
Caster Semenya declares victory after ECHR rules she was denied fair hearing
She unsuccessfully took her challenge against those rules to the Court of Arbitration for Sport (CAS) and then the Swiss Federal Supreme Court, but complained to the ECHR that her rights had been violated in that process.
The Grand Chamber of the ECHR ruled on Thursday that the Swiss legal system had 'fallen short' in providing what they felt should have been a 'rigorous judicial review that was commensurate with the seriousness of the personal rights at issue' and that Semenya's right to a fair hearing had therefore been violated.

The ruling, which is binding and cannot be appealed, is almost certain to mean that the case returns to the Swiss courts for further consideration, but does not have any impact at this stage on eligibility rules set by World Athletics or any other body.
Semenya, an Olympic gold medallist over 800 metres in 2012 and 2016, said in a statement released by her legal team: 'I have waited 15 long years for this judgment.
'Today, my patience in this journey has been rewarded with a result that will pave the way for all athletes' human rights to be protected.
'I have given up what I wanted in the hope that others may have what they need. I hope this victory will inspire young women to be and to accept themselves in all their diversity.
'There is still much work ahead to achieve justice for women in sport and I will continue to support this effort and fight for young women athletes.'
World Athletics has not commented on the judgement, given that it is not related to their female eligibility guidelines but rather about whether Semenya had been granted a fair hearing in Switzerland or not.
The Swiss Human Rights Institution (ISDH), an independent body which does not speak for the country's federal authorities, felt the Grand Chamber had 'emphasised the significant power imbalance between the individual athlete and the world governing body before the Court of Arbitration for Sport and insisted that, given this imbalance, the Federal Supreme Court had interpreted its own review power too narrowly'.

The ECHR ruled Semenya's complaints that other human rights were violated inadmissible, including the prohibition of discrimination. It found Semenya did not fall within Switzerland's jurisdiction in respect of those complaints.
World Athletics has consistently stood by the rules it introduced on testosterone levels, and earlier this year has gone even further.
Its ruling council has approved the introduction of cheek swab tests to determine eligibility for the female category. Only athletes found to be biologically female will be allowed to compete, effectively barring transgender women and some athletes with differences of sexual development (DSD).

Rangers see Champions League rivals Plzen force fixture to be axed
Raging boss Miroslav Koubek took his case to the authorities after booking a date in the third qualifying round Viktoria Plzen have been granted a fixture postponement ahead of facing Rangers in the Champions League after taking their case to the Czech football authorities. Plzen earned the right to face the Light Blues after coming from behind in the third qualifying round to edge past Swiss outfit Servette 3-2 over two legs They will now travel to Glasgow next Tuesday to take on a Light Blues side - but going into the crucial showdown Viktoria Plzen boss Miroslav Koubek has bemoaned their lack of preparation time before facing Russell Martin's side. Rangers begin their Premiership campaign with a trip to Fir Park to face Motherwell on Saturday - just 90 minutes after Plzen's fixture with Mlada Boleslav. But after taking the row to the governing body, the club have seen the game axed. Club spokesman Václav Hanzlík said: "Due to Tuesday's match in Glasgow and the associated travel, we have asked the LFA and Mladá Boleslav to postpone Saturday's match. "We greatly appreciate that both sides agreed and we can now fully concentrate on the very important match of the third qualifying round of the Champions League, which is important due to the coefficient for all of Czech football." The loser of the clash will be guaranteed group stage football until Christmas at least, with the team that is knocked out dropping into the revamped group phase of the Europa League. Irked Koubek laid out an impassioned case for why the game should be called off following their European progress. He said: "The players are euphoric, but our schedule is a killer. With us, it is automatic only in the case of the play-offs. "We will certainly be asking the question and I would welcome some help from the Czech football authorities. "It's extremely complicated for us now. We don't meet the requirement set by FIFA that players have 72 hours of rest between matches. We now finish at midnight on Wednesday night and are supposed to play at 5pm on Saturday. Former Man Utd boss Erik ten Hag forced into embarrassing U-turn at new club
Former Manchester United boss Erik ten Hag has returned to management with Bayer Leverkusen but hasn't had everything his own way as he gears up for his first season in charge Erik ten Hag's attempts to introduce wholesale changes at Bayer Leverkusen look as though they will have to wait. The former Manchester United boss has taken over from Xabi Alonso at the BayArena, but an instant tactical shift has proved difficult. Leverkusen won the Bundesliga in 2024 with Alonso's three-at-the-back approach reaping rewards. Ten Hag's preference throughout his career has been for a back four - an approach which helped him reach the Champions League semi-finals with Ajax and win two domestic cups with United - but things are proving trickier in Germany. It hasn't helped that Ten Hag has been forced to rebuild after the loss of some key players. Jeremie Frimpong and Jonathan Tah were the first to seal moves away, with Florian Wirtz and Granit Xhaka since following suit. After a humbling defeat to a Flamengo Under-20 side in his first pre-season game, Ten Hag oversaw a victory over Bochum on Sunday. With the new season drawing closer, though, a return to an Alonso-style back three appears inevitable. Sporting director Simon Rolfes has said he held conversations with Ten Hag over the tweak, telling Bild: "I believe it's a good system, that we have great stability in it and that we have the players for it. It makes sense to put many of the players on the pitch." Swiss midfielder Xhaka, one of Alonso's important signings ahead of the 2023-24 title campaign, has returned to the Premier League with Sunderland. "I'm very proud to be here.
