Former top prosecutor takes over full defence in AKA, Tibz murder case
Former National Prosecuting Authority director in KZN, Advocate Simphiwe Mlotshwa, will now represent all the accused in the Kiernan 'AKA' Forbes and Tebello 'Tibz' Motsoane murder case — including those facing extradition from Eswatini.
The Witness reports that Mlotshwa was already representing two of the accused. The matter, now transferred to the High Court, returned today for a pre-trial conference following the indictment of the accused in February.
AKA and Tibz were gunned down outside the popular Durban restaurant, Wish, on February 10, 2023.
The five men — Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimande (35), Siyanda Eddie Myeza (21), Mziwethemba Harvey Gwabeni (36), and Lindokuhle 'Lindo' Ndimande (29) — were arrested in February 2024.
They made a brief appearance at the Durban High Court today for the pre-trial.
The matter was postponed to June 12 after state prosecutor Advocate Lawrence Gcaba informed the court that the defence attorney was in Eswatini handling the extradition proceedings of two other accused, Siyabonga and Malusi Ndimande.
The group faces several charges, including conspiracy to commit murder, two counts of murder, unlawful possession of a firearm, unlawful possession of ammunition, and five counts of attempted murder.
In addition, Mkhwanazi, Ndimande, Myeza, and Gwabeni face charges of money laundering involving the acquisition, possession or use of proceeds from unlawful activities.
During a previous court appearance, the state revealed it had obtained surveillance footage from King Shaka International Airport allegedly showing Gwabeni waiting for AKA upon his arrival in Durban on the day of the murder.

The assassination of a legal counsel in an apparent hit draws attention to a worrying trend of sourcing 'guns for hire' in the Eastern Cape. The death of a Gqeberha public prosecutor, widely believed to be an assassination, has highlighted growing concern for the safety of state attorneys. Crime experts warn that there is no clear solution to the escalating attacks on legal officials – especially in the Eastern Cape (EC), which they describe as a rising hotspot for hired guns. Regional Court prosecutor Tracy Brown arrived at her Young Park home at around 3.30pm on Thursday 31 July. She was still seated in her car when a VW Polo pulled up to her driveway. Four armed men wearing masks to hide their faces got out, walked up to her car and fired multiple shots into Brown's Toyota Etios before fleeing the scene. Brown's partner and minor child were at home when the incident occurred. She was rushed to hospital, but sadly succumbed to the numerous gunshot wounds she sustained. The police said the motive behind the murder was still unclear. But the National Prosecuting Authority (NPA), as well as court and police officials who worked with Brown, believe she was the target of a planned hit murder. Her death comes only a few short months after another prosecutor, Elona Sombulula, was shot and killed in Ngcobo in April. NPA spokesperson Mthunzi Mhaga said Brown's death was an attack on law and order, and no stone would be left unturned to solve the violent crime. 'Brutal murder' 'Tracy Brown was shot assassination-style by four armed men in front of her house in Gqeberha, in the presence of her partner and minor child. The NPA, together with law enforcement, will spare no effort in ensuring that the perpetrators of this brutal murder are brought to justice,' he said. Mhaga said prosecutors like Brown show a deep commitment to upholding the law, often at great personal risk. He shared the NPA's condolences with her family. Colleagues of Brown's at the New Brighton Magistrates' Court said she was a hard-working and diligent prosecutor who never shied away from difficult cases. Detectives working in the jurisdiction of her court said she was very dedicated to her craft and often put pressure on them to conduct very thorough investigations when building her cases. 'Even when she put pressure on us, she was a delight to work with. She only pushed us to ensure the success of our cases. Her death is a major loss to law and law enforcement,' a detective who worked closely with her said. In another unrelated incident, it is believed that a prosecutor stationed at the Gqeberha Magistrates Court recently took an extended period of leave after allegedly receiving reports that she was being targeted by suspects awaiting the outcome of their formal bail application. Justice Minister Mmamoloko Kubayi condemned the murders that claimed Brown and Sombulula, and called on the public to assist the police by coming forward with any information they believe could help the investigation. 'The death of one prosecutor is one too many,' she said. 'Their protection must be reinforced and better coordinated with other security cluster stakeholders to ensure that our prosecutors can carry out their duties without fear for their lives.' Kubayi said the NPA had security measures in place for prosecutors, but said these measures should urgently be reviewed and strengthened, particularly in the EC. Bringing shooters from EC Criminologist John Alexander said the suspected hit murders of state officials were endemic to the EC, where hitmen are steadily becoming a well-known export. 'The gun-for-hire trade is becoming highly specialised in the Eastern Cape. More and more reports are circulating that gangs from the Western Cape and other provinces are bringing shooters from the Eastern Cape to do their dirty work.' With reference to the murders of public prosecutors, Alexander said there was no quick solution to the problem. Due to the nature of their work, and courts being a public space where anyone can attend proceedings, Alexander said prosecutors have no chance of a normal life. 'Often they do not get to choose the cases they are assigned, and when you deal with dangerous criminals, you open yourself up to risk. Prosecutors either make use of security guards, or they accept the risks that come from not being protected.' He believes the increase in violence against court officials also increases the chances of corruption or extortion. 'The unfortunate truth is that officials might become more susceptible to taking bribes if it means saving their lives and protecting their loved ones. A little envelope to make a case go away might just be the thing to keep the hitmen off your tail,' Alexander said. DM

