Canberra man jailed for raping customer in shopping centre art shop where he worked

A man accused of raping a customer in a Canberra shopping centre art shop where he worked is behind bars after an ACT Supreme Court jury found him guilty within four hours.
It is the second time Abhishek Timalsina has been tried for the crime, which occurred in the Westfield Belconnen store's staff room in November 2022.
The first jury was unable to reach a verdict, but yesterday another jury found Timalsina guilty of two counts or rape and four acts of indecency.
The original case was significant because it was the first test of the ACT's new affirmative consent laws, which apply a different standard to the evidence.
Consent is now required to be both free and voluntary, and has to be communicated to the other party.
That means consent can no longer be presumed.
The woman had gone to the shop to enquire about a refund when the pair began talking about her art and his photography.
The events were not disputed.
But on Timalsina's version, the pair were flirting, and the woman had been laughing and smiling when he leaned in and kissed her.
The court heard Timalsina asked her if she "wanted to do something crazy".
He told the court they had been "vibing", and he thought he had consent and that the woman was enjoying the attention.
The woman later told a friend that during the incident her brain had "checked out".
She admitted she had kissed him back, but as things escalated, she stopped reacting.
The woman took herself to hospital in the immediate aftermath, to be examined.
Timalsina's bail has been revoked, and he was taken away to jail.
He will be sentenced in August.

Officers from the Port Stephens-Hunter Police District were patrolling Woodberry Rd at Millers Forest at about 4:15am on Wednesday when they spotted a vehicle that had been reported stolen. Police say the driver failed to stop when directed, prompting a short pursuit that lasted less than a minute before the car veered off the road and crashed at Woodberry, about 5km north of Hexham. Officers rendered immediate assistance to six occupants – believed to be teenagers – allegedly travelling in the vehicle. One of the teens being taken away on a stretcher. A married young doctor has been charged by police after he was allegedly caught with more than 5000 files of child abuse material on his phone. Dr Gregory John Couch was arrested at a home in Albury — on the NSW-Victoria border — at 6am on Tuesday as a part of ongoing strike force investigations into the sexual abuse and exploitation of children online. The 37-year-old's phone was seized by Australian Border Force officers at Melbourne Airport in May. The phone was referred to detectives from the state's Sex Crimes Squad, who then allegedly found thousands of videos and photos of child abuse material. Footage from the arrest shows the young doctor, dressed in grey track pants, a black puffer jacket and ugg boots, being escorted out of the property, up the driveway and into an awaiting police van. Couch was charged with possess child abuse material, use carriage etc to access child abuse material, and intentionally import prohibited tier two goods. It is not believed there was any offending occurred against his patients. According to social media, Couch worked at Liverpool Hospital in Sydney's south west before relocating to the Gold Coast earlier this year. He was refused bail by Albury Local Court on Tuesday. Couch will remain behind bars on remand and is due to appear in court next on August 19.
