
Opioid dollars will help fund new sheriff's office
In March 2024, the commission approved a $1.75 million American Rescue Plan grant which allowed the sheriff's department to buy the Mercer County Professional Building which is located next door to the Mercer County Courthouse. The building once housed a bank and has been used as office space by various agencies.
The sheriff's department now operates out of the courthouse's basement, a situation which does not allow its deputies and other personnel much room for their duties.
Sheriff Alan Christian spoke Tuesday about his department's request for $100,000 in opioid settlement funds to help convert the building into its new headquarters.
County Commission President Bill Archer said that since the department's request is for opioid settlement funding, it does not impact the county's general revenue.
'I'll provide you with a quick guide to what we've got going on at the new building,' Christian told the commissioners.
'We ran into our first setback (Monday) with the building,' Christian said. 'Apparently, whoever did the renovations prior to us decided to do a big filler on some of those with sand, so it caused what you could call a 2-inch dip and we had to tear it out, go and refill it. Not a huge deal.'
The discovery showed how problems can appear unexpectedly, he said.
'When you're doing renovations, you have no idea what you're getting into,' Christian said. 'So that's why we're asking for the little extra leeway just in case.'
The sheriff's department has already saved $10,000 when buying computers from a company, he said.
'There's no reason for us to pay $500 for our monitors, so we went to save some money and we expect to do the same with this,' Christian said. 'But we just like to have it (extra funds) just in case so I'm not having to come back again and ask for more money which I will be, but I appreciate it and forever.'
The project is now in its second phase. The next phase will include getting furniture and working on the building's exterior. Christian said the department hopes to move in by July.
Christian said the department also planned to ask for Archer's help to put together an archive about past deputies.
'We're going to have a little museum, if you will, for those folks who gave their lives to this county and deserves some recognition,' Christian said.
Commissioner Greg Puckett said he had spoken with the West Virginia First Foundation, which helps manage the state's settlement from opioid manufacturers, about how future funding requests will be addressed.
'I did go through with the West Virginia First Foundation. I've got their grant application and sort of where they've gone with settlement funding from the state,' he said. 'Of course, that's in addition to what the counties actually get throughout the state. I have a resolution that looks to put together a task force team that looks at all requests. That way, there's a broad based sort of input from the community.
'This (department's request) would obviously supersede that because it's a direct need that has to do with our sheriff's department, but for all other opioid requests. I should have that memorandum set and then to start the team process soon and then grant applications would be based on the availability of funds to the community,' Puckett said.
The county now has around $2.6 million in opioid settlement funds, he said.
''We are taking those and putting those into an interest earnings account; so, for all the monies that we do have in there during this period of time, it is earning which gives us additional monies in which to work with, which is extremely valuable,' Puckett said. 'Hopefully we can get that and keep a $1.5 million minimum in there at all times.'
If the county keeps $1.5 million in the account and, based on the current interest rates the county has with New People's Bank, the county could between from $75,000 to $80,000 a year in interest income, Puckett said.
'That would give us project money to move it forward and keep that going forever and ever if all goes well,' he said.
Puckett and Commissioner Brian Blankenship supported the funding request. The request was approved unanimously.
'All that being said, I do think this is a great request because it's putting our sheriff's office in good standing, opening that up and allowing for the expansion of our sheriff's office,' Puckett said.
'I just want to say we appreciate your due diligence and everybody over there looking out where you can and how you can save,' said Blankenship. 'You know, they're doing a lot of the work themselves.'

Morgantown opioid allocation a fraction of state's other cities
MORGANTOWN — Would it surprise you to learn that the city of Charleston – a city of 48,864 people per the 2020 Census – will receive around 46 times more directly allocated opioid settlement funds than the city of Morgantown and its 30,347 residents? Or that Beckley, with a population of 17,286, will receive about 28 times as much? Or that Morgantown doesn't even get the largest direct allocation among Monongalia County's municipalities? All true. In fact, when it comes to the direct allocation of opioid settlement dollars going to local governments, the city of Morgantown is a glaring outlier among the state's major cities. Of the approximately $980 million in opioid settlement dollars coming to West Virginia, 24% – some $235 million – will be distributed directly to local governments over the next several years based on default percentage allocations set forth in the West Virginia First Memorandum of Understanding (MOU) signed into law in 2023. The percentage agreed to by Morgantown – the state's third most populous city – is the 40th highest municipal distribution percentage in the state. Exactly how those percentages were arrived at isn't abundantly clear. What is clear is that those tiny numbers will add up to big money. On July 15, the West Virginia First Foundation issued its 2025 Qualified Settlement Fund Expenditure Report. A requirement of the MOU, the annual report details how much money was distributed directly to towns, cities and counties between July 1, 2023, and June 30, 2024, and how those dollars were spent. The report represents the first, and likely largest, direct allocation provided directly to local governments. Charleston received $4.2 million. Huntington is listed at $2.7 million. Beckley brought in $2.5 million. In fact, no city of at least 17,000 residents received less than Fairmont's $624,579. Except one. Morgantown received way less – $90,856.10 according to the report. Granville, with 1,355 residents, received $112,306.69. The city of Morgantown responded to several questions. Why is its direct share so low? Did it opt out of any settlements? Did it try to negotiate? 