‘Pregnancy care' for wife: Kerala HC junks plea for man's parole

Kochi: High court has dismissed a petition by the wife of a convict sentenced to life imprisonment in a
murder case
, seeking emergency parole for her husband to provide her with 'pregnancy care'.
Dismissing the Kannur native's petition, the bench of Justice P V Kunhikrishnan observed that if HC begins granting emergency leave to convicts for occasions such as birthdays, naming ceremonies, first rice-feeding ceremonies and similar events, public faith in judiciary would be eroded. The court further stated that convicts must remember that the victims' families also live in this society, and that if emergency leave is granted in such circumstances, the bereaved families would lose their faith in judiciary.
The petitioner's plea stated that she married the convict in 2010, and the marriage remained childless. The couple underwent several years of IVF/ICSI treatment, and she is now two months pregnant at the age of 42. She claimed she was extremely distressed, as there was no one else to look after her, and therefore sought emergency leave for her husband.
HC noted that the husband had been sentenced to life imprisonment by the additional sessions court, Thalassery, in a murder case. It further observed that once a person is sentenced, they cannot enjoy life like other citizens. While the intention of sentencing is reformative, the convict must remain inside prison, deprived of most liberties available to other citizens, for the purpose of sentencing to be achieved.
Therefore, unless an extraordinary situation exists, emergency leave should not be granted, HC concluded.

Telangana High Court on Tuesday directed the State government to submit a report on the food poisoning at State-run BC residential school for girls at Uyyalawada in Nagarkurnool district on July 26. A bench of Chief Justice Aparesh Kumar Singh and Justice GM Mohiuddin granted two weeks of time to the government counsel to secure instructions over nearly 100 girls of the school falling sick due to food poisoning. The bench passed the order in a PIL seeking directions to the government to provide hygienic and nutritious food to students as per the guidelines in fourth chapter of the National Commission for Protection of Child Rights. The plea was filed in 2023 by K.A.S. Guru Teja raising several issues relating to facilities to be provided to students in government schools and hostels. In 2024, the HC passed interim directions seeking response of the government in the matter. In another PIL, the bench instructed the government to submit before it the steps taken to protect Kaleshwaram Lift Irrigation Project in the backdrop of heavy rains lashing the State. This interim direction was passed by the bench in a batch of two PIL petitions over remedial measures to be taken during heavy rains and floods in 2020. The bench wanted the government to file a status report in the matter and posted it to August 28 for the next hearing.

Lucknow police on Monday night recovered the body of 85-year-old Dr Sarojini Kapoor, a retired Sainik School teacher and mother of Brigadier Akhilesh Kapoor, from her home under suspicious to officials, Brigadier Kapoor, who is posted elsewhere, had called his mother several times during the night but received no response. Concerned, he alerted relatives in the city to check on her. When the relatives reached the house, they found the door locked from inside, prompting them to call the officers arrived at the scene and, after gaining entry by breaking the door through the terrace, found Sarojini lying lifeless in the prayer room. Her body was sent for post-mortem, and an investigation into the circumstances surrounding her death has been initiated. Family members said Sarojini had been suffering from multiple ailments, including heart and respiratory problems. She had experienced difficulty breathing as recently as Saturday. Her husband, Manohar Kapoor, passed away 11 years ago, and a maid would visit the house daily to prepare Rakshabandhan, she had gone to her brother's home in Chowk's vegetable market area to tie him a rakhi. Hassan/Mysuru: Jain mutt seer Swastishri Abhinava Charukeerthi Bhattaraka swami has alleged that vested interests are attempting to tarnish the image of the Dharmasthala. In a press release, the Shravanabelagola-based seer said the temple and the trust managing it, are known for their social service, which serves as a model for the country. "From spirituality to women empowerment , it is involved in numerous social services aimed at empowering the society. Sadly, today he is subjected to false allegations which have no base or substance," the seer added. "It is highly condemnable that vested interests are spreading false news and are involved in defaming the temple. It is an insult to our society and culture," the seer said, adding that the attack was not just on the temple but on society as a whole. Meanwhile, in Mysuru, devotees of Dharmasthala will stage a protest Wednesday. A procession will begin from Mymul office on Bannur road at 10.30am and end at the DC office, where a memorandum will be submitted. Organisers said devotees and well-wishers are expected to participate in large numbers.
