked why he was 'singling India out' for additional tariffs, Mr. Trump said, 'It's only been eight hours. So let's see what happens over the… You're going to see a lot more. You're going to see so much secondary sanctions,' he said.

Officials look to make A.I. summit bigger than G20
Preparations are in full swing as the government gets ready to host the India Artificial Intelligence (AI) Summit next year in New Delhi, with people aware of the matter saying that the government wants it to be 'bigger than the G20 Summit.' 'This will be a grand event, built around the model of G20. All global CEOs, along with heads of state have been invited,' said a government official at the ministry of electronics and information technology (MeitY), which is the ministry leading the preparations of the Summit. 'Lots of moving parts right now. The government is still working around the programme schedule, smaller pre-events, and slowly sending out invitations.' Based on the central theme of 'People, Planet, and Progress,' the Summit's invitation, sent to a select few last month, read, 'The event will bring together world leaders, policymakers, innovators, and experts to discuss AI's role in driving equitable development, improving public services, and tackling global challenges while prioritizing ethics, safety, and inclusivity.' People familiar with the planning told HT that the Prime Minister's Office is closely involved, with clear instructions to make it a landmark global event bigger than the G20. At the G7 Summit held in Kananaskis, Canada in June 2025, PM Narendra Modi invited all G7 leaders to India's AI Summit. Ahead of the summit, MeitY has issued a call for proposals inviting government agencies, academia, intergovernmental organisations, private firms and non-profits from all over the world to host pre-Summit events between August 11, 2025 and 31 January 2026. These pre-events can be in the form of workshops, panels, hackathons, conferences, etc, and must be held in-person or hybrid, but not fully virtual. 'By hosting Pre-Summit Events, organisations can play an active role in shaping the Summit's deliberations and outcomes. Selected events will receive official co-branding and visibility as part of the Summit's global programme,' said MeitY. The pre-events must align with the seven smaller summit themes, namely human capital, inclusion, safe and trusted AI, resilience, science, democratising AI resources, and social good. In the run up to the preparations, MeitY also held five virtual stakeholder consultations from June 6 to 8, chaired by ministry's additional secretary Abhishek Singh. These consultations included representatives from international organisations, industry, startups, academia, and civil society. The ministry also opened a public consultation forum from June 6 to 30, inviting citizens to share their suggestions on shaping the Summit's agenda. The previous AI Summit was held in Paris in February 2025, where 58 countries, including India, endorsed a joint statement on 'Inclusive and Sustainable Artificial Intelligence for People and the Planet.' The United States and the United Kingdom did not sign the declaration, which emphasised making AI more accessible while ensuring trust and safety in its deployment.
