Telangana HC pulls up state tax officers for repeated errors, terms it ‘official misconduct'

Hyderabad: The Telangana high court on Tuesday came down heavily on the functioning of state tax officers, expressing concern over repeated mistakes that compel assessees to approach the courts for relief.
"If I were the commissioner of the state tax department, I would not have been able to sleep properly," said Chief Justice Aparesh Kumar Singh, pointing to what he described as the lackadaisical approach of the officers.
A bench comprising the Chief Justice and Justice GM Mohiuddin observed that although eight years have passed since the introduction of the GST regime, state officers are still struggling to grasp its framework.
The special govt pleader for state tax informed the court that officers are being continuously briefed on court proceedings, corrective measures, and given regular training sessions.

The court was hearing a petition filed by Sri Venkateshwara Dairy Products, which challenged multiple notices issued by the assessing officer for the same tax period—FY 2018-19—under the TGST Act. Taking a serious view of the matter, the bench directed the assessment officer concerned to appear in person before the court on Sept 8.
The judges did not mince words in highlighting the consequences of such lapses. The bench observed that the conduct of the tax officers was unnecessarily consuming the precious time of the court and leading to loss of state revenue. "Who will be ultimately responsible for this loss? This is nothing but official misconduct. Are you taking any action against these officials?" the bench asked.
While impleading the commissioner of state tax in the case, the bench directed that a detailed counter affidavit be filed by the assessment officer, which must be duly vetted by the commissioner, within two weeks.
Meanwhile, granting interim relief to the petitioner, the court ordered that no coercive steps be taken against the company in connection with the disputed notices until further orders.

The gradual rise we saw last week is now set to continue as we trade into the weekly expiry today. The emerging trend clearly suggests that the rally last week was a holding the resistance zone and a gap-up opening ensured that the prices traded above that range. The move above 25,000 (Nifty Spot) signals a bullish bias. Momentum on hourly charts indicates that the market seems to have absorbed the selling pressure. However, we can expect the rise to remain hesitant as the bearish overhang continues. We continue to maintain short positions in the Nifty so long as 24,800 holds, viewing any sustained move below that level as a clear sign that bullish conviction is waning. What had previously been support around 24,500 has now shifted up to 24,800, while open interest peaking at 25,200 marks the next significant resistance zone. If the index breaks down from its current 30-minute range on Wednesday, we can pivot to two-way trades, but until then the trend remains in a tentative standoff. Geopolitical uncertainty still looms large, limiting the market's ability to muster strong directional moves, so be prepared to lock in gains quickly. At the same time, monitor FII/DII flow data for shifts in institutional sentiment, watch US yields and crude‐oil volatility for potential catalysts, leverage intraday volatility heatmaps to spot pockets of expanding risk, and consider short-tenor option structures—such as one-week iron condors—to capitalize on muted directional conviction. Options data suggests that PCR has now moved comfortably above 1, highlighting that the trends are showing intention to move higher. Steady put writing at 25,000 to 24,800 levels continues absorb the bearish bias and help the recovery. We must now watch out for multiple news triggers as global tariff threats, cautious investor sentiment, and domestic economic challenges have contributed to the sharp market decline and volatility in the rupee. 1 2 Nagpur: On first day of rollout of the private bus parking ban, traffic police on Wednesday cracked down on vehicles parked illegally on roads, causing traffic jams. However, buses dropping off or picking passengers were spared. Cops registered 12 FIRs against bus operators for violating the recent order issued by DCP (Traffic) Lohit Matani and for causing danger by obstruction. Till evening, the cops dealt with the bus operators with velvet gloves. Instead of taking strict action, they asked bus operators to leave, and some even complied, fearing police action. Such was the impact of the city police action that by 9pm, Chhatrapati Square, which usually witnesses long lines of private buses, and traffic chaos because of it, was completely devoid of buses. The traffic department had on August 12 issued a notification banning the pick-up and drop service of private bus operators inside the Inner Ring Road boundary. Police also gave seven days to the operators to find locations, with the deadline of August 20. Learn More Undo Speaking to TOI, DCP Matani said police on Wednesday took action against private vehicles illegally parked on streets. "The drive will continue, and after some days, we will even intensify the action to clear the city roads," said the DCP, adding that many vehicles were parked on roads for more than 45 minutes. Police deployed 21 officers and 70 personnel for the drive. Till 7pm, cops had registered 12 FIRs and also seized vehicles, which were later sent to the respective police station. The FIRs were registered under section 223 and 285 of Bhartiya Nyaya Sanhita. Cops also imposed a 5,000 fine on 15 vehicles under the Motor Vehicle Act for illegal parking. TOI on Wednesday also visited many spots in the city where private buses pick-up and drop passengers. Interestingly, during afternoon hours, at locations like Chhatrapati Square, Bole Petrol Pump, Ravi Nagar, Rahate Colony, and Central Avenue, the private operators were picking up and dropping passengers like usual. However, by evening, the police went into action and started cracking down heavily. However, police also started removing the buses rather than only issuing challans. "On Wednesday, we focused mainly on Chhatrapati Square and Central Avenue, where the menace of private buses is higher," said DCP Matani. Meanwhile, the process of identifying locations for private buses for pay and park is also underway inside city limits. Noida: A murder accused was arrested after an encounter with Badalpur police near an abandoned railway crossing at Roza Yakubpur on Tuesday night. Pappu Mistri (27), a resident of Chhapraula, was the main suspect in the murder of an elderly woman who lived near Vidya World School. Pappu allegedly committed the crime on Aug 3 at the victim's house, where he strangled her and fled with her jewellery and mobile phone. According to police, the arrest was made by a police team that was conducting checks near the closed railway gate. A man was spotted approaching, and when signalled to stop, he tried to flee. Suspecting foul play, cops chased him. In retaliatory firing, he sustained a bullet injury and was overpowered," said DCP (central Noida) Shakti Mohan Avasthy. The accused was rushed to a hospital for treatment. A country-made .315 bore pistol, a live and an empty cartridge, a Samsung mobile phone, two earrings, a floral nose pin, and a blade were recovered from his possession. "The recovery of the stolen ornaments from him further establishes his involvement in the murder case," DCP Avasthy said. A case was registered against him under BNS Section 103(1) (murder). Police have initiated further legal proceedings against the accused and are investigating whether he was involved in other crimes in the region. Sources in the police revealed that they initially received information about the 65-year-old woman's body found inside her house. On reaching the spot, police found the woman strangled with her throat slit. Three teams were formed, and a case was registered against unknown persons by the daughter of the deceased at the Badalpur police station. "It was earlier suspected that the murder was carried out for property, but the investigations revealed that the accused worked as a labourer in the area and knew the old woman. On Aug 3, he consumed alcohol, entered the victim's house and committed the crime before fleeing. He also took her phone away to transfer the money from her account," the officer said.