'The City of Morgantown did not opt out of opioid settlements presented by the WVAG's office, nor did we engage in negotiations,' Communications Director Brad Riffee said, explaining the city is grateful for the funds it received. Neither the West Virginia First Foundation nor the attorney general's office could provide clarification as to how the local distribution percentages were formulated. 'The Attorney General's Office was not involved in calculations for cities and counties. That was handled by the lead attorneys for local governments,' Kallie Cart, deputy chief of staff and director of communications for the attorney general's office noted, providing Paul Farrell Jr., Tony Majestro or Bob Fitzsimmons as suggestions. Farrell, who served as co-lead counsel on the national opioid litigation and lead counsel on West Virginia's case, responded. He indicated that each county was allocated an overall set number as a geographic area and it was up to the county commissions and their respective municipalities to sort out amongst themselves how much each governmental body would receive — otherwise, the default percentages listed in the MOU were assigned. Adding up the initial allocations received by Monongalia County Commission, Granville, Morgantown, Westover and Star City, the total provided to Monongalia County in the 2024 fiscal year was $1,279.054.80. That's about what the city of Martinsburg received on its own, at $1,224,848.41. The Berkeley County Commission received $3,688,693.32. Liberty University faces second lawsuit accusing it of mishandling sexual assault cases
A former Liberty University employee says she was terminated in part for cooperating with a federal investigation of the school's handling of sexual assault, according to recently filed court documents. In her suit against the private Christian university, Erika Woolfolk stated she was paid less, required to work more, and the subject of a hostile work environment while employed in the university's office of Equity and Compliance and Title IX. Woolfolk's work involved investigating cases of sexual violence on campus, of which she alleged her bosses would improperly predetermine their outcomes, according to her lawsuit. She claimed in the filing that she shared that information and more about the university's 'systemic violations of federal law' with the U.S. Department of Education. She also claims she was fired for it. She is now the second former Liberty University employee who has alleged in lawsuits that they reported the university's improper and unethical investigations into sexual assault and were later terminated. Most recently, Peter Brake sued the university along similar grounds and his firing was cited in Woolfolk's filing. Both suits also name as a defendant Ashley Reich, a former top administrator at the university who oversaw the Title IX office. In a statement to USA TODAY, Liberty University declined to respond to all the allegations but disagreed with Woolfolk's claims. It stated that her termination did not have to do with her race or her interactions with the federal government. Instead, her firing was tied to "legitimate business reasons" related to Title IX investigations. USA TODAY reached out to Reich for comment but received no response prior to publication. The Biden-era Education Department in 2024 found that the university had created a culture where students and others were afraid to report sexual violence. The university was penalized $16 million as a result. It also remains on federal monitoring through April 2026. Liberty has previously said it believed it was treated unfairly by the Biden administration, while agreeing 'there were numerous deficiencies that existed in the past' with its compliance with the Clery Act. That regulation includes requirements for how universities respond to and report sexual assault and other crimes on their campuses. It laid out how university officials tried to cover their tracks by seeking technology staff to delete hard drives. Liberty, based in Lynchburg, Virginia, is among the nation's largest and most prominent Christian universities. The school is also hugely popular among Republican politicians. Jerry Falwell, a televangelist and conservative figure, started the school in 1971. The university has grown thanks to online students – about 124,000 combined in the 2023-24 academic year, according to the school – and it took nearly $880 million in federal financial aid for its students in the 2022-2023 academic year, according to the Department of Education. What did Woolfolk allege? In her lawsuit, which was filed in the U.S. District Court in the Western District of Virginia, Woolfolk stated she earned undergraduate and master's degrees at the school and had been working there since 2014. She initially produced content for the Liberty Flames Sports Network, before transferring to the Office of Equity and Compliance/Title IX in 2018. In that office, she was the only Black employee and faced a hostile work environment, the suit states. She alleged she was paid less than her more inexperienced peers and was asked to work longer hours on more arduous tasks. She said she was denied promotions and accommodations, like remote work, while Reich routinely stayed home, according to the lawsuit. She also described facing racial comments from her colleagues, like one who stereotyped 'Blacks as either 'black-black' or 'white-black'' with more positive connotations for the latter, according to the lawsuit. The suit also included screenshots from Microsoft Teams chats where her peers joked about naming a coworker's new dog after Confederate generals. Woolfolk's suit also states that Reich regularly influenced the findings of Title IX cases, either directly or through another employee. In another instance, Woolfolk learned details of a confidential case were improperly shared throughout the office, which 'posed significant risks of prejudice to complainants and respondents.' That was because members of her team would sometimes have to serve as neutral deciders in cases other than their own. In 2022, Woolfolk spoke to Education Department investigators. Her suit states she told them about numerous violations of Title IX, which included 'systematic efforts to minimize and downplay sexual assault reports; and predetermined case outcomes before investigations were completed.' She also alleged that Reich was aware of her actions. By June 2024, Woolfolk said she had filed an internal complaint against Reich related to workplace discrimination and retaliation for cooperating with the federal government. She was assigned to work virtually, but was fired days later. The suit stated that the university fired her for unspecified compliance issues. She was terminated on the same day as two other investigators, including Peter Brake, who had also raised complaints about Reich. Reich now works at the Education Department where she'll be recused from matters involving the school.
