Expedite probe into procurement of mosquito nets: HC to CBI

recently directed the CBI to expedite investigation into an alleged scam committed by Hindustan Insecticides Limited (HIL), a public sector company, in the procurement of Long Lasting Insecticidal Nets (LLINs) to the Jharkhand govt and Central Medical Survey Services Society (CMSS), New Delhi in 2022.
The court was hearing the petition filed by A R Malaiyappasamy, president of the Karur HDPE Filament and Bednets Manufacturers Welfare Association. According to the petitioner, HIL, New Delhi, a public sector company, had obtained a contract from the Jharkhand govt and CMSS in New Delhi, for supply of mosquito nets for public use. While CMSS procured more than 40 million LLINs, the Jharkhand govt had floated a tender in 2022 for procurement of 48,000 LLINs.
The petitioner alleged that the HIL had procured LLINs from shell companies at a low cost and supplied it at a higher cost. Alleging that a fraud had been committed by HIL, the petitioner association had lodged a complaint to the CBI in March 2023. The petitioner had filed the present petition in 2024 seeking a direction to the CBI to expedite inquiry into the complaint.
Earlier, the court had directed the CBI to ascertain as to whether the shell companies through which, HIL said to have procured the nets, are having any manufacturing facilities to manufacture LLINs and regarding the actual cost of production and the cost which has been shown by HIL as procurement cost.

Pursuant to the earlier order, the CBI submitted an interim report stating that LLINs were purchased at the lower cost from a shell company which was given purchase orders for 9.31 lakh LLINs.
However, the shell company had the capacity to manufacture 75,000 nets per month, as per the report of HIL itself.
Justice B Pugalendhi observed that the interim report submitted by the CBI reveals that there are certain prima facie materials available in the complaint of the petitioner and therefore, it needs to be prosecuted. Hence, the judge directed the CBI to proceed with the investigation and conclude the same as expeditiously as possible. The petition was disposed of.

As SP, Kangra, in 2017 under the Congress-led Virbhadra Singh government, he spearheaded operations against drug and mining mafias. These actions resulted in three transfers within 15 days, though public and political support called for his retention. Verma retired Saturday and necessitating the transfer of his charge to 1994-batch IPS officer Ashok Tiwari, posted as DGP (Vigilance and ACB). Gandhi, meanwhile is on medical leave and Solan SP Gaurav Singh has been given additional charge for Shimla. Shimla: Sanjeev Kumar Gandhi, a 2012-batch Indian Police Service (IPS) officer posted as Superintendent of Police (SP) of Shimla, has landed at the center of a controversy involving senior police officers and political figures. The Himachal Pradesh government placed Gandhi, former director general of police (DGP) Atul Verma, and Additional Chief Secretary (Home) Onkar Sharma on leave on 29 May, citing 'indiscipline'. He was subsequently transferred to Una, where he continued targeting similar syndicates. In 2022, Gandhi was awarded the DGP Disc and Best Administrator Award for his work against the drug mafia in Himachal Pradesh. The current controversy stems from Gandhi's role leading a Special Investigation Team (SIT) investigating the death of Vimal Negi, a chief engineer with the Himachal Pradesh Power Corporation Limited, whose body was found in Gobind Sagar lake on 18 March. On 23 May, Himachal Pradesh High Court transferred the case to Central Bureau of Investigation (CBI) citing delays on the part of the state police. At a press conference the next day, on 24 May, Gandhi publicly named Verma, former DGP Sanjay Kundu, and Chief Secretary Prabodh Saxena, accusing them of obstructing justice. Gandhi alleged that Verma submitted a misleading affidavit questioning the SIT's evidence handling, particularly regarding a formatted pen drive, claiming it was intended to discredit his investigation. The affidavit referenced a 20 March conversation among five police officers discussing the pen drive's potential replacement. He also criticized the Bharatiya Janata Party (BJP) for allegedly using corrupt means to destabilize the Sukhvinder Singh Sukhu government. Verma recommended Gandhi's suspension for these allegations, and Gandhi's attempt to challenge the high court's CBI transfer ruling through a Letter Patent Appeal (LPA), an appeal made against the decision of a single judge to another bench in the same court. But CM Sukhu did not act on Verma's recommendation. Subsequently, the LPA was withdrawn. ThePrint reached Gandhi, Verma and Kundu for comment but had not received a response by the time of publication. This report will be updated if and when a response is received. Gandhi's run-ins with Verma go back to 2021-22, when Gandhi, part of a police recruitment committee, raised concerns about irregularities, prompting a CBI investigation. He accused Verma, then DG-CID, of pressuring subordinates to produce a misleading report in another case and claimed Verma's staff leaked a confidential CID report in the 'samosa scandal'. As for Kundu, Gandhi alleged in the press conference on 24 May that he misrepresented a 18 July, 2023, gas leak explosion in Shimla's Middle Bazaar as a terror attack, 'misusing' the National Security Guard (NSG) to fabricate evidence. In another case, Gandhi's status report on a complaint by Dharamshala businessman Nishant Sharma detailed nine phone calls between Kundu and K.D. Shreedhar, an advocate and Sharma's business partner, in 2023, including a 256-second call on 25 October, 2023, suggesting potential 'criminal links', leading to a court-ordered impartial investigation. Gandhi's investigations have also led to tensions with BJP MLA Sudhir Sharma, whom he accused of orchestrating 'horse-trading' during the February 2024 Rajya Sabha elections, when six Congress MLAs cross-voted in favour of BJP candidate Harsh Mahajan. Gandhi filed a contempt of court petition against Sharma for sharing a video of Negi case proceedings. Sharma responded with a criminal defamation notice and wrote to the Speaker of the Himachal Pradesh Vidhan Sabha to move a privilege motion against Gandhi, claiming the officer's statements harmed his reputation. Gandhi has accused Chief Secretary Prabodh Saxena of pressuring him to halt police inquiries in cases related to the Ram Krishna Ashram land dispute, alleging he was instructed not to question the ashram's swami. He claims a 'long-term conspiracy' by senior officials to undermine his investigations, particularly in the Negi case, which BJP alleges involves a Congress cover-up. Gandhi has reported these issues to the state government and Advocate General, stating that no action has been taken. He has expressed readiness to resign rather than compromise on his integrity, emphasising his 25 years of service. Public opinion on Gandhi is divided. Some view him as an officer committed to addressing corruption, while others, including Sharma, describe him as defiant, accusing him of politicizing investigations and challenging senior officials. 'The ongoing disputes reflect the complex interplay of policing, bureaucratic dynamics, and political tensions in Himachal Pradesh. Gandhi is outspoken but when you are in force, there is a procedure. He has made a mistake by holding a press conference against superiors,' a retired IPS officer told ThePrint on condition of anonymity. A senior police officer who did not wish to be named said Gandhi had Sukhu's backing, so far. 'He worked with a free hand. Proceeding on leave is not a big deal. But since he has levelled open accusations against superiors, that amounts to indiscipline,' he told ThePrint. 'The SIT led by Gandhi has not questioned those accused by the deceased's wife. It raises fingers on his probe and even the court has pointed it out,' another officer pointed out. CBI arrests two including senior IRS officer for Rs 25 lakh bribe case
NEW DELHI: The Central Bureau of Investigation (CBI) has arrested senior Indian Revenue Service (IRS) officer of the 2007 batch Amit Kumar Singal, who is currently posted as Additional Director General, Directorate of Taxpayer Services in New Delhi for allegedly accepting a bribe of Rs 25 lakh, officials said on Sunday. One more person was also arrested in the case The CBI action comes after the agency registered a case against the accused on Saturday. In its FIR, CBI stated that the accused, a public servant, had demanded illegal gratification of Rs 45 lakh from the complainant for providing favourable treatment from the Revenue/Income Tax Department. Following a complaint regarding the alleged bribe demand, the CBI laid a trap and arrested a private individual, Harsh Kotak, who was reportedly caught accepting the bribe on Singal's behalf at the latter's Mohali residence, officials said. Singal was arrested from his residence in Vasant Kunj, New Delhi. Both the accused will be produced before the competent court, the agency said. Following Singal's arrest CBI sleuths have been conducting searches at multiple locations across Delhi, Punjab and Mumbai as part of their probe into the case. Officials confirmed that documents and digital evidence related to the bribery charges were being seized during the searches and are being examined.