IOL reported on Friday that the murder of the female public prosecutor in front of her child and partner has been described as an attack on the rule of law. Tracy Brown, a regional court prosecutor, was shot and killed in front of her house at Lotton Street, Young Park in Gqeberha on Thursday after four men alighted from a white Polo vehicle and fired multiple shots at her vehicle. Nqola said protectors of the justice system in South Africa are not safe. 'This is indeed a tragedy where the protectors of our criminal justice system are not safe anymore. This is unacceptable and no stone should be left unturned to bring the culprits to book,' he said. According to reports, Brown was ambushed and shot multiple times by four armed assailants while sitting in her car, in full view of her partner and child. 'The brutal nature of this assassination-style killing is deeply disturbing and represents a direct attack on the justice system and those who serve it with dedication and courage,' he said. This incident follows the tragic murder of Elona Sombulula, a court official at the Engcobo Magistrate's Court, in April. The parliamentary committee is 'gravely concerned' by what appears to be a pattern of targeted violence against officials within the justice sector. 'The murder of Ms Brown is not only a devastating loss to her family and colleagues, but an attack on the rule of law in South Africa. Prosecutors serve at the forefront of our fight against crime and corruption. When they are targeted, it threatens the foundations of our constitutional democracy. 'The committee sends its heartfelt condolences to Ms Brown's loved ones and colleagues during this painful time. The committee also calls on law enforcement agencies to prioritise the investigation and ensure that those responsible are swiftly apprehended and face the full might of the law.' Nqola said the portfolio committee will engage with the Department of Justice and the National Prosecuting Authority (NPA) on urgent measures to enhance the safety and security of prosecutors and court officials across the country.

Religious leader's murder shocks Benoni community
A lone brightly coloured floral arrangement stands next to the curb in Caledon Street in Actonville, in Benoni, Ekurhuleni – it serves as a stark reminder of where guru Roy Naidoo (66) was murdered on Wednesday. Steeling herself, one of Naidoo's sisters, Queenie, places a fresh rose next to the bouquet, paying her respects to a man she said served his community until his final moments. Benoni City Times reports that Anton Koen of NoJack Vehicle Tracking said private security, local SAPS, as well as members of the Benoni Flying Squad (BFS) responded to the incident, which he described as gruesome. Paul Apicella, from the neighbouring Paarl Street, said that the suspect had been walking the streets that morning, wielding what he described as a panga. 'The man was swinging the weapon around, screaming and ranting,' said Apicella. 'Pedestrians could be heard screaming and running in all directions. It was chaos, people locked themselves in their homes out of fear.' Shanwill da Costa, a local youth who had been living under the mentorship of the Tamil priest for the past four years, said that at about 13:30, Naidoo approached his assailant to calm the situation. 'Uncle Roy was standing in the road next to him, speaking in his characteristic calm manner. It seemed like the situation was simmering down,' said Da Costa. 'The suspect started swinging the weapon, and the next minute, Uncle Roy was on the ground. I tried to help, but could not get close enough. I felt incredibly helpless.' Koen confirmed that after the incident, the suspect fled into his home, barricading himself inside. 'Following a brief exchange of fire, SAPS members tactically breached the property,' he said. 'The man was found on his bed with a gunshot wound. He was arrested and taken to a local hospital for treatment.' Sitting in Naidoo's living room, Queenie said that her brother's home and Ashram (temple) have, for more than two decades, served as a beacon of hope for the community. 'Roy has served as a spiritual leader for 45 years, assisting weary souls with guidance and care,' she said. 'Despite not being in good health, he sourced food donations from local businesses to provide those in need with a weekly meal and a diligently packed food hamper. His life was dedicated to caring for everyone regardless of faith and culture.' She said that Roy's two children, as well as his surviving five siblings, are grappling to come to terms with his death. 'It would have been easier to accept his physical departure if it were due to natural causes,' she said. 'This burden is too heavy to carry. We leave Roy's attacker in the hands of God, for only He can judge.' A funeral service will be held at Naidoo's Caledon Street home tomorrow (August 2).