Delhi HC rejects plea by Lalu Prasad Yadav to stay trial proceedings in land-for-jobs scam case
The Delhi High Court has dismissed a petition filed by Rashtriya Janata Dal leader and former Bihar Chief Minister Lalu Prasad Yadav seeking to stay proceedings in a trial court in connection with a money-laundering case linked to the alleged land-for-jobs scam. Yadav had filed a petition in the High Court seeking to quash the first information report filed against him by the Central Bureau of Investigation in 2022. In addition, he had also sought a stay on the proceedings in the matter in the trial court while the petition was pending. In an order issued on May 29, Justice Ravinder Dudeja said that he found no compelling reasons to stay the proceedings in the trial court. 'The present matter is stated to be listed before the learned special judge for arguments on charge,' the order said. 'Notwithstanding, the pendency of the present petition, petitioner would be at liberty to urge all his contentions before the learned trial court at the stage of consideration of charge.' Dudeja said that the trial proceedings would be 'an added opportunity' for Yadav to 'put forth his point and get the same adjudicated'. In an earlier submission, advocate Kapil Sibal, representing Yadav, had told the High Court that the CBI did not to obtain mandatory prosecution sanction under Section 17A of the Prevention of Corruption Act against Yadav before registering the FIR. This section stipulates that no investigation can be conducted by a police officer into an offence alleged to have been committed by a public servant under the Act without prior approval from an appropriate authority. Sibal also said that the offences that Yadav were accused of were allegedly committed between 2004 and 2009. However, the FIR was lodged only in 2022 after a delay of almost 14 years, he pointed out. Sibal also said that the matter was listed before the Rouse Avenue Courts on the framing of charges on June 2. He added that if the charges were framed, then the present petition would lose its purpose. Senior Public Prosecutor DP Singh, on the other hand, told the High Court that the question on the applicability of Section 17A was under consideration before a larger bench of the Supreme Court. Yadav could also make similar submissions before the trial court at the stage of the framing of charges, Singh added. The CBI has named 78 accused persons in the case, including 30 government officials. The case centres on allegations that between 2004 and 2009, when Yadav was the Union railway minister, land was illegally acquired at reduced prices in exchange for appointments to Group-D positions in the Indian Railways. The agency alleges that land parcels were transferred to Yadav's family members, including wife Rabri Devi and daughters Misa Bharti and Hema Yadav, at prices significantly below the market value.
